JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRDL1-21-R-0072

1. Contracting Agency: Defense Logistics Agency - DLA Land Warren (DLA-WRN) is the responsible contracting activity for this action.

2. Description of Action: DLA-WRN proposes to award a new Firm-Fixed-Price, Indefinite Delivery Indefinite Quantity (IDIQ), 5-year Long Term Contract (LTC) to Marvin Land Systems, Commercial and Government Entity (CAGE): 064H2, for National Stock Number (NSN) 5998-01-676-1630, Auxiliary Power Unit (APU) with Container, using Army Working Capital Funds (AWCF).

3. Description of Supplies/Services: The APU with Container, NSN 5998-01-676- 1630, Part Number (PN) 57K7331, is used on the M1A2 System Enhancement Program Version 3 (SEPv3) Abrams Tank. The deliverables for this contract are for a minimum guaranteed quantity of 25 each, with a maximum quantity of 1,000 each, making a total maximum possible quantity of 1,000 each. The total estimated maximum value of this contract is $ .

100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD- STD-100 definition, altered and selected items shall have an adequate Technical Data Package (TDP), data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: The APU with Container has a PN of 57K7331; this PN consists of both the APU PN 12649297 and the container PN C18010807. The APU is the primary component of the kit and is sole sourced to Marvin Land Systems. The APU for the M1A2 SEPv3 Abrams Tank consists of a belt-driven 28-volt (V) generator, a 2-cylinder air-cooled diesel engine, a control box assembly, and a self-contained fuel supply. Power from vehicle batteries is used to drive the APU generator (in starter mode) through controls on the control box assembly. When in starter mode, the generator turns over the engine through a set of drive V belts. The engine is permitted to warm up, and then the generator is manually switched to load mode to produce electrical charge to vehicle batteries. The 28V Direct Current (DC) generator, driven by the diesel engine, produces an output of 154 to 204 amperes to maintain vehicle battery charge without vehicle engine operation. The APU is a 28V DC nominal power generation subsystem located in the rear left sponson of the M1A2 SEPv3 Abrams Tank developed for the purpose of supporting 12 hours continuous silent watch or engine off operation.

The Government does not have the pertinent technical data to enable competitive re-procurement. The Government does not own the necessary intellectual property data rights to the pertinent technical data to enable competitive re-procurement.

The Government does not have complete build to print TDPs nor does it have proprietary data rights to produce technical data needed to compete this item.

Only Marvin Land Systems has the requisite technical and engineering expertise to perform all efforts required to provide the supplies and services identified in this Justification & Approval (J&A). A substitute item cannot be used without prior approval by U.S. Army Tank-automotive and Armaments Command (TACOM). It is a critical item of the M1 Abrams electrical system and must meet the requirements specific to its intended function in accordance with Source Control Drawing 12649297/19207. This item assembly must meet the requirements and demonstrate compliance to performance, design, test, manufacture, and acceptance as specified in the Product Fabrication Specification (PFS) document SC-SA20450, including testing for compliance with electromagnetic interference (EMI) and electromagnetic compatibility (EMC) shielding and nuclear hardening. This product is a survivability item and critical for Soldier safety.

Currently, Marvin Land Systems is the only approved source to make this item for the Government. Marvin Land Systems is qualified and can meet all of the requirements stated in the PFS document SC-SA20450. This manufacturer is the sole owner of the build to print TDP. Reverse engineering is the only option for the Government to develop a competitive TDP – which is needed for competitive procurement. Reverse engineering is a multi-layered process; it requires the procurement and testing of prototypes and the release of the design. These efforts involve a significant amount of time and money. The Government does not have the funding required to develop and qualify additional sources for this product. Even if a reverse engineering effort was

As stated in section 5, there is no build to print TDP available to support a competitive procurement. This item is source controlled to Marvin Land Systems. This manufacturer owns the technical data and is the only approved source of supply for this item. The Government is not actively pursuing the development of a competitive TDP for future procurements because a significant amount of time and money would be necessary to reverse engineer, procure and test prototypes, and release the design (also stated in section 5).

TACOM Engineering requires successful vehicle level qualification testing to support the approval of a new component; the Government has no plans, or funding, to complete qualification testing at this time.

8. Market Research: A Sources Sought Notice was posted to beta.SAM.gov on 12 May 2021 and was open for 16 days. No responses were received.

Online market research was performed by Ground Vehicle Systems Center (GVSC) Engineering in March 2021, by reviewing vendor catalogs, and searching for product literature published online, in effort to find other manufacturers and/or commercial items or non-developmental items that could meet the Government needs or could be modified to meet the Government needs. While similar products are produced by several manufacturers, those items are not designed specifically for the M1A2 SEPv3 Abrams Tank, nor tested to the M1A2 SEPv3 Abrams' unique requirements to attain qualification, as described in section 5.

Findings: While APU products are produced by several manufacturers, they are not designed and tested to supply the suitable subcomponent required for the M1 Abrams Tank. None of the available products conform to the unique specifications per SC- SA20450 PFS for the APU. Additionally, as the Government does not have a complete TDP, it cannot be verified that any commercially available parts will conform to the unique space claim required within the AGT1500 gas turbine engine.
