About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Army Contracting Command-Detroit Arsenal (ACC-DTA). The procurement is for a Bracket Assembly, Detector (NSN 5340-01-667-2638) with an estimated total quantity of 500 units and a total estimated contract value of $3,244,000. The contract will be a five-year, Firm-Fixed-Price Requirements contract awarded to Meggitt Safety Systems, Inc., utilizing Army Working Capital Funds.
The J&A justifies sole-source procurement under 10 U.S.C. 2304(c)(1) because Meggitt Safety Systems is the only approved source and possesses proprietary technical data for the component. A Sources Sought Notice was issued on SAM.gov on May 11, 2021, with two contractors (Mistral Group and Precision Welding) responding with capability statements. However, the government lacks a complete technical data package and cannot competitively procure the item. The contract will include clauses to maximize small business opportunities, and the government will continue to request that Meggitt Safety Systems license the technical data package to enable potential future competitive re-procurement.
