SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1 Scope of Contract
A. This solicitation and any resulting contract(s) are for maintenance of Forest Service roads on the Oakmulgee Ranger District. Task Orders may be requested on other Ranger Districts within the National Forest in Alabama. Upon such request the contractor and the government shall negotiate appropriate line item adjustments for the expense of performing work on a district other than the Oakmulgee Ranger District.
B. The Contractor shall furnish the necessary personnel, material, equipment, facilities, supervision, transportation, operating supplies, and incidentals to perform the ordered tasks.
C. Road maintenance includes services, such as: grading; ditch cleaning; cleaning culverts; minor culvert and drainage repair; slash busting; mowing, and spot surfacing.
D. Road Construction includes activities, such as: replacing culverts; patching asphalt; major slump/slide removal; bridge repair; and aggregate re-surfacing.
E. Task Orders may be requested for minor construction for items that are not pre-priced in section “B”. For these orders the Government will prepare a separate Scope of Work and Bid Schedule for the requested Task Order.
F. The estimated quantities stated in the Schedule of Items is the average annual volume of work expected under this contract. The actual volume of work will depend upon available funding, weather, and road conditions.
G. The Forest Service may order specific equipment, with operator, on a per hour basis for: (1) opening a forest road that has become overgrown with brush and trees; or (2) clearing debris dams from culverts during storm events. In both cases, at the time of placing the task order it is not possible for the Forest Service, or the Contractor, to estimate accurately the extent or duration of the work, or anticipate the cost of performance with any reasonable degree of confidence. Therefore, the Contractor shall provide the ordered equipment, with operator, to perform tasks identified by the Forest Service.
H. District maps are available at the Oakmulgee Ranger District office, 9901 Hwy 5 Brent, AL 35034. The Government will supply the contractor with 2 copies of the administrative district map. A PDF copy of the map can be supplied for the contractor to print additional copies at their own expense.
C.2 Furnishing of Material and Equipment
A. Unless otherwise stated in the Bid Schedule, the contractor shall furnish all material and equipment required for performance of the contract. All material and equipment shall comply with the specifications.
B. The Contractor shall furnish and deliver the material and equipment to the work site in such a manner that their quality and fitness for the work is preserved.
C. The Contractor shall start work when directed within three calendar days from the date of the work order.
D. The Contractor shall submit a weekly operating schedule demonstrating a clear path to completion of the Task Order within the specified period of performance. Failure to perform work and comply with the operating schedule shall be grounds for issuance of a Notice of Non-Compliance.
Exceptions to the operating schedule shall be made for weather, fire, or directed emergency response, as determined by the Contracting Officer. The Contractor shall document and notify the COR for delays.
Once work resumes, the Contractor shall submit a revised operating schedule.
E. The Contractor shall be responsible for furnishing warning devices and complying with the safety standards and traffic management procedures in accordance with the Manual of Uniform Traffic Control Devices.
C.3 Coordination of Specifications
A. “800 Series” maintenance specifications
The maintenance specifications apply to all line items identified as subject to SCA wages.
B. FP-14 Standard Specifications for Construction of Roads and Bridges on Federal
Highway Projects
The FP-14 specifications shall apply to all line items subject to DBA wages and individually issued construction task orders. A copy of these specifications may be obtained at:

C. Forest Service Supplemental Specifications
The supplemental specifications modify the FP-14 specifications for USFS application.
C.4 Definitions, Abbreviations, and Quantity Measurement Terms
A. Definitions - Certain specifications are common to contract and timber sale requirements.
Where ever in these specifications, or in other contract documents, the following terms or pronouns in place of them, are used, the intent and meaning shall be interpreted as follows:
Base Course - The layer or layers of specified or selected material of designed thickness placed on a sub-base or a subgrade to support a surface course. (See Illustration of Road Structure Terms.)
Berm - A curb or dike which controls roadway runoff water. Berms commonly parallel road centerline.

Channel - A natural waterway leading into or away from a culvert or bridge.
Contract Modification - A bilateral modification is a written agreement between the Government and the Contractor, documenting a negotiated equitable adjustment resulting from the issuance of a Change Order, or to reflect other agreements modifying the terms of the contract.

Contractor - The individual, partnership, joint venture, or corporation undertaking the execution of the work under the terms of the contract.
Culvert - Any structure which provides a passageway, drain, or waterway under a road or embankment.
Cross Ditch - A shallow ditch placed across the roadbed to remove water from the roadbed surface which can be driven across by full size pickups or by other high clearance vehicles; usually placed diagonally to centerline. (See drawings if applicable.)
Lead-off ditch - A specific type of man-made ditch used to remove water from roadside drainage ditches, the roadway, cattle guards, or drainage structures such as culverts and drainage dips.
Ditch - A relatively long narrow excavation placed to collect or disperse water.
Ditch Dam – Constructed barrier which channels water flowing in a ditch thru a culvert inlet and prevents the water flow from continuing down the ditch and bypassing the culvert inlet.
Drainage dip - A drainage structure which was previously constructed within the roadbed surface to form a uniform depression which allows routine passage of standard passenger cars while diverting water from the traveled way. (See drawings if applicable).
Drainage ditch - A specific type of furrow ditch located parallel to and abutting the roadbed. (See Illustration of Road Structure Terms.)
Drainage structure - A general term denoting any man made device placed to control water movements along, under or across the roadway. Includes ditches, culverts, bridges, etc.
Drawings - Depictions detailing maintenance contemplated including all road listing diagrams, maps, and performance schedules included in the contract.
Equipment - All machinery, operating supplies and tools necessary for the proper performance and acceptable completion of the work.
Excess Material - Material from the roadway excess to that needed for maintenance of roadway.
Foreslope - The slope of the ditch section nearest to the traveled way. (See Illustration of Road Structure Terms.)
Furrow ditch - Any ditch which nominally parallels the road centerline and diverts water from natural flow patterns to protect road slopes, roadbed, or downslope areas. Furrow ditches may be located within the roadway or roadside, but as used in this contract excludes drainage ditches.
Grade - The trace of vertical plane, as shown on the drawings, intersecting the top surface of the road.
Materials - Any substance specified for use in the performance of the work.
Measurement - Method of determining and expressing the quantities of work
Nominal dimensions or Weights - The numerical values shown on the drawings or in the specifications as measurements for the work.
Order - A written order by the Government directing fulfillment of work requirements under the terms of the contract
Original Contract Quantities - Those estimated quantities shown in the Schedule of Items as awarded.
Patching - Minor repairs incidental to recurring maintenance which is not substantial in nature.
Paved Surface or Pavement - Denotes asphalt, concrete, or other stabilized materials excluding natural aggregates. Dust palliative treatments are not considered as pavement.
Reasonably Close Conformity - Means compliance with customary maintenance tolerances where working tolerances are not specified.
Right-of-Way - A general term denoting land, property, or interest therein acquired for or devoted to a road.
Roadbed - The portion of a road between the intersection of the subgrade and side slopes, excluding that portion of the ditch below the subgrade. (See Illustration of Road Structure Terms.)
Road Listing - A listing of road locations and any established work priorities included in the contract as a drawing to indicate current estimates of contract timing; subject to revision in accordance with Contract Section F in developing the work schedule.
Road Maintenance Levels Definition as used in this Contract:
Maintenance Level 4 & 5: Roads with a moderate to high degree of user comfort and convenience. These roads receive maintenance on a routine basis, normally with brushing done yearly or biyearly.
Maintenance Level 3: Roads maintained for use by a prudent driver in a passenger car. These roads generally receive maintenance on a routine basis, normally with brushing done every 3 to 4 years.
Maintenance Level 2: Roads maintained for use by high clearance vehicles. These roads generally receive only drainage related maintenance on a routine basis, and usually getting relegated to the lowest priority for brushing. Many have become mostly brushed in.
Roadside - See Illustration of Road Structure Terms
Shoulder - The portion of the roadway contiguous with the traveled way for the accommodation of stopped vehicles, for emergency use, and for lateral support of pavement structure. As used in this contract, the term is restricted to roads having an asphalt surface. (See Illustration of Road Structure Terms).
Slide - A concentrated deposit of materials from above or on the backslope extending onto the traveled way or shoulders, whether caused by mass land movements or accumulated raveling.
Slump - A localized portion of the roadbed which has slipped or otherwise become lower than the adjacent roadbed and constitutes a hazard to traffic.
Supplemental Specifications - Specifications which detail conditions and requirements peculiar to the individual project.
Standard Specifications - Broadly-used (for instance throughout the Pacific Northwest Region of the Forest Service) specifications for specific divisions of the work, such as: Blading, Paved Surface Cleaning, Ditch Maintenance, etc.
Subgrade - Top surface of roadbed upon which sub-base, base course, or surface course was constructed. (See Illustration of Road Structure Terms.)
Surface Course - The top layer of a pavement structure, sometimes called the wearing course, usually designed to resist skidding, traffic abrasion, and the disintegrating effects of climate. (See Illustration of Road Maintenance Terms.)
Traveled Way - The portion of the roadway for the movement of vehicles, exclusive of shoulders on asphalt paved roads. For purpose of this contract, traveled way includes turnouts and curve widening.

Turnouts - A short auxiliary lane on a one lane road provided for passage of meeting vehicles.
Unsuitable Material - Material removed during maintenance which must be disposed of in designated locations. Examples - clay, serpentine, or other unstable material or material with substantial amounts of vegetation or other objectionable matter.
Waterbar - A deeper type drainage ditch which is intended for passage of high clearance vehicles only.

C.6 Abbreviations
Whenever in these specifications, or in other contract documents, the following terms, or pronouns in place of them, are used, the intent and meaning shall be interpreted as follows:
1. AASHTO - American Association of State Highway and Transportation Officials.
2. CS - Commercial Standard issued by U.S. Dept. of Commerce.
3. EPA - Environmental Protection Agency.
4. FAR - Federal Acquisition Regulation.
5. FED SPEC - Federal Specifications.
6. FSS - Federal Specification and Standards.
7. MSHA - Mine Safety Health Administration.
8. MUTCD - Manual of Uniform Traffic Control Devices.
9. NBS - National Bureau of Standards.

C.7 Quantity Measurement Terms
A. Measurement under the contract shall be according to standard measure.
B. The methods of measurement and computation will be those necessary to accurately determine the quantities of materials furnished and work performed.
C. All items measured by the mile will be parallel to its longitudinal centerline, unless otherwise shown on the drawings.
D. A station when used as a definition of term or measurement will be 100 feet.
E. Miles shall, in the absence of known distances from existing plans or surveys, be determined by the Government using a calibrated survey odometer or distance measuring device operated on the traveled way at or parallel to road centerline.
F. Trucks used to haul material measured by truck weight shall be weighed empty at least once daily, and each truck shall bear a plainly legible identification mark. Weigh tickets furnished by the Contractor from certified scales will be used to determine weight measurements. Materials measured by the cubic yard in hauling vehicle shall be measured therein at the point of delivery. Vehicles may be of any size or type, provided that the box is of such shape that the actual volume may be readily and accurately determined.
G. Measurement by the acre will use the length and width treated. Measurement of width will approximate significant slope breaks, but will not include minor deviations along the slopes.
H. Volume of bituminous products will be measured at 15.6 degrees C, using ASTM D-1250 for asphalt. Emulsified asphalt shall be measured at 15.6 degrees C, or by converting the volume at another temperature to volume at 15.6 degrees C by means of the following formula:

T degrees C = temperature of the emulsified asphalt at the time the volume is measured.
I. The term "Lump Sum" when used in the Schedule of Items will mean the complete unit as required by or described in the contract.
J. Measurement will be made of each item or unit of work, as shown in the Schedule of Items, completed and accepted in accordance with the contract provisions, specifications and drawings.
C.8 Order of Precedence
Any inconsistency in this solicitation or contract shall be resolved by giving precedence in the following order:
(a) The Schedule (excluding the specifications);
(b) Representations and other instructions;
(c) Contract clauses;
(d) Other documents, exhibits, and attachments (Supplemental Specifications & Drawings); and
(e) The specifications.
C.9 Technical Specifications for Maintenance of Roads
The specifications are numbered in the "800" series codes. Only those sections which could be applicable to this contract are included. There will be gaps between the section numbers due to the fact that many sections have been purposely omitted or because certain specification sections have been reserved for possible future inclusion in the "800" series.
C.10 BioPreferred Program Requirements
The Contractor shall comply with Section 9002 of the Farm Security and Rural
Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal
Environmental, Energy, and Transportation Management,” and the Federal Acquisition
Regulation to provide biobased products.
The Contractor shall utilize products and material made from biobased materials (e.g. biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards.
All supplies and materials to be used in the performance of work described herein are subject to the approval of the
Contracting Officer Representative (COR).
The following is an example list of products that may be used in this contract for operations and maintenance for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

Biobased products that are designated for preferred procurement under USDA’s
BioPreferred program must meet the required minimum biobased content as stated in the
USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content.
In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other biobased products.
The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract.
Additionally, the winning Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. The Contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes.
The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification.
The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products under Service and Construction Contracts.
Within thirty (30) days of contract award, the Contractor shall submit an Operations and
Maintenance Plan. This submittal shall be approved by the COR in writing. The Contractor shall not commence work until this submittal is approved by the COR in writing.
The Plan must be reviewed and updated annually, and as required by the COR. The Plan must contain and define the following elements:
1. The Contractor’s written policy stating its commitment to the use of biobased products, employee health and safety, and sound environmental management practices.
2. Detail on how the Contractor intends to keep abreast of the increasing availability of biobased products and how any new or improved products will be incorporated on an ongoing basis into contract performance.
3. Proposed biobased operations and maintenance products which must be selected in accordance with the criteria included above. At a minimum, the Plan must identify products by brand name for each of the product types.
NOTE: A Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.
The product guides which define standard operating procedures for instructing staff in the proper use, storage, and disposal of biobased products; proper maintenance of equipment; and other procedures/instructions to accomplish work under this contract.
The Contractor shall provide data on the quantity and dollar values of biobased products used in this contract. The data will be submitted to the COR quarterly.
A demonstration of proper use, an effective training program, and technical assistance are essential to the success of the purchase and use of some biobased products that may function differently than a conventional product. Therefore we will look for a Contractor who will 1) demonstrate products, and 2) when selected, offer any necessary training to all of the construction staff and 3) be available with technical assistance to trouble shoot problems.
C.11 Applicability of the Service Contract Act (SCA) and Wage Rate Requirements (Construction)
(DBA)
The Contractor is responsible for compliance with the Service Contract Act (SCA) and Wage Rate Requirements (Construction), formerly known as the Davis-Bacon Act (DBA). The Department of Labor (DOL) is responsible for enforcement of the SCA and Wage Rate Requirements (Construction).
Contractor shall contact the DOL to resolve any questions concerning the applicability of the SCA or
Wage Rate Requirements (Construction). The DOL has provided the Forest Service with the following guidelines concerning road maintenance activities.
The SCA applies to the following typical activities on, or along, a paved road:
Brushing and mowing;
Ditch cleaning and brushing;
Sign, cattleguard, gabion, and guardrail repair;
Minor patching performed in conjunction with normal maintenance activities;
Cleaning culverts;
Minor slump/slide removal;
Litter cleanup; and
Minor culvert and drainage repair.
The SCA applies to the following typical activities on, or along, a unpaved road:
The above noted activities;
Grading;
Rock raking; and Removal of oversized material.
The Wage Rate Requirements (Construction) (DBA) applies to the following typical activities:
Patching of asphalt or other pavements;
Replacing culverts;
Striping pavements;
Rehabilitation/recycling pavements;
Fog or chip sealing;
Major slump/slide removal;
Bridge maintenance; and Aggregate surfacing, except minor spot surfacing.
