1. Contracting Activity: U.S. Army Contracting Command – Rock Island (ACC-RI) Rock Island Arsenal, Rock Island, IL 61299-8000.
2. Description of Action: JMPB/CBP at Pine Bluff Arsenal requests a Firm Fixed Price contract with Molecular Products Inc. to test their new carbon product in live filters built at Pine Bluff Arsenal. ACC-RI projects award for
, Army Procurement Funds funds. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

4. Authority Cited:
10 U.S.C. 3204(a)(3), as implemented by Federal Acquisition Regulation (FAR) 6.302-3, Industrial mobilization; engineering, development, or research capability; or expert services.
5. Reason for Authority Cited:
As described in FAR 6.302-3(b)(1)(iv)(B), full and open competition need not be provided for when it is necessary to award the contract to a particular source or sources to create or maintain the required domestic capability for production of critical supplies by limiting competition to items manufactured in the United States, its outlying areas, or Canada.
The purpose of this contract is to determine if Molecular Products Inc. (MPI) has the skills, equipment, and production facilities to produce acceptable ASZM-TEDA Carbon with the required density, carbon particle size, levels of impregnation and gas life needed to successfully produce the M48, M49 and M98 filters. It will also demonstrate MPI can produce MIL-DTL-32101B w/Amd 1 compliant ASZM-TEDA Carbon on a scale that will support the governments filter production requirements.
To qualify to produce ASZM TEDA Carbon, vendors must demonstrate that they can successfully produce carbon that passes the preliminary testing process to the standard of MIL-DTL-32101B w/Amd 1. The preliminary testing is done at the vendors expense.
Only has passed all the requirements and is currently fully capable to produce ASZM-TEDA Carbon for the Government. Through Market Research, multiple additional vendors were identified that could potentially produce this carbon, however Molecular Products Inc
(MPI)/CAGE 4TMH3, was the only source who expressed interest in taking the necessary steps to become qualified and has already passed the preliminary test included in the MIL-DTL-32101B w/Amd 1 standard. This procurement will allow MPI to produce a full production run to demonstrate that they can successfully produce this carbon.
Only one brand of Carbon, produced by , has been available for production of Chemical and Biological filtration systems and individual filters since the 1990s. The government, and commercial manufacturers producing for government consumption, have been forced into a sole source purchasing pattern from Calgon. TACOM has requested filters be manufactured for testing, shelf life and distribution to approve Molecular Products Inc. as a second source for ASZM-TEDA.
Failure to achieve this acquisition from Molecular Products Inc. will halt First Article Testing, approval requested by Pine Bluff’s Customer (TACOM) and acceptance of a product that could provide competition into the market and remove the restriction to only purchase from in the future.
This purchase is an attempt to create open competition and provide multiple sources in the event the government has a need to ramp up production due to a war or peacekeeping effort. As well as create a secondary source to maintain current production operations should Calgon experience production delays.
6. Efforts to Obtain Competition: ACC-RI shall publish the notices required by FAR
5.201. Because this is a sole source action, effective competition is not applicable. This requirement does not present any opportunities for subcontracting.
7. Actions to Increase Competition: Acquiring, testing, and building confidence in MPIs ASZM-TEDA carbon production is an attempt for the government to increase competition and provide options in the market for future production.

A fair and reasonable price will be determined in accordance with FAR 15.404-1(2)(ii) Comparison of the proposed prices to historical prices paid and FAR 15.404-1(2)(v) Comparison of proposed prices with Independent Government cost estimate. Certified cost or pricing data will not be requested in accordance with FAR 15.403-1(b)(3) as the product requested can be produced commercially.
