DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018)

1. The Defense Logistics Agency (DLA) Land and Maritime is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity’s needs are described as follows:

The use of the authority cited below:
Acquisition Method Code (AMC) 1. Suitable for competitive acquisition for the second or subsequent time.
The use of the authority cited is based on:
Acquisition Method Suffix Code (AMSC) C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.
The acquisition will be synopsized and a pre-solicitation notice posted on the Government Point of Entry (GPE) website (https://sam.gov) website on or after 25 June 2021.
6. I hereby determine that the anticipated cost to the Government will be fair and reasonable based on buyer analysis.
According to the Small Business Association, both manufactures have been determined to be small businesses for the North American Industry Classification System (NAICS) code (332911) of this part. This information is in Tab 8 of Stack 1.
Based on market research, one of the approved sources, SAF Industries, identified by Commercial and Government Entity (CAGE) Code 26044 is expected to provide a proposal for this item. The Government also expects to receive a proposal from New England Specialty Components, identified by CAGE Code 1WAC1, a distributor. Based on New England Specialty Components’ response to the market survey questionnaire, they will be sourcing the item from Crissair, the other approved source. Therefore, the Government expects to receive two proposals offering the product of two different small business manufacturers for this procurement. There were no responses received from the Sources Sought notice posted to the GPE on 16 April 2021.
This item was previously auto awarded with acquisition values well below the Simplified Acquisition Threshold. It has been awarded to SAF Industries, an approved source, and New England Specialty Components, a distributor.
The acquisition is below the Truth in Negotiation Act threshold of $2,000,000, and certified cost or pricing data (CCPD) will not be required. Other than cost or pricing data may be required to determine the price fair and reasonable. Additional methods may be used in determining if the offered price is fair and reasonable if needed. If necessary, a price analysis will be conducted utilizing historical price data from most previous award and estimated annual demand quantity for the LTC.
7. Market Research
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
A market survey was conducted on/during 14 April 2021-23 April 2021.
Total number of vendors contacted: Three
Response Received: SAF Industries LLC, an approved manufacturer, and New England Specialty Components, a distributor, responded to the market research request. Both expressed an interest in an LTC and ability to fulfill product demand in a timely manner. The responses are summarized in the table below:

Techniques used to conduct survey: Emails were sent to approved source point of contact listed in the GPE.
Types of information requested: Contact information, interest in an LTC and structure of the LTC, commerciality, minimum and maximum quantities and values, delivery times and quantities, and price breaks.
8. Additional facts supporting other than full and open competition are:
Based upon the technical data, acquisition of this part is restricted to source specified on source control, altered item, or selected item drawings/documents.
A list of approved sources, if any, indicating an interest in the acquisition is: See table above.
9. The following actions are being taken to identify additional sources: A market research questionnaire was sent to the vendors listed in the procurement history, SAF Industries and New England Specialty Components, and to Crissair, the other approved source, on 14 April 2021.
Two responses were received; Crissair did not respond. Additionally, a sources sought notice was published on 16 April 2021 on the GPE. No responses to the sources sought notice were received.
