Single Source Justification (Simplified Acquisition)
Section A: General Contract Information
Contracting Activity: 724 EABS/CONF Purchase Request/ Identification Number:
PRO 0104
Project/Program Name: Water Treatment Plant Parts (WWTP) Estimated Contract Cost (including Options):
Section B: Description of the Supplies/Services Required Air Base (AB) 201 is in need of waste water treatment plant parts (WWTP) designed for the latrine/laundry trailers already installed. World Housing Solution, INC. (WHS) engineered and supplied both the WWTP and latrine/laundry trailers provided on contract FA5422190033. WHS. is the original equipment manufacturer and/or distributor of this material, and proprietary data restraints may apply.
Section C: Justification for Soliciting from a Single Source
The waste water treatment plant services the existing plumbing infrastructure for AB 201. WHS. is the only company fully aware of all pre-existing equipment in the trailers. The recycling/ filtration system is specifically designed to operate as a whole unit. WHS has already confirmed they are the only manufacturer of the equipment needed for the WWTP. Substituting parts or piece-mealing parts over several contractors would only lead to inadequate quality of operation, failure of treatment system and loss of latrine/laundry trailer use.
Section D: Efforts to Obtain Competition After receiving the part numbers from WHS, the part numbers required to solicit, are their parts that they have proprietary rights to. Email traffic with customer and vendor also reinforced the idea that no other source could provide exactly what we needed. In the end, soliciting to a wholesaler or another company would only slow down the entire acquisition process. The data needed for another company to accurately bid on these spare parts could only be provided from WHS in the first place.
Section E: Steps to Preclude Future Single Source Awards
The WWTP and latrine/laundry trailer system was designed for this deployed location in Agadez, Niger. Expansion of AB 201 will require either to re-engage with WHS for more equipment or a re-compete for a whole new system. Market research must be conducted by Civil Engineering to see if companies can offer compatible systems that meet current regulations and standards.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
