About this file

This is a Justification and Approval (J&A) document authorizing other than full and open competition for a sole source contract to L3 Harris for storage, preservation, and parts removal services for two unflyable Coast Guard HC-27J aircraft (CGNR 2704 and CGNR 2708).

The Department of Homeland Security, U.S. Coast Guard is awarding a 3-year firm-fixed-price contract to L3 Harris Integrated Mission Systems in Waco, Texas to provide long-term outdoor storage with proper aircraft mooring requirements at Texas State Technical College (TSTC) Airport. The aircraft became unflyable after the Coast Guard canceled its HC-27J missionization program in May 2024 during L3 Harris's installation of mission systems. Only L3 Harris and TSTC had available storage space, but TSTC's closed taxiway location lacked proper aircraft tiedown provisions. L3 Harris was selected as they had suitable ramp area with proper mooring capabilities to prevent wind damage. The Coast Guard is developing plans to either transfer the aircraft to another government agency or cannibalize usable parts while recycling remaining materials on site.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. § 3204 (c)(1)

Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement

Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

1. Agency and Contracting Activity.

The Department of Homeland Security, United States Coast Guard (USCG), Medium Range Surveillance (MRS) Aircraft Program (CG-9312) prepared this justification for other than full and open competition.

2. Nature and/or Description of the Action being Approved.

This Justification and Approval (J&A) authorizes and approved the issuance of a sole source firm fixed price contract action to L3 Harris for services required to preserve, store, and remove aircraft parts from two unflyable Coast Guard HC-27J aircraft.

The proposed supplier is:

L3 Harris Integrated Mission Systems 7500 Maehr Road Waco, Texas 76705-1647

3. Description of Services.

The services being acquired are provide suitable long-term storage for two unflyable Coast Guard HC-27J aircraft located at Texas State Technical College (TSTC) Airport Waco Texas.

Other services include aircraft preservation and removing aircraft parts. Suitable long-term storage is outside storage that supports HC-27J aircraft mooring requirements with controlled access to ramp and runway areas. The anticipated contract will cover a period of three years with an estimated total contract value of for suitable long-term storage, and planned aircraft preservation and parts removal tasks.

4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. § 3204(a) implemented by the FAR Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Require Use of the Authority Cited.

U.S. Navy Air System Command (NAVAIR) Naval Air Warfare Center Aircraft Division (NAWC-AD) contracted with BAE Systems Technology Solutions and Services to produce and install mission systems on two Coast Guard HC-27J aircraft. BAE Systems subcontracted with L3 Harris Integrated Mission Systems Waco Texas to install the mission systems on the two Coast Guard HC-27J aircraft. In Fiscal Year 2022 (FY22) two Coast Guard HC-27J aircraft, CGNR 2704 and CGNR 2708, were inducted into mission system installations at the L3 Harris facility located TSTC Airport Waco Texas. In May 2024 while L3 Harris Waco Texas was installing mission systems on CGNR 2704 and CGNR 2708, Coast Guard cancelled its HC-27J missionization program. With incomplete mission system installations, CGNR 2704 and CGNR 2708 are unflyable. The Coast Guard has no plans to complete CGNR 2704 and CGNR 2708 mission system installations, and no plans to return these two aircraft back to a flyable configuration. NAWC-AD is terminating the BAE Systems contract and under that contract L3 Harris is moving CGNR 2704 and CGNR 2708 from its installation hangar to suitable outside storage at L3 Harris TSTC Airport Waco Texas to make space available for other business opportunities.

Only two entities located at TSTC airport have available storage space, TSTC and L3 Harris.

TSTC offered a closed taxiway, but that location does not have provisions to meet HC-27J mooring requirements. L3 Harris offered available aircraft ramp area with suitable provisions (aircraft tiedowns) that meet HC-27J mooring requirements. Without tiedowns, normal wind conditions could tip HC-27J aircraft and caused significant damage. This is also a preventable hazard to surrounding personnel and equipment. Both TSTC and L3 Harris have hangars, but those hangars are unavailable for long-term storage.

6. Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable.

Coast Guard directly solicited TSTC and L3 Harris. Both TSTC and L3 Harris responded with quotes and proposed storage sites. No other sources are available.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.

In accordance with FAR 15.402(a) & (a)(2), the Contracting Officer is required to purchase all supplies and services from reasonable sources at fair and reasonable prices and will require the Contractor to submit certified cost or pricing data or other than certified cost or pricing data, in order to perform an analysis of the proposal to ensure that the price is fully justified as fair and reasonable to the Government. This analysis will include input by the Government Technical Analyst and Contract Specialist. Pertinent data will include prior acquisition history for comparable supplies for similar efforts.
