by Trijicon, Inc (0FL29) meet the technical and quality standards identified by the military services.

Therefore, Trijicon, Inc (0FL29) is uniquely qualified to supply these items.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

(X) The acquisition will be synopsized on www.SAM.gov at least one day prior to solicitation opening date. Sources Sought Notice is further discussed in Paragraph 8 below.

(X) Manufacturer of exact products identified in the market research will be solicited.

(X) Dealers of the manufacturer will be solicited

(X) Solicitation will be posted on DLA Internet Bid Board System (DIBBS) for 10 days.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Prices will be determined fair and reasonable through price analysis based upon the application of the Producers’ Price Index (PPI) to the past acquisitions. Should more than one offer be received, proposed prices will be compared among all offers to determine if price competition exists. Items are commercial and proposed prices will be compared with commercial prices for the same items. Contract is firm-fixed price with a contract length of one three-year base period and two one-year options that will be exercised at the Government’s discretion. A price analysis for future contract years will be conducted based on the Global Insights Producer Price Index (PPI) forecasts. Since the items are commercial, certified cost and pricing data is not required per FAR 15.403-1(b)(3). Buyer will use all methods stated to determine all contract years and quantity range prices fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

Contracting Officer reviewed buy history for potential sources (See Attachment 2 – Procurement History).

Buy history shows that items are provided by dealers of Trijicon, Inc (0FL29). Most recent buys have been delivery orders issued off of basic contracts. Contracting Officer researched the availability of the previous J&A for the most recent buys for each NSN. Both NSNs were included on solicitation SPELX-16-X-0045. The J&A for this solicitation is provided as Attachment 3, titled, J&A for SPELX-16-X-0045.

Market Survey [10 U.S.C. 2304(f)(3)(D)]:

Market research was conducted during October 2021 – December 2021.

Total number of vendors contacted: 10

Trijicon, Inc (0FL29), Small Business Manufacturer Kampi Components Co, Inc (7Z016), Small Business Dealer Lawmen’s and Shooter’s Supply, Inc (0B2A2), Small Business Dealer Atlantic Diving Supply (1CAY9), Small Business Dealer Packaging People, Inc (1GC30), Small Business Dealer U.S. Tactical Supply, Inc (1T5U0), Small Business Dealer RSR Group (1XQL9), Large Business Dealer Tactical & Survival Specialties, Inc. (0UWS0), Small Business Dealer Monarch Products Corp (72KG0), Small Business Manufacturer Gun Accessory Supply (36BE2), Small Business Dealer

The only sources to respond were Packaging People, Inc, RSR Group, and Trijicon, Inc. Both the Packaging People and RSR Group stated they were not interested. The Packaging People stated they can no longer supply these items. RSR Group stated that due to market volatility they are unable to commit to any fixed price contract. Trijicon, Inc also responded but will defer to its distribution network to respond and support the

LTC.

Kampi Components (7Z016) is currently performing on SPE7LX17D5010 for NSN 1240015354485, and Atlantic Diving Supply (1CAY9) is currently performing on SPE7LX17D5011 for NSN 1240015816621. Both contracts expired February 27, 2022. Because neither Atlantic Diving Supply nor Kampi Components responded to market research requests, Contracting Officer contacted each again by email asking if either source was interested in submitting an offer for the successor contract. Neither source responded to the second request to provide information.

CUI

Techniques used to conduct market research: Market survey questionnaires, review of buy history, Sources Sought notice, and internet search on exact items.

Types of information requested: Information included business type, business size, interest in LTC and length of contract, commerciality of the item, approximate price and delivery, inspection and packaging compliance, and ability to provide Certified Cost & Price data.

Market research conducted by the Contracting Officer revealed the following:

Search of the exact part number found both items commercially available. Both items are available for purchase on trijicon.com, the approved manufacturer’s website. Items are also available for purchase on amazon.com.

For solicitation SPELX-16-X-0045, the Justification and Approval (J&A) document stated that solicitation was issued utilizing FAR 13.5 procedure because Contracting Officer determined items as commercial.

Checked the Commercial-Off-The-Shelf (COTS) line in the Material Master for each item to verify if the COTS line was populated with a either a “Yes”, “No”, or is left blank. The COTS line for each item was blank.

Based on the results of the research conducted, Contracting Officer determined that the subject items are commercial of type as defined in FAR 2.101, Definitions – Commercial Items – Paragraph 1(i).

In order to identify other possible sources, a Sources Sought notices was issued on SAM.gov on December 21, 2021, with a response date of December 30, 2021. No source responded to the notice.

9. Additional facts supporting other than full and open competition are:

Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

Additionally. forecast information is available to all potential sources for both sole source and competitive items. The DLA Supplier Requirements Visibility Application (SRVA) is a database that is available via the DLA internet Bid Board System (DIBBS.) SRVA provides potential sources the opportunity to search for information on DLA’s anticipated requirements based on updated monthly forecasts. Essentially it provides 24 months of sole source and competitive projected purchase order quantities. Potential alternate sources for current sole source items can easily see DLA’s forecasted procurements and can contact the Value Management Unit to become approved sources for sole source and code and part number items. The DLA Land & Maritime Value Management Unit continually seeks out sole source, limited competition, over-priced, low reliability and hard to buy items to improve their value and support posture. The DLA Land & Maritime internet website contains information for all potential sources on how to challenge prices, how to submit a Value Engineering Change proposal, a link to DoD’s Value Engineering program and the necessary contact info for both the DLA Value Engineering program and the DoD Value Engineering program.

10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state)

There are no sources that expressed interest in the long term contract

11. The following actions are being taken to identify additional sources:

The Government will continue to conduct market research, to see if changes occur in the marketplace that would enable future actions for these items to be competitive. The Government will also include in the solicitation DLA Procurement Notes L04 Offers for Part Numbered Items and DLA Procurement Note, M06 Evaluation of Offers for Part Numbered Items. Should alternate offers be received, sources will be encouraged to submit a source approval request (SAR) package that will be referred to the engineering activity for consideration of future procurements.

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief. If not exceeding $750,000, this signature serves as the approval.
