I. Agency and Contracting Activity.
United States Air Force 1st Special Operations Contracting Squadron/PKB 350 Tully Street Hurlburt Field, FL 32544
II. Nature and/or description of the action being approved.
This action is a modification to Contract FA441718C0017, Capital Project 1018486, Renovate Community Commons, Bldg.
90337.
III. Description of supplies/services required to meet agency needs (including the estimated value).
Renovate landing zone restrooms and library restrooms and paint existing offices, the Landing Zone, and the game rooms . This work includes:
Removing all plumbing fixtures, counter tops, bathroom washroom accessories, diaper changing stations, floor covering, wall tile, toilet partitions, signage, lighting, speakers, and ceiling air diffusers/grilles in all restrooms.
Providing new plumbing fixtures, counter tops, bathroom washroom accessories, diaper changing stations, floor covering, wall tile, toilet partitions, lighting, and air diffusers/grilles in all restrooms.
Repairing, prepping, and painting all walls in five existing offices (3 adjacent to Landing Zone and 2 adjacent to Library Foyer), the Landing Zone, and two game rooms. Includes removing wall bases and replacing with new rubber wall bases, removing exposed fasteners, removing textile surfaces, painting behind portable objects and surface mounted items, and patching wall surface defects to match adjacent surfaces.
IV. Statutory authority permitting other than full and open competition.
10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2), and required by FAR 6.303-2(b)(4).
V. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above (applicability of authority).
Contract FA441718C0017, Capital Project 1018486, Renovate Community Commons, Bldg. 90337, is already a contract in place and on going for substantial renovations to this building previously awarded to The Green-Simmons Company, Inc., on 27 September 2018
. The contractor currently has control of this building and has not issued Beneficial Occupancy back over to the Government. The work required under this modification will require some overlap in renovation work already required under the current contract. Should this work be competed and not awarded to the current contractor, would require work already being completed to be re-worked to tie into the new work, resulting in additional cost to the Government and potentially void the warranty for the work under the current contract should future warranty claims be needed. Also, should this work be competed and not awarded to the current contractor, it will result in additional costs to the Government and time for mobilization for the new contractor. Since the current contractor is already mobilized and working in the building, this additional cost and time would not be needed.
Lastly, should this work be competed and awarded to a different contractor, it would require a site visit prior to proposals for any prospective bidders and coordination of the work between the two contractors performing work in the building which will delay completion of the work required under both requirements.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, March 2020 FOR OFFICIAL USE ONLY Page 3 of 3March 2020 FOR OFFICIAL USE ONLY Page 3 of 3 including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under
FAR 5.202 applies.
A Notice of Contract Action (NOCA) will be issued IAW FAR 5.201(b)(1)(ii). The NOCA will be publicized once this Justification and Approval is approved. It was throughly discussed amongst base Civil Engineering and Contracting Squadrons as to whether or not this work would be competed or accomplished by other means. It was determined it would not be due to the information cited in Paragraph V above.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated cost to the Government will be fair and reasonable. The original award was determined fair and reasonable at time of award. Market research and information utilized to determine previous in scope modifications fair and reasonable will be relied upon to determine the cost of this modification fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
It was throughly discussed amongst base Civil Engineering and Contracting Squadrons as to whether or not this work would be competed or accomplished by other means. It was determined it would not be due to the information cited in Paragraph V above.
