The vaccines will be provided by Moderna, Novavax, Janssen, and Sanofi Pasteur. Battelle Memorial Institute was awarded follow-on contract 75A50121P00058 for $3,977,119 on August 10, 2021 by the Department of Health and Human Services Office of the Assistant Secretary for Preparedness and Response to perform the study in compliance with applicable regulations and quality requirements. 3. Description of Services or Supplies:

Basis for Approval (FAR 6.303-1(d)): Individual Basis Class Basis

The total estimated value of the proposed action, including all options is $ $3,977,119

The objective of this study is to explore immune correlates of protection in rhesus macaques across different vaccines with diferent doses being evaluated within each vaccine. Vaccine candidates will be provided by Moderna, Novavax, Janssen and Sanofi Pasteur.

The study will be conducted under an approved quality management plan. The study will be conducted in compliance with 21CFR Part 58 (Good Laboratory Practice for Nonclinical Laboratory Studies), Office of Laboratory Animal Welfare (OLAW) regulations and BARDA Project Quality Requirements. Exceptions to GLP compliance will be described in the study protocol.

4. Authority and Rationale: Identify the statutory authority, FAR title and FAR citation permitting other than full and open competition. It may be one of the following most commonly used citations by the operating divisions of the Department of Health and Human Services (HHS), but other exceptions may apply per FAR Subpart 6.3.

Actions other than simplified acquisition procedures (select only one and provide an explanation):

FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements, 41 U.S.C.

3304(a)(1)

Only Battelle is capable to perform this task as it is a continuation of previous work issued under contract 75A50121P00027. Battelle is the only organization that has the current capabilities and capacity to ensure timely execution of the studies without a gap period. In addition, any attempt of another organization seeking to perform this study would cause substantial duplication of cost and time to establish the study, which would present to the Government and unacceptable delays in fulfilling the agency’s requirements. Significant time and money have been invested in developing, optimizing, qualifying and validating the assay that are to be used for the analysis of the samples from the NHPs in the correlates of protection study. Developing these assays and getting to a validated stated at another facility would take at least a year and several million dollars, which is not in the best interest of the Government, especially during a pandemic. Data from this study will further inform the ongoing human clinical studies. The correlates of protection is a variable measure post vaccination that can be used to predict protection from SARS-CoV-2 infection.

FAR 6.302-2: Unusual and compelling urgency, 41 U.S.C. 3304(a)(2)

FAR 6.302-5: Authorized or Required by Statute, 41 U.S.C. 3304(a)(5)

Other (See FAR Subpart 6.3 for additional authority)

Provide a full explanation to justify use of the exception.
