FEDERAL BUREAU OF INVESTIGATION

JUSTIFICATION FOR LIMITED COMPETITION/SIMPLIFIED ACQUISITION

JUSTIFICATION AND APPROVAL FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

In accordance with Federal Acquisition Regulation 13.106-1(b)(1), I hereby determine that the Juki Sewing Machines listed on DJF-21-1800-0004773 are available from only one source, and competition is precluded as there are no substitutes available.

1. This acquisition is restricted to the following sole source:

Company: Central Penn Company Address: 351 East 7th Street, Bloomsburg, PA 17815 Company Point of Contact and Phone Number: Click here to enter text.

2. The Central Penn Juki Sewing Machines are estimated to cost _____________ and are required to be delivered by 9/30/2021.

The Juki Sewing Machines will be used for the creation of products for Agents to use for cases in the field as well as Training Classes.

3. The machines will be used to teach Agents how to create products for cases in the FBI. The Juki brand is the brand that federal agencies use to create these products used in cases. The Juki Sewing Machines must be delivered by 9/30/2021. This office became aware of the requirement on 7/22/2021. If the required delivery date is not met, Agents completing training courses will not be able to be trained on creating products for their Field Office.

4. Check and fill in all that are applicable for an Open Market Buy:

|X| Other information to support a brand name only buy:

The machines are part of the concealment process that Agents use to create usable products for the field to incorporate these products in investigations. Additionally, the sewing machines will be used for several classes in the Agent Training curriculum. These Juki Sewing Machines are also used by DOD, CIA, DEA, and OGA to create the correct legal products to be used in Federal cases. Central Penn is the only vendor who sets up these machines to industry standard. They also calibrate the needles to the exact specification for products to be created. Other vendors do not setup the machines and if they do it will be an additional cost.

5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).

The contracting officer will determine, after considering the level of effort and the mix of skills available for the tasks needed, that the proposed order or BPA represents a reasonable total price and will be the best value for the FBI.

6. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that barriers to competition are avoided to ensure we obtain the best value for the government.
