Justification and Approvals for Other Than Full and Open Competition
Elevator Extended Warranty Maintenance Services
Elevators Number Six through Elevator Number Thirteen
Robert A. Young Building (RAY)
1222 Spruce St. Louis MO
1. Contracting Agency
General Services Administration (GSA), Public Buildings Service, Services Acquisition Branch (6P1QC), 2300 Main, Kansas City, Missouri, is the agency responsible for this action.
The requesting office is General Services Administration (GSA), Public Buildings Service, Building
Services Branch (6P2CMB) on behalf of the St. Louis West Field Office.
2. Nature and/or Description of Action Being Approved This justification and approval is for the award of a sole source, fixed-price contract for extended warranty elevator maintenance services at Robert A. Young Federal Building, 1222 Spruce, St. Louis MO. This contract is a separate follow-on contract for elevator maintenance services which were initially included in an elevator modernization construction project.
3. Description of the supplies or services required The GSA has determined a continued need for the provision of extended warranty elevator maintenance service at the Robert A. Young Building, 1222 Spruce, St. Louis MO.
The Contractor must provide all management, supervision, manpower, equipment, and supplies necessary to provide extended warranty elevator maintenance service. This shall include providing qualified elevator mechanics and qualified crews in sufficient quantity to service and maintain the eight elevators (Numbers
6-13). The work provided must maintain the elevators in an unimpaired condition.
For this procurement, the Government anticipates awarding a sole source, fixed price contract to Midwest
Elevator Company, 1824 Knox Avenue, St. Louis MO. The performance period of the new contract will be
February 25, 2019 through December 25, 2019. The estimated value of the contract is $78,600.
4. Identification of statutory authority The authority to award this contract is in accordance with former 41 U.S.C. 253(c)(1), now codified as 41
USC 3304 (a)(1) as implemented by Federal Acquisition Regulation (FAR), Part 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition of extended warranty of elevator maintenance services directly correlates to the application discussed in FAR
6.302-1(a)(2)(ii) (A )
5. Demonstration the acquisition requires use of the authority cited FAR 6.302-1 provides for less than full and open competition when the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements. It elaborates further that this authority may be applicable when unique supplies or services are available from only one or a limited number of sources with unique capabilities and to be available only from the original source in the case of a follow-on contract for the continued development or production of highly specialized equipment, including major components thereof, which would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition.
The services are currently being provided by Midwest Elevator Company, 1824 Knox Ave., St. Louis MO.
The current procurement is associated with a construction contract and will expire on February 25, 2019.
During the construction contract, Midwest Elevator Company developed a temporary cross-controller that allows for the two separate elevator systems to operate together.
Midwest Elevator is the only known source for providing the extended warranty elevator maintenance services on elevators six through thirteen at the Robert A. Young Federal Building 1222 Spruce, St. Louis
MO due to this cross-controller. This knowledge is related to the installation of a wiring/controller to operate the old 1982 Westinghouse control system with the newly installed 2018 Motion Control system.
Without this control system the elevators systems will not operate together and would require extensive duplication of costs for another elevator maintenance contractor to research and develop a similar control system to allow all eight elevators to operate as a unit.
6. Efforts to Obtain Competition
For this short-term requirement, competition will be unable to be obtained due to the fact that there are no other elevator maintenance contractors with the ability to service the cross-controller developed and provided for these elevators without substantial duplication of costs already incurred. Once modernization of the remaining four elevators is complete there will be no need for the cross-controller as the newer computer based systems will operate together through software interface. And, competition for the provision of the required maintenance services can be sought through other means.
7. Fair and Reasonable Costs
The extended warranty elevator maintenance service was originally part of a construction contract for modernizing four of the eight elevators at the Robert A. Young Federal Building. The original pricing was considered fair and reasonable by the source selection committee and Construction Contracting Officer.
The pricing was accepted as part of the contract. The pricing provided under the construction contract for the provision of maintenance services will be utilized to compare the pricing provided by Midwest for these short term services to determine price reasonableness. An IGE will also be completed to assist in price reasonableness determination.
8. Market Research
Due to the unique nature of the cross-connect controller that enables the two distinct systems to operate as a whole unit, there are no other known elevator maintenance contractors to provide this service.
9. Other Facts During the performance of the required third party five-year testing in February of 2019, these elevators failed the inspection due to a failure of the elevators to return to the designated fire service landing during the phase one fire service inspection. This mishap caused four of the eight elevators to fail the testing and be removed from service. Without these elevators it would be a safety issue if a building evacuation was required during a period of occupancy of the building. Therefore, it is imperative that maintenance services are provided for these elevators without delay or pause.
