Justification for Other than Full and Open Competition
USPFO P&C for ARIZONA
Date: 15 September 2020 Nomenclature: Expeditionary Kit Estimated Delivery or Period of Performance: 30 days ARO
1. Agency and Contracting Activity:
United States Property & Fiscal Office (USPFO) 5636 E McDowell Road Phoenix, AZ 85008-3495
2. Nature of Action Being Approved:
This document is to provide the supporting details surrounding the subject acquisition, awarded under Only one responsible source and no other supplies or services will satisfy agency requirements IAW FAR 6.302-1.
3. Description of Requirement:
Expeditionary kit for helicopter repair and maintenance.
4. Statutory Authority permitting other than full and open competition:
Only one responsible source and no other supplies or services will satisfy agency requirements IAW FAR 6.302-1, 10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1).
5. Contractor’s unique qualifications:
EAA has patents and proprietary processes for manufacturing these tools. Though each kit contains some items commercially available commercial off the shelf, approximately 80% of all items within each kit are only available through EAA Tools.
6. Description of Solicitation Efforts and Exemptions
This contract action is made under the conditions described in FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
Furthermore, this acquisition is posted IAW 5.202(a)(2).
7. Market Research and Price Reasonableness:
A query was conducted of the Federal Procurement Data System (FPDS-NG), System of Award Management (SAM), as well as Small Business Dynamic Search for potential sources. A random sampling revealed that pricing is within 2% of vendors published pricing same or similar items that would be sold separately, and would not satisfy this requirement in its entirety.
The Independent Government Estimate (IGE) referenced two vendors with estimated pricing based on previous acquisition history for the same or similar supply.
8. Determination and Findings:
EAA Tools has adequate financial resources to perform the contract, or the ability to obtain them (see FAR 9.104-3(a)). The vendor has adequate financial resources to perform the contract with minimal risk to the government, and is financially capable to provide the supply. Furthermore, the contractor has successfully completed similar requirements with other Government and commercial entities on previous acquisitions.
9. Price Reasonableness Determination:
Price has been determined fair and reasonable per FAR 15.404-1(b)(2)(v), the price is fair and reasonable in comparison to the Government estimate. The independent government estimate (IGE) submitted by the requiring activity for this procurement based on market research, informal requests for quotation, previous acquisitions of a similar type, and parametric price comparison to similar items sold separately within the industry.
This award is being made pursuant to FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
10. Statement of Actions to Overcome Competition Barriers:
Continued market research efforts for Small Businesses capable of providing similar supplies in future acquisitions.
11. Contracting Officer’s Signature:
Based on the above, EAA Tools, has been determined to be a responsible contractor, in accordance with FAR Subpart 9.1.
