About this file

This is a Sole Source Justification for Acquisitions Between $25K - $250K submitted by the Indian Health Service (IHS), Great Plains Area Office of Health Programs. The contracting activity seeks to award a firm-fixed-price contract to James Valley Imaging, LTD (PO Box 975, 525 N. Foster, STE 2403 Mitchell, SD 57301) for radiological imaging interpretation services at the Standing Rock Service Unit. The estimated contract value is $25,300.00 with a performance period from September 1, 2026 to September 30, 2026.

The acquisition supports the Standing Rock Service Unit's provision of 24/7 continuous coverage for plain film, CT interpretation, and consulting services delivered via tele-radiology. The justification cites FAR 6.302-1(a)(2)(ii)(A) for follow-on contracts where duplication of cost to the government is not expected to be recovered through competition and FAR 13.106-1(b)(1)(i) for single-source solicitation under the simplified acquisition threshold. James Valley Imaging is identified as the sole qualified vendor with over 15 years of existing contract history with the Standing Rock Sioux Tribe and established IT infrastructure compatibility. The document notes that switching to an alternative vendor for the two-month period would require costly duplication of IT infrastructure, changes to hospital policies and procedures, staff retraining, and would create unacceptable medical error risks. No other sources expressed interest in writing. The contracting officer determined the cost to be fair and reasonable based on market research using comparable IHS and local area contracts of similar scope and services.

Sole Source Justification for Acquisitions Between $25K - $250K

“Source Selection Information – see FAR 2.101 and 3.104”

2. Nature and/or description of the action being approved.

a. Acquisition purpose and objectives. The Indian Health Service, part of the Department of Health and Human Services is charged with providing all-encompassing care to eligible beneficiaries. This contract supports and augments the Standing Rock Service Unit’s ability to provide the needed Radiology interpretation services which directly relates to the IHS mission and vision. FAR 6.302-1(a)(2)(ii)(A): allows for follow on contracts that would duplication of cost to the government not expected to be recovered through competition.

3. Project background. Gas The Indian Health Service Standing Rock Service Unit has provided care to the members of the Standing Rock Tribe and surrounding Native American population in accordance with numerous treaties including the Sydner Act of 1921. The tribe and IHS have worked closely to meet the common goal of elevating the medical care of the tribal population. In the past this has involved the tribal government creating and supporting contracts directly related to Indian Health Service functions. This contract is a continuation of that history. Historically, the Standing Rock Sioux Tribe has contracting for Radiological Interpretation services through their own contracting. In 2023 the Standing Rock Service Unit was able to acquire a CT machine to provide higher levels of care at the Service Unit level. This acquisition has lead to a deficit in contract funds allotted for Radiology Interpretation Services paid for by the tribal contract. In 2024 and 2025 , SRSU awarded contracts 75H70624P00707 and 75H70265P900253 respectively to James Valley Imaging with the Period of Performance of August 1st, 2024- September 31st, 2024 for $28,129.82 and August 1st, 2025 -September 2025 for $37,529.82 as a continuation of the tribal

7. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies. Communication with the tribe has occurred on their allotted budget for services including re-allocating funds to a different source allowing for the federal service unit site to competitivity bid the entire project. As the Tribal government is considered a sovereign nation, but serves the same constituents as the Standing Rock Service Unit collaborating efforts . FAR 5.202(a)(3) does not require to submit notice when dealing with contract expenses between governments with between the United States and the government with specified sources.

Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable. The determination of fair and reasonable will be determined by other existing federal contracts in the Great Plains Area and IHS along with the provided market research.

Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.

Market research was performed using previous local and IHS area contracts of similar scope and services.

Any other facts supporting the use of other than full and open competition.

The Standing Rock Sioux Tribal has contracted with James Valley Imaging for >15 years for Teleradiology services. The service unit’s current IT infrastructure is setup to work with James Valley Imaging. Bidding a separate federal contract for two months to a possible different vendor would likely require costly duplication of IT infrastructure and likely lead to unacceptable medical errors using a short term provider for only month. Changing and creating new hospital policies and procedures for a temporary vendor would increase costs to the government and would negate any potential savings through a competitive bid process. It is anticipated that costs for man power alone in changing policies and gaining required approval from the medical executive committee, IT personnel, and radiology department would be over 25% of the total contract value. When factoring in changes to IT infrastructure and retraining of staff this costs continue to rise. When instituting temporary measures, it is also anticipated that human error will occur with the sending and receiving of files from a vendor providing services for only two months. The potential delay caused in a high risk medical procedure would negate the entire cost of the contract.
