Justification and Approval for Other Than Full and Open Competition

1. Contracting Activity: USPFO-AL

2. Description of Action: Action requested is to award a contract/modification on a sole source basis to Seay, Seay & Litchfield, PC (SS&L) for architectural design services of the F-35 Deployable Parts Storage (DPS) facility (FAKZ182356) located at the 187th Fighter Wing (FW), Montgomery, Alabama.

3. Description of Supplies/Services:

In September 2018 USPFO-AL and the 187th FW awarded a task order for Type A design services to SS&L to design a new supply complex (FAKZ999088) to be constructed at the 187th FW. In September 2019 a sole source modification was award to continue design services, Type B, to the 100% designed stage. The initial intent of this project was to design the facility to meet current and future mission needs. During the performance of Type B design services it was determined that to meet future mission requirements, to store the deployable parts package for the F-35 aircraft arrival scheduled for FY2023, that changes needed to be made to the supply complex. The change is a 6,000 square foot addition to the west end of the supply complex building which will include fire protection, utilities, and site improvements.

The supply complex is currently programmed for Fiscal Year (FY) 2021 and the Deployable Spare Parts for FY2022 but it is the intent/desire of the 187th FW for these projects to be built concurrently.

Anticipated award amount:

If awarded to SS&L

If awarded to other than SS&L

4. Authority Cited:

6.302-1(a)(2)(ii) Only one responsible source and no other supplies or services will satisfy agency requirements.

(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in-

(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or

(B) Unacceptable delays in fulfilling the agency’s requirements.

5. Reason for Authority Cited:

In January 2014, the USPFO-AL issued an indefinite delivery contract to SS&L to perform A-E Services for the Alabama Army and Air National Guard. Since then they have performed all A-E services for the 187th FW, to include creating the Installation Development Plan. SS&L was awarded a task order to perform Type A design services for the construction of a new base supply complex. SS&L completed initial Type A services to the 35% stage. In September 2019 a sole source modification was approved and awarded to SS&L to perform the Type B design services to 100% completion.

In October 2019 NGB A4O contacted the 187FW to see if we would be able to execute an award for design services for the DPS, no later than February 2020. Currently USPFO-AL does not have local A-E IDIQ in place. The initial decision was we would not be able to award the contract within the time constraints. After discussion with the Base Civil Engineer (BCE) it was determined that this should be considered for a modification to the existing task order or a sole source award to the incumbent architects under FAR 6.302-1(a)(2)(ii).

This requirement meets the intent of FAR 6.302-1(a)(2)(ii) in that it is a follow-on contract for the continued development of a highly complex and detailed project. The project calls for additional warehouse/storage space to be added to the planned supply complex, to include tying into planned electrical, plumbing, security and fire protection equipment. Additionally, there is a high probability of increased cost and time delays if this project is not awarded as a sole source.

If a firm other than SS&L was selected additional time would have to be added for re-work/revision to the previously performed Type A services. To date $796,800.00 have been obligated to this design action. Based on awarding as a sole source the Government can expect an immediate savings of and a potential savings, at time of construction, of approximately see table below, for a total potential cost saving of What is more difficult to estimate are the savings in dollars and time that can be gained during construction by having both projects to the 100% designed stage and bid out as a single construction project.

Direct Costs Cost Estimate

Removal of 3,570SF of Metal Wall Panel Installation of 1,404 SF of new exterior composite metal wall panel Installation of 2,166 SF of new interior metal wall panel Removal of 441 SF of brick veneer Mobilizing/Additional Job Trailer Additional Supervision $25/hr. x 2020 hrs.

To pursue this action competitively, under FAR Part 36.6, would add 6 – 12 months for the award of the design services of the DPS. The USPFO-AL is currently working to put a local A- E IDIQ in place, with an anticipated start date of November 2020. To award other than a sole source to SS&L would jeopardize the completion of the design effort in time to include the DPS project into the construction of the supply complex.

6. Efforts to Obtain Competition:

At this time effort to obtain competition has not been performed.

7. Actions to Increase Competition:

No actions have been taken at this time to increase competition. However USPFO-AL has initiated the acquisition process for a new local A&E IDIQ. This acquisition will be competitive, utilizing FAR Part 36.6 procedure. Anticipated award date November 2020.

8. Market Research:

Specific market research for these items have not been performed.
