JUSTIFICA TION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

Under Simplified Procedures for Certain Commercial Items (FAR 13.5)

1. Contracting Activity.

NAVSEA Puget Sound Naval Shipyard & Intermediate Maintenance Facility (PSNS & IMF).

2. Description of Action Being Approved.

Award of a firm fixed price (FFP) service type purchase order on a sole source basis for on-site technical representative repair services and replacement parts in support of a US Submarine on

(1) Groom Low Pressure Air Compressor (LPAC), (1) Groom Low Pressure Air Dehydrator (LPAD), and (1) High Pressure Air Dehydrator (HPAD) #2 from

. CASREP Number for this is 18018.

3. Description of Supplies/Services.

This requirement is for to perform on-site technical repair service, provide replacement parts, inspection and testing for (1) LPAC, (1) LPAD, and (1) HPAD.

is to perform the OEM technical repair services; provide all parts and supplies; deliver and install all replacement parts; complete inspection and operational testing of the Ship’s equipment in accordance with the Original Equipment Manufacturer (OEM) drawings and OEM repair standards. Repairs must be accomplished OCONUS at .

Period of performance is from (estimate) 9 April 2018 through 30 May 2018. The total estimated cost is $112,000.00. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. Funding will be FY18.

4. Statutory Authority Permitting Sole Source.

10 U.S.C. 2304(c)(1) and 41 U.S.C 1901 – A sole source acquisition under the authority of the simplified acquisition procedures for certain commercial items, as implemented by FAR 13.501(a) and in accordance with FAR 6.303-2(b)(5).

5. Rationale Justifying Use of Cited Statutory Authority.

(1) All components/parts of LPACs/LPAD/HPADs are proprietary to OEM vendor ) and cannot be purchased from other vendors. Other vendors do not have access to OEM proprietary information.

(2) is the authorized OEM, and the only manufacturer in the United States with access to the OEM drawings and proprietary information. Proprietary information includes patents held by affecting the fit-up, installation, and compatibility

(3) is the NAVSEA mandated provider of the submarine’s LPACs, and LPADs per T/M S6220-AN-MMA-010 Chg H (LPAC), T/M S9551-BX-MMA-010 Chg G (LPAD), and HPAD.

(4) Existing units are compressors (LPAC/LPAD/HPAD). These units are complex, highly engineered units mandated by NAVSEA for carrier applications. All parts must be OEM provided to ensure proper operation of the units.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

This requirement is exempt from being synopsized and solicited under Only One Responsible Source per 10 U.S.C. 2304(c)(1), under Unusual and Compelling Urgency per 10 U.S.C 2304(c)(2), and FAR 52.202(a)(13)(i) amount not expected to exceed the simplified acquisition threshold. No additional market research was conducted; as is the only company authorized to provide this service.

7. Determination of Fair and Reasonable Cost.

The contracting officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, PSNY & IMF has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, PSNY & IMF will assess whether competition for future requirements is feasible.
