Department of Army FAR Part 6 Justification and Approval for Other than

Full and Open Competition

1. Contracting Activity: US PROPERTY AND FISCAL OFFICE FOR

PENNSYLVANIA DEPARTMENT OF MILITARY AND VETERANS AFFAIRS

ANNVILLE, PENNSYLVANIA

2. Description of Action: The 171st ARW of the PA Air National Guard requests a Firm-Fixed Price Contract for additional design services pertaining to an existing design for to Repair Base Stormwater Infrastructure. The Government projects award using SRM funds.

3. Description of Supplies/Services: The Government requires contractor support to provide additional design work to an existing design for the repair of base stormwater infrastructure. The existing design dates to FY13, and following a Code & Compliance Review in late FY19, it was determined that minor additional design work is required.

The Government intends to award a Firm-Fixed Price Purchase Order to the A-E firm responsible for the original design. The period of performance shall be from contract award to six (6) months, hereafter referred to as the Period of Performance (PoP).

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited:

The 171st ARW of the Pennsylvania Air National Guard (PAANG) has a requirement for additional design work to an existing design to repair the Base Stormwater Infrastructure.

a. The PAANG utilized DRS, Inc, the A-E responsible for the original FY13 design, to conduct a Code & Criteria (C&C) review on the original FY13 design, utilizing the Government Purchase Card (GPC) in late FY19. Its rationale for utilizing the original firm for the C&C review was that the team responsible for the FY13 design was still mostly intact at DRS, Inc. Their familiarity with the previous design work meant that they were best positioned to conduct a C&C review, as well as additional design. Hiring a different firm to provide the additional design will inevitably result in a significant increase of both time and money on the part of the Government.

b. The quoted price of the additional design work is $18,811.98, or roughly 23% of the original Task Order price of $79,407.91 (including a NTE CLIN of $10,000.00).

Hiring a different firm to provide the additional design will result in a significantly higher cost, since a different firm would need to essentially re-design the entire project, and then only after conducting their own reviews and taking additional time to familiarize themselves with the existing design, not to mention the undertaking of their own separate liability precautions, all of which would inevitably passed down to the Government.

6. Efforts to Obtain Competition: This is a one-time action and necessary only to bring an existing drawing into compliance with current code. No future related actions are contemplated, and any new A-E requirements will be competed in accordance with all applicable rules and regulations.

7. Actions to Increase Competition: A new competitive action is currently in the pre-solicitation stage.

8. Market Research: Market Research in the form of an Independent Government Estimate (IGE) was conducted.

9. Interested Sources: No Market Research was conducted in terms of other interested sources.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable. This determination will be made using price analysis techniques as prescribed in FAR 15.402(a)(2)(ii). Specifically, an Independent Government Estimate (IGE) was utilized to determine fairness and reasonableness.

As a part of this basis, certified cost or pricing data will not be required and the following exception applies: FAR 15.403-1(a), “Certified cost or pricing data shall not be obtained for acquisitions at or below the simplified acquisition threshold.”
