JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Cargo and Billing (CAB) Support Services
HTC711-08-F-0042
1. CONTRACTING ACTIVITY.
United States Transportation Command, Directorate of Acquisition, DPO Support Division (USTRANSCOM!fCAQ-D), 508 Scott Drive, Building 1900W, Scott AFB JL 62225-5327.
2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.
USTRANSCOM requires continued contract support for Task Order HTC711-08-F-0042, Cargo and Billing (CAB) Support Services. A modification to the current task order is needed in order to add an additional period of performance (POP) of I February 2012-31 March 2012. This constitutes a firm fixed price action using monthly unit prices to continue services currently provided under the task order. The subject task order was previously awarded sole source to Computer Sciences Corporation against GSA ANSWER GW AC (GS09K99BHD0003) in accordance with the ANSWER GW AC ordering procedures.
In accordance with FAR clause 52.217-8, Option to Extend Services, a modification to the CAB task order is anticipated. The extension of services option period was not evaluated at time of the initial task order award as required by FAR 17 .207(t); therefore, a Justification for An Exception to Fair Opportunity is being executed (see GAO Decision B-401471, Matter of Major Contracting Services, Inc.).
3. DESCRIPTION OF SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS.
SDDC has a continued need to provide contract support for the legacy CAB system. CAB Support Services is a non-core financial business system performing functions that address Defense Transportation System (DTS) cargo movement via ocean carrier, and cargo handling by Department of Defense (DOD) stevedore and privately owned vehicle (POV) contractors, who have remote access to CAB. CAB enables SDDC to accurately bill DTS customers and pay commercial transportation providers for services rendered in the movement of DOD surface (ocean) cargo.
The CAB task order was awarded in accordance with FAR 8.405-6(b)(l), only one source capable of responding due to the unique or specialized nature of the work. CAB was awarded 1 August 2008 and included a base period I August 2008 through 30 September 2008 and three option years ending 30 September 2011. A modification for a four month extension of services was executed in order to continue services until 31 January 2012. In accordance with FAR 52.217-8, which allows for extension of services up to six months, the task order has two months left available with services ultimately ending 31 March 2012.
The current value of this task order is $5,548,052.52. The maximum extension remaining available using FAR 52.217-8 is two months. The total estimated value of the two-month extension is based on the Independent Government Cost Estimate. The period of performance for the extension is from 1 February 2012 through 31 March 2012.
4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY AND THE SUPPORTING
RATIONALE, INCLUDING A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S
UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE
EXCEPTION CITED.
FAR 16.505 (b )(2)(iXC)- The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to the orders already issued under the contract. ·
The Government has a need for continued CAB support services while the requirement is being re-competed . A lack of support for this financial business system beyond the current performance period (ending 31 January 2012) would be detrimental to fiscal year end closeout activities and other financial activities performed under this task order.
The two-month extension will be exercised in accordance with FAR Clause 52.217-8, Option to Extend Services.
This action is a continuation of the current requirement; the services required are within the scope of the task order and are in accordance with the current performance work statement (PWS). As such, they represent a logical follow-on to the current task order.
5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO
THE GOVERNMENT WILL BE FAIR AND REASONABLE.
The extension of services for the CAB task order will be based on the current monthly unit prices already on the task order. Existing rates used in the current period of performance have already been determined fair and reasonable monthly unit prices during competition of the ANSWER award.
6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION
The Government identified CAB Support Services to be fully re-competed effective upon the completion of the current task order. SDDC is actively working with USTRANSCOM to award the new CAB task order and requires continued contract support, as the current task order will expire 31 January 2012 and the new task order has an estimated start date of I April 2012.
7. A STATEMENT OF THE ACTIONS, IF ANY, mE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY
BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SERVICES IS MADE.
