DEPARTMENT OF VETERANS AFFAIRS
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROaDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.S
Acquisition Plan Action ID: 36C246-21-AP-1116
1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration, Network Contracting Office (NCO) 6. Purchase request 2237 590-17-4-447-1887.
2. Nature and/or Description of the Action Being Processed: This procurement is for purchase and installation of physical security equipment, personal identity verification (PIV) electronic card access door readers, and an intrusion alarm system to support the Hampton VA Medical Center (VAMC). in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR
13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. Network Contracting Office 6 intends to award a new, sole source, firm-fixed-price contract to ACME Technical Group.
3. Description of Supplies/Services Required to Meet the Agency's Needs: The requirement is to provide all material, equipment, hardware, labor, installation and software required to replace the current physical security system, physical access control PIV card readers and instruction alarms at the Hampton VA Medical Center. The Government estimate is $1,430,000 with a performance period of February 1, 2021 through September 30, 2021.
4. Statutory Authority Permitting Restricted Competition: FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 Is 41 U.S.C. § 1901 and Is implemented by FAR 13.106-l(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:
(X) Unusual and Compelllng Urgency
s. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (appllcablllty of authority): ACME Technical Group possesses unique familiarity with the Hampton VAMC campus and communications and as they were the subcontractor on the infrastructure project contract. The contract for the design and replacement of the Hampton VAMC security infrastructure system was awarded in September 2017 and terminated in December 2020 due to the contractor's failure to perform and provide equipment in accordance with the contract terms and conditions the contract was terminated in December 2020. The current physical security system, PIV card readers and intrusion system reached its end of life in December 2020 and service, spare parts, software upgrades and patches, and technical support are no longer available creating security vulnerabilities. ACME Technical Group has the ability to provide the equipment and installation of the critical components of the infrastructure project that include the replacement of the PIV card door readers, intrusion alarms and providing a fully integrated monitoring and command and control security platform In accordance with security infrastructure design. The system controls all doors, entryways, alarms and security features for the entire campus.
These operations of this system are critical in case of an emergency and a non-functioning system

ACME Technical Group has intimate knowledge of the needed system and the campus's security infrastructure. They possess the background, technical expertise and staff to expeditiously perform the required work to avoid potential security risks that may put the Hampton VAMC staff, visitors and Veterans at risk.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Limited market research was completed due to the immediate need for the service only a brief survey of two companies that were known to provide these services was conducted.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will determine that the anticipated price will be fair and reasonable based on comparison of proposed prices with prices found reasonable on previous purchases. Prior to award of the proposed contract price analysis will be performed and documented to sufficiently determine that the cost to the Government is fair and reasonable.
8. Description of the Market Research Conducted and the Results. or a Statement of the Reasons Market Research Was Not Conducted: Due to the criticality and time sensitivity of this requirement two companies were contacted that provide these services however both companies stated it would take at least two months before they could even provide a quote. Due to the immediate critical need for the services no further market research was conducted.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.
10. Listing of Sources that Expressed, In Writing. an Interest In the Acquisition: N/A.
11. A Statement of the Actions. If any. the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Government will continue to conduct thorough market research to gauge the marketplace capabilities for future requirements. The Government will seek competition of future acquisitions for these services if available.
