About this file

This Justification and Approval document outlines an emergency procurement by the General Services Administration Public Buildings Service Region 5 to repair and replace an air cooled condensing unit at a federal building in East St. Louis, Illinois. The agency requires repair of one circuit of the unit to operate during construction of a replacement. Services include installing multiple compressors, refrigerant, repairing refrigerant lines, and new pressure switches. The estimated value is $86,712.04. Due to the urgency of preventing additional damage to the structure from lack of cooling, the agency could not conduct market research or full and open competition under the authority of FAR 6.302-2.

GSA GREAT LAKES REGION

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

FOR

EMERGENCY REPAIR AND REPLACEMENT OF

AIR COOLED CONDENSING UNIT #8

AT

MELVIN PRICE FEDERAL BUILDING

750 MISSOURI AVENUE, EAST ST. LOUIS, IL 62201-2955

1. Identification of the agency and contracting activity.

This Justification and Approval (J&A) for Other Than Full and Open Competition is exe-cuted by the General Service Administration (GSA) Public Building Services (PBS) Great Lakes Region 5 Acquisition Management Division.

2. Nature and/or description of the action being approved.

The services required are for emergency repairs and replacement of the Air Cooled Con-densing Unit #8.

3. Description of the supplies or services required to meet the agency’s needs (includ-ing the estimated value).

The purpose of the order is to provide labor and materials to repair one circuit of ACCU8 to run during the build time of a replacement at 750 Missouri Ave, East St.

Louis IL. Services required include installing multiple compressors, refrigerant, repair leaks in the refrigerant line, and install new pressure switches.

This work shall be in accordance with all Federal, State and local standards as well as the most current version of all applicable consensus standards including any supple-ments or revisions. In addition to compliance with these laws, the Contractor shall follow all applicable standard industry practices including, but not limited to the Occupational Safety and Health Act (OSHA) and NIBS. The contract shall also ensure that their em-ployees are properly trained, licensed and/or certified to operate necessary building sys-tems or equipment for which licensed and/or certified personnel are required by Fed-eral, State, or local laws; codes, or ordinances.

The estimated value for this acquisition is $86,712.04.

4. An identification of the statutory authority permitting other than full and open competition.

FAR 6.302-2 Unusual and Compelling Urgency

41 U.S.C. 253 (c)(2) permits limiting the number of sources from which proposals are submitted in circumstances where unusual and compelling urgency justifies such a limita-tion.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

The statutory authority cited is FAR 6.302-2(b)(1) which states an unusual and compel-ling urgency precludes full and open competition; and FAR 6.302-2(b)(2) which states that a delay in award of a contract would result in serious injury, financial or other, to the Government.

Without cooling in the building, the building becomes extremely hot and the building would become unsanitary and unsafe for the employees and public who require access to the building.

6. A description of efforts made to ensure that offers are solicited from as many poten-tial sources as is practicable, including whether a notice was or will be publicized as re-quired by FAR 5.2 and, if not, which exception under FAR 5.202 applies.

Due to the urgency of this situation this situation does not permit the solicitation of addi-tional offers.

In accordance with FAR 6.305(a), the OFOC will be posted within 14 days after the exe-cution of the modification.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

GSA has prepared an Independent Government Cost Estimate (GCE) to assist in the es-tablishment of a fair and reasonable price.

8. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted.

Due to the urgency of this situation and to prevent additional damage to the structure of the building, no market research was conducted due to the unusual and compelling cir-cumstances.

9. Any other facts supporting the use of other than full and open competition.

There are no additional facts to be reported in this section.

10. A listing of any sources that expressed a written interest in the acquisition.

No sources indicated an interest in this acquisition for this shortened performance period.

11. CERTIFICATION

I hereby certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
