DMEA Exception to Fatr Opporhmity

Justification for Exception to Fair Opportunity For

Advanced Technology Support Program llt (ATSP3) Indefinite Delivery / Indefinite Quantity (lD/lQ) Task Order Contract

l. Agency and Gontracting Activity: Office of Secretary of Defense, Defense Microelectronics Activity (DMEA)/ MEEB Contracting Office Justification for an Exception to Fair Opportunity in accordance with 16 s05(bx2).

ll. Nature and/or Description of the Action Being Approved:

This is a contract modification under the basic lDlQ contract, H94003-04-D-0001, delivery order 0065 (Lockheed- Martin) thai will add scope requirements to the current effort on this Delivery Order; which was posted for fair opportunity prior to award. The additional efforts are required to increase the Counterfire radar capabilitv of the TPQ-53 Radar System.

lll. Description of the Supplies/Services required to meet the Agency's Needs (including the total estimated value, including options, if any):

The initial DMEA-sponsored TPQ-53 Radar System Product lmprovements task under CET 14-451was posted for fair opportunity on 29 December 2014 and only one offer was received from Lockheed Martin. The order was awarded 5 Mar 20'15 at a value of $7,068,422 with a Period of Performance through 3'1 Mar 2017. lts purpose was to conduct trade studies to enhance TPQ-53 radar performance in high clutter environments and with low QE shots, increase radar range, improve radar accuracy Point of Origin (POO) and Point of lmpact (POl). The additional scope will improve the TPQ-S3 radar capabilities to increase Counterfire radar flexibilities. Additional improvements are expanded and required to enhance the performance bevond what was envisioned in the original task and are non-severable.

The estimated value of this effort is $4.124M. There are no options anticipated for this effort.

lV. ldentificatlon of the Exception to Fair Opportunity (Authority Cited):

FAR 16.505(bxlXi) requires the Contracting Officerto provide each awardee under a multiple award contract, a fair opportunity to be considered for each order exceeding $3,000 unless a statutory exception applies. The specific exception that precludes the fair opportunity process for this acquisition is FAR 16.505(bX2XiXC). The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

The purpose of delivery order 0065 is to enhance the TPQ-53 radar systems capabilities in high clutter environments to track and locate hostile rocket, artillery, and mortar fires. The added scope requirements will allow the performance improvements to radar accuracy to increase Counterfire Target Acquisition (CTA) in hrgn clutter environments. tt will further improve the capabilities to increase the probability of location, probability of correct classification and false location rate.

V. FAIR AND REASONABLE COST DETERMINATION:

"l hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable." Actions to insure reasonableness of the price will be accomplished using procedures and criteria contained in FAR 15.4. Cost and pricing data will be requested. Detailed documentation and justification of price reasonableness will be set forth in the Price Negotiation Memorandum.

vt. Additional Facts Supporting this Justification:

lmpact lf This Exception to Fair Opportunity is not Approved - lf the Exception to Fair Opportunity for the added scope is not approved, due to the limited availability of test ranges, the TPQ-53 radar system will not be able to meet current test schedules that have been reserved. . Without this additional compre-hensive testing, the system modeling and simulation validation and verification cannot be accomplished to field the system.

The ANiTPQ-S3 Counterfire target acquisition radar is a new generation of Counterfire sensor with the flexibility to adapt to uncooperative adversaries and changing missions. The ANiTPQ-53 mitigates close combat radar coverage gaps and will ultimately replace the current AN/TPQ-36 and AN/TPQ-37 Fire Finder Radars, thus supporting Brigade Combat Teams (BCT) and Fires Brigades operations. The AN/TPQ-s3 will complement the Fire Finder Radar system and interoperate with the current and future Batfle Command Systems lnbS; toprovide the maneuver commander increased counterfire radar flexibility.

The AN/TPQ-S3 is a mobile fire findingi fire support radar system. The AN/TPQ-S3 system is capable of locating hostile rocket, artillery, and mortar (RAM) fire in a clutter environment, and provides fiiendly artillery registration and adjustment. The AN/TPQ-53 radar system is the current US Army program of record for long-range surveillance and tracking radar against RAM threats. This task will enhance the ANiTPQ-53 radai system as seen from the AN/TPQ-53 user's community, anomalies generated from the live system testing and deployed system.

Several core capability improvemeni objectives are: increase radar range, improve radar accuracy pOO anc POl, add multi-mission capabilities, reduce cost, increase Counterfire Target Acquisition (CTA) in iliglr-Clutter Environments, and Low Quadrant Elevation relative to the Radar (Low QE). Lastly, independent government analysis of the work to be performed under this CET has determined that the use of vendors othei than the incumbent would prove to be both cost and schedule prohibitive, as the current analysis and development worK authorized from this will be performed simultaneously. Significant prerequisite knowiedge of the ANTTpe-s3 radar systems work performed under CET 14-451 is required for execution of this work. Thus, this analvsis considers the use of another vendor untenable, as cost and schedule goals cannot be realistically met.

Vll. Actions to Remove or Overcome Any Barriers that Led to this Exception to Fair Opportunity:

The original delivery order, H94003-04-D-0001-0065, CET 14-451 for TPQ-53 was posted for fair opportunity providing all eight ATSP3 contract holders an opportunity to propose.. The current contractor (Lockheed-Martin) was the only contractor to respond. lt is anticipated that subsequent phases of development effort will be posted for fair opportunity
