About this file
This document is a Justification and Approval (J&A) for Simplified Acquisition Procedures for the Bureau of Land Management's Utah State Office. The procurement is a sole source, firm-fixed-price contract with San Juan County for the purchase, installation, and 20-year maintenance of six cattle guards to be placed on county-controlled roads. The total estimated award amount is $59,820.00, with planned installation in the fall of 2025. A public Notice of Intent to sole source was posted on SAM.gov on February 11, 2025, for 10 days, and no alternative responses were received. The county was selected due to its unique position of already maintaining the existing roads, having necessary heavy equipment, and the ability to meet specific road department specifications for the cattle guard installation and long-term maintenance.

JUSTIFICATION AND APPROVAL
FOR ACQUISTIONS UNDER SIMPLIFIED ACQUISTION PROCEDURES
This document sets forth the justification and approval as required by 13.106-1(b)(1) & (2).
1. AGENCY AND CONTRACTING ACTIVITY:
Department of the Interior
Bureau of Land Management
Utah State Office
440 West 200 South, Suite 500
Salt Lake City, UT 84101
2. NATURE/DESCRIPTION OF ACTION(S):
This is a firm-fixed-price, sole source award for the purchase, installation, and maintenance of six cattle guards to be placed on San Juan County controlled roads. The intended contractor is San
Juan County (SJC), located at 117 S. Main St. Monticello, UT, 84535-7866, UEI #
WCVABP2FEVA2.
3. DESCRIPTION OF THE SUPPLIES/SERVICES:
The scope of work would include the purchase of necessary cattle guards and accessories (e.g., bases, grids, wings), installation of said cattle guards, and future maintenance of the cattle guards for their span life, which is typically around 20 years. The installation of the cattle guards would take place in the fall of 2025, as time and funding allow, and in conformance with any applicable timing limitations.
4. ESTIMATED DOLLAR VALUE:
The estimated award amount for this requirement is $59,820.00.
5. IDENTIFICATION OF STATUTORY AUTHORITY:
__X__41 U.S.C. 1901 – Simplified acquisition procedures (use when the simplified procedures for purchases of property and services for amounts (1) not greater than the simplified acquisition threshold
____41 U.S.C 1903 – Special emergency procurement authority (applies when in support of a contingency operation as defined in section 101(a) of title 10 or to facilitate the defense against or recovery from nuclear, biological, chemical, or radiological attack against the United States).

6. RATIONALE SUPPORTING USE OF THE AUTHORITY STATED IN PARAGRAPH 5:
SJC is in a unique situation to purchase, install, and provide continued maintenance of the cattle guards for their lifespan. This is due, in part, because the country already maintains the existing roads that the cattle guards would be placed on, and because the cattle guards must meet SJC
Road Department’s specifications as they would be placed on roads controlled by the county.
7. OTHER INFORMATION:
Costs will be fair and reasonable due to San Juan County’s familiarity with the specified project area, their existing maintenance of the backcountry roads that the cattle guards would be placed upon, having available heavy equipment necessary to perform such tasks, and their expertise in such activities. As a county agency, only actual costs are chargeable. These costs include personnel time, supplies, services, equipment, and administrative costs to conduct the work.
8. THE EFFORTS TO IDENTIFY ADDITIONAL SOURCES INCLUDING THE MARKET
RESEARCH CONDUCTED:
A public Notice of Intent to sole source was posted to SAM.gov on February 11, 2025, for 10 days to allow potential sources to be made aware of this requirement and provide an opportunity to respond with comparable capabilities and service offerings. No responses were received.
Buyer also conducted online research for the same materials which revealed slightly higher price than the proposed contractor’s pricing, all of which did not include installation, maintenance or repair.
9. FUTURE PLANS TO PERMIT COMPETITION:
Due to the unique position that San Juan County has to install these cattle guards in such remote locations, as well as the ability and willingness to conduct regular and costly maintenance into the future to keep the cattle guards in a functional condition, there are no future plans to allow for competition.
10. CERTIFICATIONS:
I certify that the facts and representations under my cognizance, which are included in this justification, and which form a basis for this justification, are complete and accurate.
