DEPARTMENT OF VETERANS AFFAIRS
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5
Acquisition Plan Action ID: 36C244-21-AP-0200_____________________
1. Contracting Activity: Department of Veterans Affairs, VISN 04, Wilkes-Barre VA Medical Center (VAMC), 1111 East End Blvd., Wilkes-Barre, PA 18711. Purchase Request 693-21-1-594-0005.
2. Nature and/or Description of the Action Being Processed: This procurement is for the installation and configuration of Avigilon IP cameras and Avigilon network video recording system in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. The purpose of this services is to replace the existing CCTV system with the Vigilon IP cameras and network recoding system. It is the Government’s intent to award a new firm-fixed price contract to the most qualified Contractor to ensure ongoing systems compatibility and seamless integration.
The estimated Period of Performance is: One (1) Year from Date of Award
The total estimated contract value is $578,750.09
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The intended use of a service Contractor is to replace the existing CCTV system with the Avigilon IP cameras and network recording system at the Wilkes-Barre VAMC. Configuration includes updating the camera firmware, changing the view of the camera if requested by the Police Service, and modifying the cameras’ network information. The equipment required for this installation includes cameras, switches, racks, cables, servers, and network video recorders. The labor costs associated are for installation of required equipment, device wiring, network wiring, network, and program management.

4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This is a Brand Name Only Requirement. The component list are exact requirements which are crucial to maintain the best CCTV coverage on the Wilkes-Barre VA campus, substitution of parts is not allowable due to the differences in performance. Such as focal length of the lens, when Police need to obtain a wider view the camera must have the ability to back out and provide coverage of the requested area.
Conversely when Police need fine detail the camera must be able to zoom in to obtain the picture required. Avigilon has unique abilities required for the Medical Center’s security posture and the package of items for this requirement are exact for this specific need. For example, the H4/H5 cameras listed in the requirement from Avigilon are ideal for seeing objects and activity in complete darkness. Embedded with proprietary and patented self-learning video analytics, the H4/H5 cameras seamlessly integrate with Avigilon Control Center (ACC)TM, allowing security personnel to respond proactively and mitigate an incident before damage occurs. With unique adaptive IR technology, this camera provides both wide and narrow illumination, enabling consistent illumination in complete darkness to enhance image quality regardless of scene conditions. Avigilon cameras are equipped with new Triple Exposure Ultra-Wide Dynamic Range (WDR), and patented LightCatcher TM technology, ensuring excellent image detail for security personnel. The H4/H5 cameras are effective at monitoring a variety of environments that require discreet nighttime coverage, including parking lots and multiple sensitive campus locations.
Avigilon maintains patents on much of its camera and video analytic technology and retains the exclusive rights to manufacture its technology. The video analytic technology allows Police to find what they are looking for faster, over vast amounts of recorded video. It utilizes facial recognition and license plate recognition. Police can also search the video based off physical descriptions, allowing operators to search for a person by selecting specific physical descriptions, including clothing color, gender, and age categorization. The analytic software is self-learning, with its object classification and tracking using pattern-based analytics to recognize people and vehicles, while ignoring nuisance motion. It also includes unusual activity detection that is designed to enable the detection of atypical activities, such as people and vehicles travelling at faster speeds or are in unusual locations and alert operators. The platform also offers a cloud-connected user experience to view live and recorded video remotely. This will allow Police at all connected VISN 4 sites with Avigilon CCTV system to provide security monitoring remotely in the event of an emergency. Only this suggested source can furnish the requirements, to the exclusion of other sources.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought notice was posted on Contract Opportunities on 2/17/2021.
A total of ten (10) vendors responded to the sources sought notice. Of those ten (10) vendors, eight
(8) were Service-Disabled Veteran-Owned Small Businesses (SDVOSB), one (1) was a Woman Owned Small Business (WOSB), and one (1) was a Small Business.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost to the Government of $578,750.09 is fair and reasonable in accordance with FAR 13.106-3(a)(2)(vi) when compared to the Independent Government Cost Estimate (IGCE). Contracts have been awarded for similar equipment with prices ranging from $419,620.00 (36C24420P0648) to $579,944.16 (36C24420D0031). Any consideration for a reduction in cost will be requested prior to contract award.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The Contracting Officer conducted a search on VIP VetBiz to determine if there are any SDVOSB’s or Veteran-Owned Small Businesses (VOSB) able to fulfill the requirement. Searches were also conducted on Federal Procurement Data System (FPDS) and Dynamic Small Business website (DSBS). Other websites used for research were Contract Opportunities, GSA Advantage, USASpending, and the Federal Procurement Data System (FPDS).
Based upon the Market Research conducted and the resulting analysis, adequate sources of supply for Small Business concerns were obtained and after reviewing the VIP database, the data supports setting aside the procurement to SDVOSB vendors. The Contracting Officer will set aside the procurement for SDVOSB vendors and post on Contract Opportunities.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: There are no other supporting facts.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No other vendors showed interest by responding to the sources sought notice posted in Contract Opportunities.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: As additional requirements occur, the market will be researched to determine if other companies are available in order to seek competition for similar requirements.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
