About this file

This document is a Justification for Other Than Full and Open Competition issued by the Federal Bureau of Investigation (FBI), Criminal Justice Information Services (CJIS) Division. The document seeks to sole-source a maintenance contract for a PDQ Laser Wash 360 Car Wash System located at the CJIS Division's Automotive Care Facility. Simoniz USA has been designated by PDQ Manufacturing as the exclusive authorized service provider for the North Central West Virginia region, making them the only vendor capable of performing the required maintenance services.

The proposed contract covers preventative maintenance, system inspections, parts replacement, and repair services for the proprietary car wash system, with a base year from February 1, 2026 through January 31, 2027 and four additional option years. The maintenance must be performed exclusively by factory-authorized technicians to ensure proper operation, compliance with original equipment manufacturer (OEM) standards, and preservation of equipment warranties. The CJIS Facilities Management Unit will continue monitoring the marketplace for potential future competition, but currently, Simoniz USA remains the sole responsible source for these specialized services.

AUTHORITY OF 41 U.S.C.253(c)(1)(or 10 USC 2304(c) (1)) as implemented by the Federal Acquisition Regulation

(FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy

Agency Requirements.”

Requisition Number:

Date: 11/13/2025

Base Year plus 4 Option Years

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation, Facilities Contracts Unit, has prepared this justification for other than full and open competition for Automotive Care Facility

Maintenance on behalf of the Facilities Management Unit, CJIS Division.

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

This action is being processed as a sole source procurement.

The CJIS Division’s Automotive Care Facility currently operates a PDQ Laser Wash 360 Car

Wash System, manufactured by PDQ Manufacturing, along with associated support equipment including compressors, boilers, and pumps. The purpose of this contract is to obtain maintenance and support services for the facility’s equipment from a contractor certified by the original equipment manufacturer (OEM), PDQ Manufacturing.

The PDQ Laser Wash 360 Car Wash System is a proprietary system that requires servicing exclusively by authorized factory-trained technicians. For the North Central West Virginia region, the OEM has designated Simoniz USA as the authorized service provider. Accordingly, Simoniz USA is the only source capable of providing the required maintenance services to ensure proper operation, compliance with OEM standards, and preservation of equipment warranties.

3. A description of the supplies or services required to meet the agency’s needs.

Requisition Number: (insert Req Number) Version 1.0 Page 2 of 5

This requirement will encompass:

Period of Performance

The anticipated period of performance for the base year is February 1, 2026 through January 31, 2027, with four (4) option years extending through January 31, 2031.

4. The statutory authority permitting other than full and open competition.

This acquisition is being conducted under the authority of Federal Acquisition Regulation

(FAR) Subpart 6.302-1, Only One Responsible Source and No Other Supplies or Services

Will Satisfy Agency Requirements (41 U.S.C. 3304(a)(1)).

Under this authority, full and open competition need not be provided when the supplies or services required by the agency are available from only one responsible source, or from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements.

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

The Laser Wash 360 Car Wash System, located at the CJIS Division’s Automotive Care

Facility, is a proprietary system manufactured by PDQ Manufacturing. Due to the specific technical characteristics of this equipment, all maintenance and repair services must be performed exclusively by factory-authorized and trained technicians to ensure compliance with OEM standards, maintain system integrity, and preserve warranty coverage.

For the North Central West Virginia region, PDQ Manufacturing has designated Simoniz

USA as the sole authorized service provider. As such, Simoniz USA is uniquely qualified to furnish the required preventative maintenance, inspections, and repair services. No other vendors are authorized or capable of providing these services, and therefore, Simoniz USA is the only responsible source able to meet the Government’s requirements.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

The services requested are unique to a proprietary system manufactured by PDQ Manufacturing.

In order to maintain the continuity of operations for the CJIS Division’s Automotive Care

Facility’s Laser Wash 360 System, maintenance and repair must be performed exclusively by factory-authorized and trained technicians.

Market research has confirmed that only one vendor is authorized to provide these services within the North Central West Virginia region. PDQ Manufacturing has designated Simoniz

USA as the sole factory-authorized service provider for this geographic area. As such, Simoniz

USA is the only responsible source capable of meeting the Government’s requirements.

A notice of intent to sole source will be publicized in accordance with FAR Subpart 5.2 to ensure transparency and to provide any potential sources the opportunity to identify their capability. No exceptions under FAR 5.202 are applicable to this requirement.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the

Government will be fair and reasonable.

The CJIS Facilities Management Unit (FMU) has maintained a requirement for preventative maintenance and repair services for the Laser Wash 360 Car Wash System for the past thirteen

(13) years. Historical data reviewed by the FMU Contracting Officer’s Representative (COR) demonstrates that these services have consistently been administered as a sole source requirement to Simoniz USA/Washing Equipment Technologies.

The average cost incurred over the past thirteen (13) years is consistent with the current estimated cost provided by the COR for the FY 2026 requirement. Based on this historical https://www.acquisition.gov/far/html/Subpart%205_2.html#wp1107980 https://www.acquisition.gov/far/html/Subpart%205_2.html#wp1107990

8. A description of the market research conducted and the results.

Market research confirms that the requested services are unique to a proprietary system manufactured by PDQ Manufacturing. To ensure continuity of operations for the CJIS Division’s

Automotive Care Facility’s Laser Wash 360 System, maintenance and repair services must be performed exclusively by factory-authorized and trained technicians.

For the past thirteen (13) years, this requirement has been administered as a sole source contract with Simoniz USA, the OEM-designated service provider for the North Central West Virginia region. Market research, including a review of historical procurement data and vendor authorization records, verified that Simoniz USA remains the only authorized source capable of fulfilling this requirement.

Historical cost data collected over the prior thirteen (13) years was analyzed by the CJIS

Facilities Management Unit (FMU) and the Contracting Officer’s Representative (COR). This analysis demonstrated that the estimated costs for FY 2026 are consistent with prior expenditures and have been determined to be fair and reasonable based on past performance and pricing trends.

9. Any other facts supporting the use of other than full and open competition.

The sole source provider for this requirement, Simoniz USA, is the designated factory-authorized regional representative for the PDQ Laser Wash 360 Car Wash System. Competition is limited due to the proprietary nature of the equipment and the restrictions imposed by the original equipment manufacturer (OEM).

Patents, proprietary data, and licensing agreements held by PDQ Manufacturing require that all maintenance and repair services be performed exclusively by factory-trained and authorized technicians. As a result, only Simoniz USA is permitted to furnish the required services within the North Central West Virginia region.

Accordingly, Simoniz USA is the only responsible source capable of meeting the Government’s needs, to the exclusion of other vendors, thereby supporting the use of other than full and open competition under FAR 6.302-1.

10. A listing of any sources that expressed a written interest in the acquisition.

The only Vendor expressing interest to this requisition includes:

POC: Don at (800) 388-4258 or fax (585) 265-1145

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

The requested services are unique to a proprietary system manufactured by PDQ Manufacturing.

To maintain continuity of operations for the CJIS Division’s Automotive Care Facility’s Laser

Wash 360 System, only one source is currently available to meet the Government’s requirements.

To encourage potential competition in future acquisitions, the CJIS Facilities Management Unit

(FMU) will continue to monitor developments in the marketplace and evaluate emerging technologies. Specifically, the FMU will research whether additional companies become certified or approved by PDQ Manufacturing to provide authorized maintenance services for the

Laser Wash 360 System. Should new providers be identified, the agency will assess their qualifications and consider competitive procurement methods for subsequent requirements.
