Justification and Approval for Other Than Full and
Open Competition
1. Contracting Activity: USPFO-AL
2. Description of Action: Action requested is to award a modification to W912JA-14-D-0001 Task Order W912JA-19-F-6004 for the award of Type B Architect and Engineering (A&E) services for the 187th Fighter Wing (FW) Aircraft Maintenance Unit (AMU) Building, Funding year 2021, FAKZ169003.
3. Description of Supplies/Services:
Purpose of the Modification is to perform Type B services in conjunction with AMU Building, FAKZ169003. In September 2018 a task order was awarded to the local A&E Indefinite Delivery Indefinite Quantity (IDIQ)holder Seay, Seay and Litchfield, PC (SS&L) for type A design services for the 187 FW AMU Building. During this time, SS&L has performed the following services: developed basis of design, developed project concept, performed the value engineering study, criteria review, initial planning meetings, space utilization, surveying, site investigations to include geotechnical services, and creation and presentation of multiple design options.
During the performance of Type A services, the IDIQ period of performance expired. This modification awards type B, to 100% designed, to SS&L. Continuity is essential during completion of the design and necessitates this task order modification.

4. Authority Cited:
6.302-1(a)(2)(ii) Only one responsible source and no other supplies or services will satisfy agency requirements.
(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in-
(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition; or
(B) Unacceptable delays in fulfilling the agency’s requirements.
5. Reason for Authority Cited:
In January 2014, the USPFO-AL issued an IDIQ contract to SS&L to perform the A&E Services to the Alabama Army and Air National Guard. Since then they have performed all A&E services for the 187 FW, to include creating the Installation Development Plan. In September 2018, SS&L was awarded a task order to perform type A services to design the 187 FW AMU Building. SS&L completed services to the 35% stage. The designs have been reviewed and approved by the end customers, Wing leadership and NGB/A4. The request for limiting competition, sole source, is to allow for continuity of design for the AMU Building.
This modification meets the intent of FAR 6.302-1(a)(2)(ii) in that it is a follow-on contract for the continued development of a highly complex and detailed project. There is a high probability of increased cost and time delays if this project is not awarded as a sole source. To date, $225,800 has been obligated to this design action. Further delay would cause substantial duplication of cost of the Government given the fact that 8 months of design time and many government man hours have been expended to date.
Proceeding with the modification was delayed due to an environmental survey that was performed that identified the proposed site as contaminated and additional time and planning was required to determine the appropriate remediation process for the contaminated soil. The revised Statement of Work was provided in September 2019.
The 187FW has also been selected as a preferred location for the F-35 aircraft. We have been given a highly compressed delivery schedule for the aircraft (2023) with 15 new projects required to support the delivery of the aircraft. Funding for the AMU Building is expected in FY2021. The AMU building is being designed to meet the manning requirements of the F-35, converting 7 AFSCs to 2 AFSCs and housing personal appropriately. To pursue this action competitively, under FAR Part 36.6, would add 6 – 12 months for the award of Type B services.
If a firm other than SS&L was selected, additional time would have to be added for re-work/revision to the previously performed Type A services. With an anticipated contract performance period of 12 months, these unacceptable delays could jeopardize the success of the AMU Building project and delivery schedule of the F-35 aircraft.
6. Efforts to Obtain Competition:
At this time effort to obtain competition has not been performed.
7. Actions to Increase Competition:
No actions have been taken at this time to increase competition. However USPFO-AL has initiated the acquisition process for a new local A&E IDIQ. This acquisition will be competitive, utilizing FAR Part 36.6 procedure. Anticipated award date is November 2020.
8. Market Research:
Specific market research for these items have not been performed.
9. Interested Sources: To date, no other sources have written to express an interest. The intent to award as a sole source was posted to www.fbo.gov with a 15 day response period. Draft posting attached. No responses received.
