NAICS Code is 333318 (Other Commercial and Service Industry Machinery Manufacturing)

Product Service Code is J075 (Maintenance and Repair of Offices Supplies and Devices)

Small Business Size Standard is 1,000 employees.

Opex Corporation is no longer a Small Business per the System for Award Management at https://www.sam.gov under UEI Number TPUHSANK6X84. While they are registered for all awards they no longer have an active GSA contract.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Opex Corporation, 305 Commerce Drive, Moorestown, NJ 08057-4215, is the Original Equipment Manufacturer (OEM) and holds proprietary rights to such equipment and maintenance thereof.

Per written documentation from Opex Corporation, maintenance of this equipment is proprietary to Opex Corporation. Since this Contractor owns the proprietary maintenance rights of this application, it is impossible for any other company to provide support for this application.

Opex Corporation owns the proprietary rights to maintain these scanners and no authorized third party could be found to service this equipment.

4. Description of market research conducted and results or statement why it was not conducted:

The VIP query using NAICS 333318 and keyword ‘scanner’ yielded 1. The Rule of 2 could not be met. Searched DSBS, GSA, SAM, and FPDS for alternative sources the results show this equipment can only be maintained by one source. Due to proprietary software and parts my recommendation is this maintenance contract be sole sourced to OPEX Corporation.

Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3. See the S19 Open Market (FAR13) Award Documentation Form with Abstract to document price reasonableness.
