Control No: W31P4Q-05-A-0026 Task Order 0015

FOR OFFICIAL USE ONLY

LIMITED SOURCE JUSTIFICATION

AMCOM EXPRESS CONTRACT W31P4Q-05-A-0026/0015

AMCOM G-3 Operations Programmatic Support

1. CONTRACTING ACTIVITY: Department of the Army, Army Contracting Command – Redstone Arsenal, CCAM-ESB, Redstone Arsenal, AL 35898-5000.

2. DESCRIPTION OF ACTION: AMCOM G-3 requests approval to award a contract modification to task order W31P4Q-05-A-0026/0015 on a firm-fixed price level of effort basis with Sigmatech, Inc., 4901 Corporate Drive NW STE C, Huntsville, AL, CAGE Code: 69572, under Expedited Professional Engineering Support Services (EXPRESS) Program Blanket Purchase Agreement (BPA) W31P4Q-05-A-0026 Task Order 0015. This modification would extend the period of performance (POP) from 28 September 2016 through 27 March 2017.

The Government projects award for September 2016. Army Procurement funds will be used.

The original task order W31P4Q-05-A-0026/0015 was competitively awarded on 29 September 2010 for a period of five years. The awarded ceiling amount was .

The total obligated amount to date on this task order is . There is remaining of the estimated ceiling and hours available.

The re-compete package was submitted with an anticipated award date of 28 Sep 2016, allowing sufficient time for a re-compete task order to be processed, however, a hold was placed for all new actions (including re-competes) due to a protest in the Programmatic Domain on approximately 12 June 2015 per Legal and the Contracting Officer.

As of 30 June 2016 notification was given that the Protest had been resolved thus allowing the EXPRESS program to move forward with conducting Request for Information and Task Order competitions.

The modification of W31P4Q-05-A-0026 Task Order 0015, programmatic support to the AMCOM G-3 will allow sufficient time for uninterrupted programmatic support to the AMCOM G-3 until the follow-on competition is completed. The Government will execute this action against Federal Supply Schedule GS-00F-0037P.

3. DESCRIPTION OF THE SUPPLIES/SERVICES: The AMCOM G-3 serves as the principal staff for the Command for all matters concerning external operations, plans, organization, concepts, and policies for supporting customers. G-3 is responsible for: (1) strategic contingency planning, geographical exercise planning and execution, military operations, mobilization, and force protection; (2) planning and integrating future operations, managing joint integration, and providing operational oversight of Operational Performance Metrics; (3) managing the Army’s tactical missile demilitarization program; (4) providing command-level staff coordination for the aviation and missile reset programs, to include aviation field maintenance activities, and modification of aviation assets and services in support of mission areas; (5) providing command cost analysis, systems analysis and earned value management support; (6) providing centralized management and planning of the Command’s participation in Army transformation related activities; and (7) coordination of tasks and actions that cross Program Executive Offices (PEOs) and/or command lines.

Because of the diversity and breadth of these initiatives, the AMCOM G-3 has a continuing need for programmatic support services, which currently includes critical programmatic support services for Functional, Program Management, Plans and Integration Support. The current ceiling and labor hours that are available will cover the estimated and provide an estimated hours required to provide support during the extended six month timeframe and does not require an increase. This modification would extend the task order period of performance (POP) from 28 September 2016 through 27 March 2017.

4. AUTHORITY CITED: Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.), and Title 40 U.S.C 501, Services for Executive Agencies, as implemented by Federal Acquisition Regulation (FAR) 8.405-6(a)(1)(i)(C). In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with applicable Federal Supply Schedule ordering procedures. The original order of BPA was not previously issued under a sole-source or limited-sources procedures.

5. REASON FOR AUTHORITY CITED: The proposed acquisition requires the use of the above cited authority (FAR 8.405-6(a)(1)(i)(C) based on the following:

This limited source justification regarding Sigmatech, Inc., 4091 Corporate Drive NW STE C, Huntsville, AL 35805, CAGE Code: 69572 supports the authority cited above in that the POP extension is a logical follow-on to an existing Federal Supply Schedule (FSS) order which was placed in accordance with the applicable FSS ordering procedures. The original task order W31P4Q-05-A-0026/0015 was competitively awarded on 29 September 2010. This is the third limited source justification using FAR 8.405-6(a)(1)(i)(C).

This acquisition is in the interest of economy and efficiency because a POP extension will prevent duplicate costs required to perform the programmatic services. In addition to the administrative cost associated with transferring the services to another contractor, it is anticipated that it would take approximately four to six months to train and familiarize them with processes and policies associated with performing the required tasks, and it is therefore not economical or efficient to award this action as it is only required for a short amount of time, until the new contract is awarded in the second quarter of FY17. Historically, transition costs (staffing, training, time lost due to learning curve) are estimated at 20% of the contract value as resourcing a contract for short term, many additional costs beyond those associated with labor would need to be factored in (i.e. TDY, security clearances, temporary office set up costs, etc.)

Extending the POP will prevent an unacceptable disruption in services. It is anticipated that without the approval of this requirement there may be a break in service of up to 6 months while the follow-on to W31P4Q-05-A-0026/0015 is awarded as a new task order. At a minimum, the resultant break in service will result in critical mission failure resulting in the failure of award of various acquisition requirements and delay of contract requirement packages for multiple customers. The resultant break would result in the AMCOM G-3 offices not being able to satisfy critical needs and potential impacts to develop critical program related documents in a timely manner to meet higher HQ budget submission timelines; develop documentation to support follow-on demilitarization contract efforts; and assist SME’s with detailed and labor intensive submission of budgetary/fiduciary documents.

Failure to provide the services will result in significant consequences for expiring missile shelf-life, as delays in execution will result in significant safety implications and increase storage costs to mission requirements.

Sigmatech, currently has a staff of personnel familiar with the mission of AMCOM G-3 and its customers. No other contractor can gain the necessary expertise in a timely manner to meet the Government’s requirement to begin work immediately and continue to support AMCOM G-3 without unacceptable delays and duplication of cost which would ultimately impact the progress of AMCOM G-3’s mission to support the war fighter. Current contractor personnel have detailed knowledge of AMCOM G-3’s programs and program requirements. The current contractor possesses the detailed technical expertise to generate and process documentation in accordance with laws, regulations, policies, and AMCOM G-3 staffing requirements. It is essential for these services to be provided to AMCOM G-3 in order to maintain operational readiness. Sigmatech can continue to provide invaluable support with developing documentation to support follow-on demilitarization contract efforts; and assist SME’s with detailed and labor intensive submission of budgetary/fiduciary documents.

Without POP extension current contract coverage will end 27 September 2016.

As supported by the above stated facts, this limited sources procurement to Sigmatech is critical to satisfying many real-time critical war fighter needs as well as many long-range acquisition requirements because, without the approved POP extension, there will be unacceptable delays of up to 6 months in fulfilling the current needs and ongoing operations by AMCOM G-3.

6. EFFORTS TO OBTAIN COMPETITION:

a. Effective Competition: The original contract was awarded utilizing full and open competition. This additional requirement was entered into the Competition Advocate’s Shopping List (CASL) database on 24 August 2016 and updated 14 September 2016. No contractors expressed an interest in the requirement and no additional sources are being sought because it would not be economical or efficient for this brief period of performance.

Sigmatech is the only source that can complete the effort within the required timeframe.

This action is exempt from being synopsized IAW FAR 8.404(a).

b. Subcontracting Competition: Contract W31P4Q05A0026 Task Order 0015 includes the requirements of FAR 52.244-5, "Competition in Subcontracting" in the BPA. To ensure the contractor obtains competition in subcontracting, all applicable clauses required by FAR, DFARS, and AFARS will be applicable to this extension.

7. ACTIONS TO INCREASE COMPETITION: There is acquisition data available for competitive acquisition for a re-compete of the current task order, based on request for information results. Task Order Request for Quotes (TORFQ) was released 25 August 2016 for the follow-on effort; with quotes expected by 26 September 2016 and an estimated contract award on or before 27 March 2017. The TORFQ was released competitively under the AMCOM Express Programmatic Domain to all current BPA holders on. These actions will increase the competition of the programmatic support services for UHPO. This action is exempt from being synopsized IAW FAR 8.404(a).

8. MARKET RESEARCH: Market research has been performed in accordance with FAR part 10.002. In August 2016, the Business Chief of AMCOM G-3 and Contract Analyst in the AMCOM G-3 Contracts and Acquisition Management Branch, conducted market research using personal knowledge and posting this follow-on action in the CASL database on 24 August 2016 and updated 14 September 2016 Both program experience and personal knowledge were used to determine that no other source is capable of mobilizing in time to meet the requirement within the needed timeframe. Other market research techniques used included reviewing recent market research results for similar services, including the AMCOM Express Programmatic Domain, August 2016. However, based on the amount of time required to train and familiarize a new vendor, it was determined that only Sigmatech could meet G-3’s requirement during this interim period. FAR Part 12 was used for the GSA contract, this task order is based on the GSA contract, so it utilizes FAR Part 8.

9. INTERESTED SOURCES: This requirement will not be synopsized in accordance with the exception stated in FAR 8.404(a) which states "when establishing a BPA, or placing orders under Federal Supply Schedule contracts using the procedures of 8.405, ordering activities shall not seek competition outside of the Federal Supply Schedules or synopsize the requirement." As indicated in FAR 8.405-6(a)(2)(i) and (iii), a redacted version of the limited source justification will be posted within 14 days after executing this action. A copy of the posted notice will be placed in the contract file. To date, there have not been any other sources expressing an interest in writing. In the event any bids/proposals are received they will be considered.

W31P4Q-05-A-0026/0015 was modified with a LSJ (contract modification 52) on 17 August 2015, by the Contracting Officer for time extension from 28 September 2015 through 27

March 2016 in accordance with FAR 8.405-6(a)(1)(i)(C) as the remaining ceiling and labor hours were available to cover the estimated hours of support during the extended timeframe and did not require any increase.

At the time of approval of this Limited Sources Justification and Approval Paragraph 7, Actions to Increase Competition, stated “A new task order is in process and will be competitively solicited and awarded under the EXPRESS program no later than 27 March 2016 to provide programmatic support to AMCOM G-3. However, a hold was placed for all new actions (including re-competes) due to a protest in the Programmatic Domain on approximately 12 June 2015 and was not resolved by September 2015, therefore, the solicitation could not be released

W31P4Q-05-A-0026/0015 was modified with a LSJ (contract modification 55) on 14 December 2015 by the Contracting Officer for time extension from 28 March 2016 through 27 September 2016 in accordance with FAR 8.405-6(a)(1)(i)(C) as the remaining ceiling and labor hours were available to cover the estimated hours of support during the extended timeframe and did not require any increase.

At the time of approval of this Limited Sources Justification and Approval Paragraph 7, Actions to Increase Competition, stated “A follow-on task order is in process and will be competitively solicited and awarded under the EXPRESS program no later than 27 September 2016 to provide programmatic support to AMCOM G-3. However, the litigation filed by Sigmatech, Inc. in the U.S. District Court for the Northern District of Alabama during February 2016 prevented the processing of all pending new contractual actions und the EXPRESS Programmatic Domain until the litigation was dismissed on 21 June 2016. The dismissal of the litigation allowed ACC-Redstone to once again process new requirements among the holders of the BPA under EXPRESS Programmatic Domain. The TORFQ for the follow-on TO was released 25 August 2016 and close 25 September 2016. Anticipated award of new competitive TO before 27 March 2017.
