About this file
This is a Justification for Other Than Full and Open Competition (JOTFOC) document from GSA Federal Acquisition Service for the procurement of Ivan Cover thermal targets from ThermBright Ltd (P/N MJS7266) at an estimated cost of $42,000.
The JOTFOC justifies a sole-source procurement based on ThermBright being the only known vendor able to meet requirements for effective target passive thermal signatures, as proven during live fire exercises at Fort Drum, NY. The product consists of PVC-backed nylon covers with specific characteristics including: OD green color, emissivity less than .15, compatibility with US Military 3D Ivan SIT/MIT backers, ability to withstand 100+ 50 BMG impacts and 2,000+ 5.56 impacts, functionality with all NVG/thermal/fusion sights, and water resistance. The Contracting Officer will post the RFQ on SAM.gov for 7 days to allow vendors quoting the required brand name items to submit quotes, though market research was limited due to the sole-source nature of the requirement.

IDENTIFICATION OF STATUTORY AUTHORITY
This acquisition is conducted under the authority of Section 201 of the Federal Property and Administration Act of 1949 (40 U.S.C. 501). All acquisitions for THERMAL MATERIAL ROLL will be conducted under the authority of the Open Market Program. The primary statutory authorities for the MAS Program are Title II of the Federal Property and Administrative Services Act of 1949, and Title 40 U.S.C. 501, Services for Executive Agencies. In accordance with FAR Part 13, approval is sought for a sole source procurement based on the circumstances and rationale for restricting consideration of schedule contractors is FAR 13.106-1(2)(b)(1)“For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization)”.
IVAN COVER is a commercial product as defined in FAR 12.101.
DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE
AUTHORITY CITED
FAR 13.106-1 allows restricting consideration of schedule contractors to fewer than required in FAR
13.104 whenever only one source is capable of responding due to the unique or specialized nature of the item required by the agency is exclusive to one manufacturer or when there is an urgent requirement. ThermBright Passive Thermal Technologies is the only known brand name vendor that has been able to meet the government’s requirement for an effective target passive thermal signature as proven during a recent live fire exercise conducted on Range 44, Fort Drum, NY. Other vendors have provided us with similar passive thermal products in the past which we have tested in a live fire training environment, but they have not proven as effective or failed to provide the adequate target thermal signature required for successful completion of the live fire exercise degrading the ability of Units to properly train their soldiers on the use of their weapon system thermal sights. In those cases we were forced to substantially delay training so that Range Maintenance personnel could build sandbag positions to protect the generators that we were forced to use to power 120VAC thermal blankets in order to meet the training requirements of the unit.
EFFORTS TO SOLICIT TO AS MANY SOURCES AS PRACTICABLE
The Contracting Officer will synopsize the RFQ through SAM.gov for a total of 7 days. Vendors quoting the required name brand items will be allowed to submit quotes.
DETERMINATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE
Current quoted pricing is fair and reasonable based on competition among vendors quoting the required IVAN COVER.
DESCRIPTION OF THE MARKET RESEARCH CONDUCTED
Due to the limited source nature of this requirement no other manufacturers’ products were sought.
However, the Contracting Officer will synopsize the RFQ for 7 days through SAM.gov.
OTHER FACTS SUPPORTING THE USE OF THE OTHER THAN FULL AND OPEN
COMPETITION
While GSA is committed to expanding competition, we must accomplish that goal with the least risk to the successful support of the GSA Mission and the ongoing efforts in the war on terror and homeland security. GSA jeopardizes being able to meet our customers’ need by not completing this limited-source, brand name specific procurement.
LIST OF SOURCES THAT EXPRESSED AN INTEREST IN THE ACQUISITION
Due to the limited source nature of this requirement no other manufacturers’ products were sought.
However, the Contracting Officer will synopsize the RFQ for 7 days through SAM.gov.
STATEMENTS OF ACTION TO OVERCOME BARRIERS TO COMPETITION
See section “EFFORTS TO SOLICIT TO AS MANY SOURCES AS PRACTICABLE” above.
CONTRACTING OFFICER CERTIFICATION
