About this file

This is an Award Recommendation and Evaluation Synopsis for an Invitation to Negotiate (ITN) issued by the Michigan Department of Transportation's Purchasing office. The ITN 210000000049 sought to procure De-Ice Master+ ice and snow removal chemical for the 2021/2022 winter season to maintain consistency with previous pilot evaluation efforts related to direct liquid application. The solicitation was posted on SIGMA on July 28, 2021, for a 15-day period with a due date of August 11, 2021. Two bidders submitted proposals by the deadline: Chloride Solutions, LLC of Webberville, Michigan, and Harmony Deicing Products, Inc. of St. Charles, Illinois. The evaluation was conducted by Laura Dotson, MDOT Purchasing Section Solicitation Manager, and Justin Droste, MDOT Roadway Maintenance Engineer III.

Both bidders were determined to be non-responsive and non-responsible because their products did not match the specified De-Ice Master+ formulation from Michigan Chloride. Specifically, Chloride Solutions offered a product containing Geomelt S7 additive instead of the required Iceban 100 additive, and Harmony Deicing Products also failed to include the Iceban 100 additive. Because no viable alternative to the intended source existed among the responses received, the State recommends awarding the contract to Michigan Chloride pending State Administrative Board approval. The State will enter into negotiations with Michigan Chloride to execute the contract. Questions regarding this ITN may be directed to Laura Dotson, Solicitation Manager, at DotsonL2@michigan.gov or (517) 230-1612.

Award Recommendation and Evaluation Synopsis

Invitation to Negotiate (ITN)

Background Information:

This ITN 210000000049, for a new Contract for De-Icer Master, Ice and Snow Removal Chemical was undertaken by the Michigan Department of Transportation’s Purchasing office to advise contractors of the State’s desire to purchase De-Ice Master+ and intention to enter into negotiations and execute a contract based on its belief that only one contractor – Michigan Chloride - is able provide it.

Bidders:

The ITN was posted on SIGMA on July 28, 2021 for 15 days. The following bidders submitted a proposal by the published due date of August 11, 2021.

Bidder Address City, State Zip

Chloride Solutions, LLC

Webberville, MI

Harmony Deicing Products, Inc. St. Charles. IL

Because the State received a response from bidders, other than the intended source, the State reviewed the responses to determine if a viable alternative existed.

I. ITN Evaluation Process

A Responsible Vendor is a vendor who demonstrates the ability to successfully perform the duties identified by the ITN. A Responsive proposal is one that is submitted in accordance with the ITN instructions and meets all mandatory requirements identified in the ITN.

Responses to this ITN were reviewed by :

Laura Dotson, MDOT Purchasing Section, Solicitation Manager Justin Droste, MDOT Roadway Maintenance Engineer

III. ITN Evaluation Results

Bidder #1, Chloride Solutions, LLC did not meet the requirements of being responsive and responsible due to the following:

STATE OF MICHIGAN PROCUREMENT

Michigan Department of Transportation 425 W. Ottawa, Lansing, MI 48909

Version 2 Revised: 2/2019

The information provided for the Chloride Solutions product does not include the Iceban 100 additive requested in the ITN. The different additive they list is Geomelt S7. The product offered by Chloride Solutions is different than the requested product from Michigan Chloride.

Bidder #2, Harmoney Deicing Products, Inc. did not meet the requirements of being responsive and responsible due to the following:

The product offered by Harmoney Deicing Products, Inc. is different than the De-Ice Master+ offering from Michigan Chloride.

The information provided for the Harmoney Deicing Products, Inc. product does not include the Iceban 100 additive requested in the ITN. The product offered by Harmoney Deicing Products is different than the requested product from Michigan Chloride.

As noted in the ITN, De-Ice Master+ is being requested, for the 2021/2022 winter season, to maintain consistency with previous pilot evaluation efforts related to direct liquid application. In subsequent winter seasons for the direct liquid pilot MDOT will seek additional liquid deicing chemical products that include agricultural byproducts and encourage both vendors to apply.

VIII. Award Recommendation:

Because the responses from the bidders identified above are not a viable alternative to the intended source, an award recommendation is made to Michigan Chloride pending State Administrative Board approval if applicable. More information on the State Administrative Board can be found at: State Administrative Board.

The State will enter into negotiations with the awarded contractor to execute a contract. Questions about this ITN may be directed to the Solicitation Manager who may be contacted as follows:
