SECTION 2 - STATEMENT OF WORK (SOW)
2.1 Agency Mission
The United States International Trade Commission is an independent, quasi-judicial Federal agency with broad investigative responsibilities on matters of trade. The mission of the USITC is to (1) administer U.S. trade remedy laws within its mandate in a fair and objective manner; (2) provide the President, the U.S. Trade Representative (USTR), and the Congress with independent quality analysis, information and support on matters relating to tariffs, international trade and competitiveness; and (3) maintain the Harmonized Tariff Schedule (HTS) of the United States.
2.2 Background
The mission of the Office of Security and Support Services is to implement, coordinate, and execute programs supporting the effective operation of the USITC in fulfillment of its statutory mission. These programs encompass all areas of physical security, safety, and asset protection; personnel security;
security and safeguarding of classified and controlled unclassified information in physical form;
emergency response and continuity of operations; and facilities management.
The Office of Security and Support Services administers the facilities, property, furniture, supplies, space, and equipment (excluding IT equipment) management programs and is responsible for overseeing and monitoring the maintenance of the HVAC units at the USITC. These units supply power to the above-standard cooling systems currently in various conference rooms and the Computer Room.
2.3 Objective
The purpose of this Purchase Order is to limit unscheduled outages and breakdowns, by providing highly qualified service technicians to maintain all HVAC equipment covered in the attached Equipment List (Attachment 1) to the manufactures’ specifications or better.
2.4 Scope
The Contractor shall supply all labor in accordance with the attached Wage Determination (Attachment 2), parts, materials, supervision, technical manuals, test instruments, equipment, supervision, and transportation to perform the functions and tasks required under this contract, unless otherwise specified to perform the required services.
2.4.1 Initial Inspection of Equipment
The Contractor shall, within 15 days after contract start date, perform and complete a walkthrough of all equipment listed in Attachment 1 and provide a written report of all findings. The Contracting Officer’s Representative (COR) will determine if a service call will be issued to correct deficiencies.
2.4.2 Preventive Maintenance (PM)
2.4.2.1 The Contractor shall perform monthly scheduled PM inspections and cleanings each year. It is the sole responsibility of the Contractor to schedule and perform all PM inspections. The specific dates for scheduling the PMs shall be coordinated between the Contractor and the COR. PM inspections shall be performed during the hours of 9:00 AM and 4:00 PM, Monday through Friday, excluding federal holidays.
2.4.2.2 The Contractor shall perform a thorough maintenance check and cleaning of the system on each piece of equipment in accordance with (IAW) industry standards and equipment manufacturers’ recommended maintenance schedules.
2.4.2.3 Water treatment shall consist of at least 40% Glycol concentration
2.4.2.4 The Contractor shall submit a PM Inspection Report upon completion of each PM performed.
2.4.2.5 The Contractor shall inform the COR (or other designated Government Official) of all adverse conditions discovered while performing PM services the same day as discovered. Adverse conditions discovered that could potentially jeopardize the operation of all other equipment shall be reported to the COR immediately after discovery.
2.4.2.6 All PM costs shall be covered in the monthly PM contract line item number (CLIN). No additional costs shall be charged to the Government for any PM parts, labor, materials, equipment, transportation, tools or supervision.
2.4.3 Service Call
2.4.3.1 The Contractor shall provide a central call support service by phone 24 x 7 x 365 (including weekends and federal holidays). Center call support service can be either a live person or answering machine.
2.4.3.1.1 On-site service with a qualified technician will be provided within 3 hours of the initial phone call to the central call support service number during the hours of 9:00 AM and 4:00 PM, Monday through Friday.
2.4.3.1.2 On-site service with a qualified technician will be provided within 4 hours of the initial phone call to the central call support service number during the hours outside of 9:00 AM and 4:00 PM, Monday through Friday, including weekends and federal holidays.
2.4.3.2 Repairs
2.4.3.2.1 All repairs shall be in accordance with industry standards, manufacturers’ specifications, and codes applicable to the equipment covered in the Equipment List.
2.4.3.2.2 The Contractor shall perform repairs not to exceed $500.00 (without COR (or other designated Government Official) approval), including labor and parts, and shall provide a report with a written description of the work performed within 2 working days to the COR (or other designated Government Official). The Contractor shall also include in the written report, man-hours used and any parts that were required to make the repair.
2.4.3.2.3 Repairs estimated to exceed $500.00 shall be verified with the COR (or other designated Government Official) prior to servicing and/or purchasing any parts. If repair or replacement of part(s) is required, the Contractor shall submit a quote to the COR (or other designated Government Official) for approval. The COR (or other designated Government Official) will approve repairs up to $2,500.00 and the Contracting Officer (CO) will approve repairs exceeding $2,500.00.
2.4.3.2.4 Any equipment required to be removed from the Commission’s building for repair work shall not be removed without the proper written approval from the COR (or other designated Government Official).
2.4.3.2.5 All replacement parts/components for HVAC units shall be new and from the same manufacturer as that installed. Where parts/components are no longer available, then the system shall be revised or upgraded with new parts/components. Parts/components shall meet or exceed the manufacturer’s operating specifications upon completion of repairs. The Contractor shall submit schematic drawings of any parts/component revision(s) to the COR (or other designated Government Official) for approval prior to any installation.
2.4.3.2.5.1 Factory refurbished parts/components may ONLY be used in the event the new parts/components are not available, and with prior COR (or other designated Government Official) written approval.
2.4.3.2.6 Upon completion of work, the equipment shall be free of missing components or defects which would prevent it from functioning as originally intended and/or designed. Corrective or repair/replacement work shall be carried to completion including operational checks and cleanup of the job site. Except where otherwise noted, replacement parts/components shall match existing in dimensions, finish, color, design, and function.
2.4.3.3 The Contractor shall invoice for all service calls at the end of the month, using the line items in the Purchase Order for Service Call – Labor (no trip charge will be reimbursed) and Service Call – Reimbursement for Parts (for parts/materials over $150.00). The Contractor shall also attach all service reports to the invoice for the month being invoiced.
2.4.3.4 Reimbursement for Parts Necessary for Service Call Repairs
2.4.3.4.1 The Contractor shall be responsible for the first $150.00 for parts/materials per job/service call. EXAMPLE: Repairs were performed on a heat pump.
The total parts installed cost $419.00. The Contractor is responsible for $150.00; thus $419.00 minus $150.00 = $269.00 that would be reimbursed to the Contractor under the Reimbursement for Parts CLIN.
2.4.4 Replacement, Modernization, and Renovation
During the term of the Purchase Order, the Government may replace, renovate, or upgrade equipment, HVAC and control systems, and components at the Government’s expense and by means associated with this Purchase Order. All replaced, improved, updated, modernized or renovated equipment, and components shall be maintained, and/or repaired by the Contractor at no additional costs to the Government.
2.4.5 Warranties
2.4.5.1 The Contractor shall offer a minimum of 30 days warranty on labor for installation of all parts and components. This is in addition to the warranties offered by the parts manufacturer. The Contractor shall provide all parts and component warranties to the COR (or other designated Government Official).
2.4.5.2 Equipment components and parts, other than that installed under this Purchase Order, shall not be removed or replaced or deficiencies corroded while under warranty of the manufacturer or the installer without prior approval from the COR (or other designated Government Official). All defects in material or workmanship, defective parts, or improper installation and adjustments found by the Contractor shall be reported to the COR (or other designated Government Official). The Contractor shall be knowledgeable of the equipment, parts, and components that are covered by warranty. The COR (or other designated Government Official) will furnish all available warranty information to the Contractor. Furthermore, when any HVAC system parts/components are changed by personnel other than the Contractor, the Contractor will be informed. If the Contractor is not informed of the new part/component changed, the Contractor shall not be held accountable for warranty information on that part/component.
2.4.6 Clean-Up
2.4.6.1 All debris and excess material/parts shall be cleaned up and removed from the Commission at the completion of the job and/or at the end of each work day. The Contractor shall retain all parts replaced until parts are inspected by the Government.
2.4.6.2 The Contractor shall dispose of all residues offsite in strict accordance with all applicable federal, state, and local laws and regulations.
2.4.6.3 The Contractor is responsible to report and promptly clean-up all spills in a manner consistent with current federal environmental regulations.

2.4.7.1 The Contractor shall provide safety controls and protection for the life and health of personnel and other persons and for the prevention of damage to property, materials, supplies, and equipment.
2.4.7.2 The Contractor shall comply with all applicable federal, state, and local requirements for protecting the safety of the Contractor’s personnel, building occupants, facilities and the environment. In particular, all applicable standards of the Occupational Safety and Health Administration (OSHA) shall be followed when working in accordance with this Statement of Work.

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS. (OCT 2015)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-
(i) The Offeror and/or any of its Principals-
(A) Are [ ] are not [ ] presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have [ ] have not [ ], within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for:
commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);
(C) Are [ ] are not [ ] presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in subdivision (a)(1)(i)(B) of this provision; and
(D) Have [ ], have not [ ], within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required.
A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection.
The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has [ ] has not [ ], within a 3-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
(End of provision)
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS.

If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.
