1.3 Procurement Officer

The Procurement Officer, acting on behalf of the FDACS, is the sole point of contact for official meetings, questions, and all procurement related matters relating to this solicitation.

The Procurement Officer for this ITB is:

Brittany Harvey, Procurement Officer Florida Department of Agriculture and Consumer Services Email: Bids@FDACS.gov

Between the release of the solicitation, and the end of the 72-hour period following the agency posting the notice of intended award, excluding Saturdays, Sundays, and State holidays, any employee or officer of the executive or legislative branch concerning any aspect of this solicitation, except in writing to the Procurement Officer or as provided in the solicitation documents. Violation of this provision may be grounds for rejecting a response.

1.4 Mandatory Requirements

The Department has established certain requirements with respect to bids to be submitted by respondents. The use of “shall”, “must” or “will” (except to indicate simple futurity) in this ITB indicates a requirement or conditions from which a material deviation may not be waived by the Department. A deviation is material if, in the Department’s sole discretion, the deficient response does not substantially comply with the ITB requirements, provides an advantage to one vendor over other vendors, has potentially significant effect on the quantity or quality of items bid, or on the cost of the Department. Material deviations cannot be waived. The words “should” or “may” in this ITB indicate desirable attributes or conditions but are permissive in nature. Deviation from, or omission of, such a desirable feature, will not in itself cause rejection of a bid.

1.5 Conflicts and Order(s) of Precedence

All bids are subject to the terms of the following provisions of this ITB, which are hereby incorporated by reference, and in case of conflict shall have the following order of precedence:

1) Addenda, in reverse order of issuance.

2) ITB, including attachments and appendices.

3) PUR 1001, General Instructions to Respondents; and

4) PUR 1000, General Contract Conditions.

SECTION 2.0 TECHNICAL SPECIFICATIONS

2.1 Scope of Work

This ITB seeks a vendor to provide all labor, water, herbicides, materials, tools, transportation, equipment, and supervision necessary to perform mechanical grid spot ground herbicidal application using undiluted Velpar L. (or equivalent). The treatment will cover approximately 282 acres along the Walk in Water Tract within Lake Wales Ridge State Forest. All equipment used must be acceptable to and approved by the FFS.

This project includes four (4) designated site preparation areas, consisting of recently mulched sand pine scrub and sandhill habitats with minimal existing canopy. All work must be completed mailto:Bids@FDACS.gov https://www.dms.myflorida.com/content/download/2934/file/PUR%201001%20General%20Instructions%20to%20Respondents.pdf https://www.dms.myflorida.com/content/download/2933/file/PUR%201000%20%28General%20Contract%20Conditions%29.pdf in accordance with FFS specifications outlined in this solicitation. For specific site locations, please refer to the treatment area maps provided in Appendix I.

2.2 Technical Requirements

The contractor must apply undiluted Velpar L (or an approved equivalent) only within designated treatment areas. The application prescription consists of three (3) quarts (96 ounces) of Velpar L per acre, applied in a 3-foot by 3-foot grid pattern. Any proposed equivalent must be reviewed and approved by the FFS Forester-in-Charge prior to use.

2.2.1. Description and Location

Treatment areas will be scheduled and identified by the FFS with the contractor. The project site is located within the Walk in Water Tract of the Lake Wales Ridge State Forest. Site boundaries will be identified by woods roads, firebreaks, stand edges, powerline easements, flagging, or other methods as discussed with the contractor. These boundaries will be reviewed with the contractor prior to the start of treatment. Herbicide application shall only be applied within the designated areas.

2.3 Estimated Quantities

The estimated treatment acres are given only as a guideline for vendors preparing a bid in response to this ITB and should not be construed as representing the actual acreage to be treated under the resulting contract.

The FFS reserves the right to increase the treatment acreage up to an additional 20% of the specified contracted treatment acreage at the same unit price per acre on the contractor’s bid response, if necessary.

2.4 Equipment and Personnel Requirements

Spot applicators are required for this project. Due to the presence of sugar sand on access roads, only 4-wheel-drive trucks or UTVs may be used; 2-wheel-drive vehicles are prohibited on all service roads within the Lake Wales Ridge State Forest.

All equipment used to perform the work must be of the proper size and type, in good working condition, and capable of safely and effectively completing the required work. Safety protocols must comply with all applicable federal regulations and herbicide label recommendations. The Forester-in-Charge reserves the right to direct the removal or replacement of any equipment deemed unsatisfactory.

If the contractor's equipment breaks down, the contractor is responsible for repair, replacement, and/or removed from the site, at the contractor’s sole expense, within three (3) working days.

Work shall not remain idle for more than 48 consecutive hours without prior approval from the Forester-in-Charge. The contractor must provide sufficient personnel and equipment to complete the project within the specified time outlined in Section 2.9, Delivery. Any contractor personnel-related issues must be resolved immediately by the contractor to avoid delays.

If the contractor uses personnel on this project who are not fluent in English, the contractor shall provide a project foreman who is fluent in both English and the language spoken by those personnel.

2.5 Herbicide Application and Treatment Methods

The contractor shall apply three (3) quarts (96 ounces) of undiluted Velpar L. (or approved equivalent) per acre using a grid spot application method.

1) Chemicals shall be applied at the specified rate and in accordance with the product label.

2) All chemical applications must be applied in a manner that ensures private property is unaffected.

3) A one half (1/2) chain (33 foot) buffer strip must be maintained along all State Forest boundaries.

4) Additional buffer zones may be required and will be determined by the Forester-in-Charge and relayed to the contractor.

To ensure proper coverage:

1) The contractor shall track application coverage with GPS to ensure uniform coverage.

2) Any alternative methods must be approved by the Forester-in-Charge.

3) A minimum of 95% application coverage is required across the designated treatment acres.

4) Streaking must be kept to a minimum, and any skips, streaks, or missed areas must be retreated at no additional cost to the Department.

Post-treatment:

1) Treatment effectiveness will be evaluated six (6) weeks after completion.

2) If retreatment is required and still within the required treatment window (March 1, 2025 – June

15, 2025), the contractor must complete retreatment within 30 calendar days of the

Department’s notification.

3) If retreatment cannot be completed within the required treatment window, it must be completed between March 1, 2027 – June 15, 2027.

4) Failure to achieve 95% effective coverage may disqualify the contractor from bidding on future projects for the FFS.

Verification and compliance:

The contractor shall permit FFS personnel to confirm chemical application rates per acre. The contractor must show the Forester-in-Charge the sealed herbicide containers prior to application and the empty containers following completion of the project.

This contract may be cancelled or extended by the FFS if weather conditions warrant.

2.6 Weather Conditions

Rain: Herbicide application will not be allowed during rainy conditions. Areas receiving rainfall within three (3) hours following treatment may require retreatment at the discretion of the FFS Project Manager.

Temperature: Chemicals shall be stored in accordance with the label directions and not be left in conditions which may decrease the effectiveness of the herbicide.

If weather conditions cause extended delays or unfavorable treatment environments this contract may be terminated early. Application must take place within the growing season.

2.7 Resource Protection

The Walk in Water Tract site consists of low-density scattered native pine and hardwood species which are beneficial to the natural community. The Contractor shall minimize damage caused to these species by not applying chemicals within six feet (6’) of the stem or within the drip line of the following species.

• Longleaf Pine

• Slash Pine

• Scrub Hickory

• Turkey Oak

• Silkbay

A brief meeting with the contractor’s crew and/or foreman will be conducted before the start of work, to instruct the crew on the identification of these plant species.

The contractor shall perform the work in a safe and careful manner and will furnish and use such safety devices, methods and measures as required to protect contractor and employees, FFS personnel, and the general public against bodily injury and/or damage to property.

This includes providing all Personal Protective Equipment (PPE) to employees as required in accordance with the herbicide label.

1) Protection of Native Communities: Due to the highly aggressive nature of nonnative invasive plants, the contractor must take care not to further spread any nonnative invasive plants on any State Forest. No soil disturbing activity may take place in areas infested by nonnative invasive plants. The Forester-in-Charge will identify all infested areas that must be avoided in the project prework meeting. All equipment and vehicles must be cleaned prior to removal from the site. The contractor’s equipment and vehicles must be clean and free of nonnative invasive plant material and / or seed before arrival on Lake Wales Ridge State Forest to perform work described herein.

2) Protection of Faunal Species: The contractor shall use every precaution necessary to prevent disturbing and harassment of wildlife encountered on the State Forest and other state managed lands. The willful killing of any animal species (i.e., amphibians, birds, fish, mammals, or reptiles) while working on the state forest will not be tolerated. Violations will void the contract, and the contractor may be subject to prosecution under appropriate wildlife laws.

3) Protection of Streams, Lakes, Wetlands, and Reservoirs: The contractor, upon the discovery of suspected archaeological or historical materials, shall cease work in the vicinity of such material and immediately notify the Forester-in-Charge.

4) Protection of Archaeological / Historical Resources: The contractor, upon the discovery of suspected archaeological or historical materials, shall cease work in the vicinity of such material and immediately notify the Forester-in-Charge.

5) Erosion Control: All equipment and vehicles will be operated in a manner to cause the least disturbance to the soil and groundcover vegetation.

2.8 Best Management Practices

Contractor shall adhere to and implement all applicable best management practices for silvicultural operations as outlined in the current Silviculture Best Management Practices Manual

An award shall be made to the responsive and responsible vendor with the lowest Grand Total Price, as specified in Attachment D - Price Sheet for all specifications and considerations, in response to this ITB. An award from this bid does not constitute an official purchase order, contract, agreement, or commitment on behalf of the State.

In event the vendor with the lowest Grand Total Price is found non-responsive, the Department may proceed to the next responsive vendor with the lowest Grand Total Price and continue the award process.

3.19 Less Than Two Responsive Bids

Only written communications from the Department’s Procurement Officer are considered duly authorized expressions on behalf of the State. Additionally, only written communications from a vendor are recognized as duly authorized expressions on behalf of the vendor.

Any discussion by a vendor with any employee, or representative of the Department, involving cost or price information, occurring prior to the Department publishing the Notice of Agency Decision, may result in rejection of said vendor’s bid.

3.22 No Prior Involvement and Conflict of Interest

Section 287.057(19)(c), F.S., states, “A person who receives a contract that has not been procured in accordance with subsections (1)-(3) to perform a feasibility study of the potential implementation of a subsequent contract, who participates in the drafting of a solicitation or who develops a program for future implementation, is not eligible to contract with the agency for any other contracts dealing with that specific subject matter, and any firm in which such person has any interest is not eligible to receive such contract. However, this prohibition does not prevent a vendor who responds to a request for information from being eligible to contract with an agency.”

The Department considers participation in a solicitation to be any actions related to the decision, approval, disapproval, recommendation, preparation of any part of a purchase request, influencing the content of any specification or procurement standard, rendering of advice, investigation, auditing, or functioning in any other advisory capacity.

The vendor shall not compensate, in any manner, directly or indirectly, any officer, agent or employee of the Department, for any act or service, which they may do, or perform, for, or on behalf of, any officer, agent or employee of the vendor. Officers, agents, or employees of the Department shall not have any interest, directly or indirectly, in any contract or purchase made, or authorized to be made, by anyone for, or on behalf of, the Department.

The vendor shall have no interest, and shall not acquire any interest, that conflicts in any manner, or degree, with the performance of the services required under this ITB.

Proof of certification pursuant to Section 295.187(5), F.S., shall accompany the bid response. Failure to submit proof of certification will result in non-application of the preference.

More than one (1) bid from an individual, firm, partnership, corporation, or association, under the same or different names, will not be considered. If there is reason to believe that collusion exists among the vendors, any or all bids will be rejected. No participants in such collusion will be considered in future procurements for the same work. Falsifications of any entry made on the vendor's offer will be deemed a material irregularity and will be grounds for rejection.
