General Notes:
ATTACHMENT 1 - BULK SAMPLE SUMMARY
Survey Protocol. The asbestos survey and sample collection efforts utilized to identify and delineate the extent of asbestos-containing materials within the structures on these parcels meet existing Environmental Protection Agency (EPA) NESHAPs regulatory requirements. The corresponding bulk sampling of suspect materials complies with current OSHA (AHERA/ASHARA) requirements for the identification of asbestos-containing materials in buildings, (i.e., referenced AHERA protocol). Materials historically known to have used asbestos in their manufacture, such as, Transite panels, cement asbestos board and pipes, and black roof mastic were not sampled and are assumed to contain asbestos.
Definition of ACM. Current NESHAPs regulations define asbestos-containing materials (ACM) as those materials containing ≥ 1 percent asbestos. NESHAPs notification and disposal requirements, enforced in the State of Georgia by the Georgia EPD, are “triggered” by materials containing ≥ 1 percent asbestos. Though existing OSHA regulations define ACM as those materials containing ≥ 1 percent asbestos, the regulations also apply to all materials identified to contain asbestos, no matter how minute the quantity, (i.e., < 1 percent).
Wallboard and Joint Compound. Existing EPA regulations address wallboard and joint compound as a composite system, and allow composite sampling to determine the asbestos content of the combined wall system. However, OSHA does not allow composite sampling of wallboard and joint compound; Rather, OSHA’s asbestos regulations require individual sampling of each wall system component. While existing NESHAPs regulatory requirements for notification and disposal do not apply for composite wallboard systems containing < 1 percent asbestos, OSHA’s Asbestos Construction Industry Standard (49CFR5816.5801) does apply. OSHA’s regulatory requirements include but are not limited to worker training; engineering controls and work practices, communication of hazards, and waste disposal do apply to wallboard systems with any identified asbestos content.
Limitations. Suspect materials previously concealed which are uncovered by the demolition efforts (such as Transite panels, cement asbestos flues, pipe insulation, etc.) should be assumed to contain asbestos or properly sampled by an AHERA-accredited Asbestos Inspector to verify otherwise. Provide, as necessary, appropriate notifications or amendments to prior GA EPD notification regarding the increase in asbestos-containing material.
Pre-Demolition Report Demolition Requirements

As the construction schedule is critical for these project/parcel, the Contractor must begin work as soon as the Performance and Payment Bond is provided to GDOT contract officer. If the work on a specific project has not commenced within two (2) weeks providing the Performance and Payment Bond and the State Property Manager deems that the work remaining cannot be completed by the completion date as established for that project, the Department may terminate the contract.
Any citation given to the Contractor by the GA EPD or the US EPA shall be forwarded to the State Property Manager.
The Department may terminate the contract for the Contractor based on the severity or frequency of citations or non-performance and may remove the Contractor from the pre-qualified Contractors list for a period of one year.
The state of Georgia may cancel, terminate, or suspend the contract in whole or in part wherein it is determined by the state that the Contractor is in violation of the contract.
Items remaining inside the structure, ranging from trash/debris to inventory to building materials to furnishings, are considered abandoned and shall be removed under this contract.
Asbestos Inspection Reports and/or PM-10A Reports, for each parcel, are attached with detailed Scope of Work and is a part of Exhibit I.
I hereby agree to all the above provisions and respectfully submit the bids as indicated in Exhibit “III”- Bid Form for such demolition of improvements, structures, or other encumbrances in the right of way and/or easement areas of the Project.
I further agree to accept all of the above units for which I am the successful bidder, and agree to remove the above in the manner heretofore prescribed within the thirty (30) days required. I further agree to a continuance of this contract until such time as the Department accepts same not to exceed thirty (30) days from the Notice to Proceed.
In the event that I am unable to fulfill any or all of the conditions of this contract, I understand and agree that any and all monies on deposit with the Department relative to this contract are subject to forfeiture by the Department as liquidated damages and that a penalty of $500.00 will be imposed for each day beyond the thirty (30) day limit on this project. Further, such unsatisfactory performance shall vest title to all improvements upon which deposits forfeited in said Department.
Further, I understand and agree to the forfeiture of any and all deposits in the event that I am unable to deliver the required bonding or insurance certificates to the Department within five (5) business days of notice to proceed.
