Sealed Bids will be received by the City of Winter Haven until 2:00 P.M., JUNE 24, 2025, at our online solicitation platform for the following:

“Fire Station #2 Hardening – Community Development Block Grant Project”

The Invitation To Bid, Terms and Conditions, and any other Contract documents prepared for this bid, and any addenda issued during the bidding period, are a part of this Proposal and Bid Form.

ARTICLE 2

The Bidder declares that he makes this proposal in good faith without collusion and without connection with any other person or persons bidding on this project.

Contractor must start within 20 days after receipt of Notice to proceed and project must be completed within 120 calendar days after receipt of Notice to Proceed.

The Bidder declares he has examined the bid documents, visited the site of this project, and fully acquainted himself with all conditions which may affect completion of this project.

ARTICLE 3

The Bidder includes with the Proposal and Bid Form a certified check, a cashier's check, U.S. government bond (at par value), or a bid bond payable to the City of Winter Haven in an amount not less than five percent (5%) of the base bid (if bid amount is $100,000 or more).

ARTICLE 4

The contractor agrees to pay liquidated damages of $5,000 / calendar day for every day past the 120 calendar days substantial completion time that the project remains uncompleted. No additional time will be allotted for work stoppages not caused by a natural disaster or approved by the City of Winter Haven.

City of Winter Haven Fire Station #2 Infrastructure Hardening / Community Development Block Grant Project

Project Description and Information

The City of Winter Haven has secured Infrastructure Hardening funds through a Florida Commerce grant agreement. This funding will be used to construct improvements to Winter Haven Fire Station #2 in order to increase weather resiliency to the fire station and provide a safer and more consistent service to the community. A full task list is described below. These types of projects allow for the improvements to critical infrastructure that benefit from the improvements, identified by Florida Commerce. This facility has completed its required Environmental Review for this project.

Project Location

The project location incorporating hardening improvements is 4700 Lucerne Park Road, located on the north side of Lucerne Park Rd across from Lake Fannie. While there are specific design plans for this project, they may not preclude additional work to tie-in the project with adjacent or nearby public/private parcels or rights of way. Any additional work not included in the plans may be contingent on acceptance of change order agreements.

Due to grant deadlines, the project must achieve completion 120 days from the issuance of the notice to proceed and will have liquidated damages of $5,000 per day that may go into effect after that date. The project must then have all punch list items completed within 30 days after substantial completion has been achieved. The project must demonstrate successful fulfillment of all work during an inspection by City staff to be considered complete.

Project Scope and Tasks

1. Bidders to visit site and become familiar with existing conditions prior to submitting bids.

2. Task 2 - Remove and dispose of existing shingle roof and replace with a standing seam metal roof.

Basis of design is 24 ga., 16" Berridge Zee Lock Double Lock l - panel with two grooves. Florida product approval fl# 19999.4.

3. Task 3 - Remove and dispose of existing wood roof deck and replace with a steel roof deck, install updated hurricane truss strapping anchors, deck anchorage and truss reinforcement. Provide new equipment curbs as required, typical. See structural and mechanical.

4. Task 4 - Install hurricane strap-downs for rooftop equipment and anchoring for roof mounted hvac fans and intakes. Provide new curbs as required, typical. See mechanical.

5. Task 5 - Secure gutters, downspouts, fascias and soffits.

6. Task 6 - Provide tie downs and hail guards for condensers and raise cu's above the floodplain elevation.

7. Task 7 - Install class iv wind speed rated parking canopy tied into existing building. Designed by product delegated structural engineer.

8. Task 8 - Remove and dispose of 12 existing windows and replace with 12 like-sized large-missle impact rated windows. See specifications.

9. Task 9 – Remove and dispose of 4 overhead sectional bay doors and replace with 4 like-sized overhead coiling hurricane impact rated doors. See specifications.

10. Task 10 – Remove and dispose of 5 wall louvers and replace with 5 like-sized storm rated air movement and control association (amca) 550 wall louvers.

11. Task 11 - Remove and dispose of existing diesel generator and install one 120 kw generator with 550 gal diesel belly tank with hardened enclosure, mounted on concrete pad with automatic transfer switch and ancillary equipment as necessary to furnish a complete backup emergency electrical system. See electrical.

12. Task 12 - Install surge protection system on all electrical panel boards to comply with current code.

See electrical.

13. Task 13 - Install lightning protection system. See electrical.

14. Task 14 - Remove existing ceiling insulation and replace with r-30 open cell spray foam insulation.

Reuse ceiling tiles and grid if not damaged during removal and installation of spray foam. Replace any damaged ceiling grid or ceiling tiles.

15. Task 15 – Remove and dispose of all hid, fluorescent and incandescent lighting fixtures and replace with like number led lighting fixtures, see electrical.

16. Task 16 - Align ground soil and install drains to disperse water from around building and prevent erosion. See civil.

Contractors must bid on the entire project, but are encouraged to provide pricing for each individual project site as outlined on the Proposal and Bid Form. Award of the contract will go to a single contractor. The City will have the right to inspect and approve or reject all materials, workmanship, and products related to this project.

Contractor Qualifications

Bidders should show evidence of experience and qualification in CDBG construction projects of a similar or greater scope, size and nature. Bidders must be able to comply with all CDBG reporting requirements.

Refer to Article 5 of the Proposal and Bid Form to demonstrate this work history, which shall be inclusive of the primary and all subcontractors.

A minimum of three (3) projects completed within the past five (5) years should be submitted with this bid demonstrating previous experience. The bid will be awarded based on a combination of price and previous construction project experience. Individual line items may be dropped from the project at the City's discretion. All Owners/Project Managers should be listed in the bid form document.

Any bidder who does not submit the minimum evidence of construction projects and listing of Owner/Project Managers may be disqualified. City of Winter Haven Contractor Evaluation Forms and/or negative references may be the basis for a decision by the City to either reject a bid or not award a bid as determined by the City in its best interests.

Working Hours: All work requiring inspection will need to be completed during ordinary City business hours (Monday-Friday between 7a.m. and 5 p.m., excluding holidays).

Grant Required Provisions

Contracting with small and minority businesses, women’s business enterprises, and labor surplus area firms. Winter Haven will take all necessary affirmative steps to assure that minority businesses, women’s business enterprises and labor surplus area firms are used when possible [§200.321(a)].

Procurement of Recovered Materials. Contractors must comply with Section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act. The requirements of Section 6002 include procuring only items designated in guidelines of the Environmental Protection Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceeded $10,000; procuring solid waste management services in a manner that maximizes energy and resource recovery; and establishing an affirmative procurement program for procurement of recovered materials identified in the EPA guidelines. [§200.323]

Federal Award Records. Contractors must provide the City of Winter Haven, pass-thru entity, Federal awarding agency, Comptroller General of the United States, or any duly authorized representatives right of access to any books, documents, papers, or records which are directly pertinent to the project for the purpose of making audits, examinations, excerpts, and transcriptions. Records must be maintained for six (6) years after the Grantee formally closes out each program.

Bonding Requirement. A Bid Bond is required to be submitted with all construction bids in excess of $100,000. Unsuccessful bidders will be entitled to return of surety. A successful bidder may forfeit any surety required upon failure on their part to enter into a contract within the specified time after the award.

A Public Construction or Performance and Payment Bond will be required on all construction contracts when the price will exceed $100,000.

Before commencing the work or recommencing the work after a default or abandonment, the contractor shall comply with all applicable requirements of Florida law.

Bonds may be required on bids other than construction at the option of the Procurement Manager, City Manager, or City Commission. Bonds must be acceptable to the City.

Contract Provisions for Non Federal Entity Contracts under Federal Award

All contracts made/entered into by City of Winter Haven under Federal award must contain the following provisions per 2 CFR 200, Appendix II as well as any additional provisions required by the Federal agency, Florida Commerce and City of Winter Haven. As stated previously in this document, to understand the requirements fully, please review the provisions of Appendix II to Part 200 in the Code of Federal Regulations.

1. Appendix II to Part 200(A) Remedies: Contracts for more than the Simplified Acquisition Threshold ($250,000) must address administrative, contractual, or legal remedies in instances where contractors violate or breach contract terms and provide for such sanctions and penalties as appropriate.

2. Appendix II to Part 200(B) Termination for Cause & Convenience: Contracts more than $10,000 must address termination for cause and for convenience by the non-Federal entity including how it will be affected and the basis for settlement.

3. Appendix II to Part 200(C) Equal Opportunity & Non-Discrimination: Contracts that meet the definition of “federally assisted construction contract” must include the equal employment opportunity clause provided under 41 CFR §60-1.4(b). (A copy of the clause is hyperlinked for reference purposes. See comment for definition of "Federally assisted construction contract.")

4. Appendix II to Part 200(D) Davis-Bacon Act (1): Construction contracts for more than $2,000 must include a provision for compliance with the Davis-Bacon Act (40 U.S.C. §§ 3141-4144 and 3146-3148); specifically that: (1) Contractors must be required to pay wages to laborers and mechanics at a rate not less than the prevailing wages; and (2) Contractors must be required to pay wages not less than once a week.

5. Appendix II to Part 200(D) Davis-Bacon Act (2): Sub-Recipients must include a copy of the current prevailing wage determination in each solicitation for construction services in excess of $2,000, and the decision to award a contractor subcontract must be conditioned upon the acceptance of the wage determination.

6. Appendix II to Part 200(D) Davis-Bacon Act (3): Construction contracts for more than $2,000 must include a provision for compliance with the Copeland “Anti-Kickback” Act (40 U.S.C. §3145), which provides that each Contractor or sub recipient must be prohibited from inducing, by any means, any person employed in the construction, completion, or repair of public work, to give up any part of the compensation to which he or she is otherwise entitled. See attachments for a copy of the current prevailing wage determination issued by the Department of Labor.

7. Appendix II to Part 200(E) Contract Work Hours and Safety Standards Act (40 U.S.C.

3701–3708). Where applicable, all contracts awarded by the non-Federal entity in excess of $100,000 that involve the employment of mechanics or laborers must include a provision for compliance with 40 U.S.C. 3702 and 3704, as supplemented by Department of Labor regulations (29 CFR Part 5).

i. Under 40 U.S.C. 3702 of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week.

ii. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.

8. Appendix II to Part 200(F) Rights to Inventions: Contracts entered into with a small business firm or nonprofit organization and the Federal award meets the definition of “funding agreement”, must comply with the requirements of 37 CFR §401, Rights to Inventions made by Non-Profit Organizations and Small Business Firms under Government Grants, Contracts, and Cooperative Agreements. (See comment for definition of Funding Agreement.)

9. Appendix II to Part 200(G) Clear Air Act & Federal Water Pollution Control Act:

Contracts and subcontracts of amounts in excess of $150,000 must contain a provision that requires the non-Federal award to comply with the Clean Air Act (42 U.S.C. §7401- 7671q.) and the Federal Water Pollution Control Act (33 U.S.C. §1251-1387).

10. Appendix II to Part 200(H) Debarment & Suspension: Sub-Recipients must comply with CDBG regulations regarding debarred or suspended entities, specifically including 24 C.F.R. §570.609. Contracts must not be awarded to parties listed on the government wide exclusions in the System for Award Management (SAM). (Note: Contractors not registered with SAM.gov can still be debarred.)

11. Appendix II to Part 200(I) Byrd Anti-Lobbying: Contractors that apply or bid for any awards must file the required certification affirming their compliance with the Byrd Anti- Lobbying Amendment (31 U.S.C. §1352).

12. Green Building Standards: Construction contracts or agreements must contain language that requires the contractor to meet the Green Building Standard for Replacement and New Construction of Residential Housing, as defined in the Allocation Notice published in the Federal Register on November 21, 2016 (81 FR 83254-83275).

13. Section 3: Contracts subject to the requirements of Section 3 of the Housing and Urban Development (HUD) Act of 1968, as amended (12 U.S.C. §1701u), must include "the Section 3 clause" pursuant to 24 CFR Part 75. The purpose of Section 3 is to ensure that employment and other economic opportunities generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent with existing Federal, State and local laws and regulations, be directed to low- and very low-income persons, particularly those who are recipients of government assistance for housing, and to business concerns which provide economic opportunities to low- and very low-income persons.

14. Employment Eligibility Verification: Executive Order 11-116, signed May 27, 2011, by the Governor of Florida requires contractors, subcontractors, and consultants performing work or services pursuant to the CDBG-MIT sub recipient agreement use the E-Verify system to verify the employment eligibility of all new employees hired by the contractors, subcontractors, and consultants during the term of the contract.

Section 3 of the Housing and Urban Development Act of 1968 Clause and Provisions

1. Compliance in the Provision of Training, Employment and Business Opportunities

A. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing.

B. The parties to this contract agree to comply with HUD's regulations in 24 CFR Part 75, which implement section 3. As evidenced by their execution of this contract, the parties to this contract certify that they are under no contractual or other impediment that would prevent them from complying with the Part 75 regulations.

C. The contractor agrees to send to each labor organization or representative of workers with which the contractor has a collective bargaining agreement or other understanding, if any, a notice advising the labor organization or workers' representative of the contractor's commitments under this section 3 clause and will post copies of the notice in conspicuous places at the work site where both employees and applicants for training and employment positions can see the notice. The notice shall describe the section 3 preference, shall set forth minimum number and job titles subject to hire, availability of apprenticeship and training positions, the qualifications for each; and the name and location of the person(s) taking applications for each of the positions; and the anticipated date the work shall begin.

D. The contractor agrees to include this Section 3 clause in every subcontract subject to compliance with regulations in 24 CFR part 75, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or in this Section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 75. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 75.

E. The contractor will certify that any vacant employment positions, including training positions, that are filled (1) after the contractor is selected but before the contract is executed, and (2) with persons other than those to whom the regulations of 24 CFR part 7 5 require employment opportunities to be directed, were not filled to circumvent the contractor's obligations under 24 CFR part 75.

F. Noncompliance with HUD's regulations in 24 CFR part 75 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts.

G. With respect to work performed in connection with Section 3 covered Indian housing assistance, section 7(b) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450e) also applies to the work to be performed under this contract. Section 7(b) requires that to the greatest extent feasible

H. Preference and opportunities for training and employment shall be given to Indians, and (ii) preference in the award of contracts and subcontracts shall be given to Indian organizations and Indian-owned Economic Enterprises. Parties to this contract that are subject to the provisions of section 3 and section 7(b) agree to comply with section 3 to the maximum extent feasible, but not in derogation of compliance with section 7(b).

2. Training, Employment and Contracting Opportunities for Business and Lower Income Persons

A. The project assisted under this CDBG-MIT Grant is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 70U. Section 3 requires that to the greatest extent feasible opportunities for training and employment be given to lower income residents of the project area and contracts for work in connection with the project be awarded to business concerns which are located in or owned in substantial part by persons residing in the area of the project.

B. Notwithstanding any other provision of this CDBG-MIT Grant, Florida Commerce shall carry out the provisions of said Section 3 and the regulations issued pursuant thereto by the Secretary set forth in 24 CFR Part 75 (published in 38 Federal Register 29220, October 23, 1973), and all applicable rules and orders of the Secretary issued there under prior to the execution of this CDBG-MIT Grant.

The requirements of said regulations include but are not limited to development and implementation of an affirmative action plan for utilizing business concerns located within or owned in substantial part by persons residing in the area of the project; the making of a good faith effort, as defined by the regulation, to provide training, employment and business opportunities required by Section 3; and incorporation of the “Section 3 Clause” specified by Section 75.27 of the regulations in all contracts for work in connection with the project. Florida Commerce certifies and agrees that it is under no contractual or other disability which would prevent it from complying with these requirements.

C. Compliance with the provision of Section 3, the regulations set forth in 24 CFR Part 75, and all applicable rules and orders of the Secretary issued thereunder prior to approval by the City of the application for this CDBG-MIT Grant, shall be a condition of the Federal financial assistance provided to the project, binding upon the Florida Commerce, its successors and assigns. Failure to fulfill these requirements shall subject the Florida Commerce, its contractors and City of Winter Haven, subcontractors, its successors, and assigns to the sanctions specified by the Florida Commerce Hardening Grant Agreement, and to such sanctions as are specified by 24 CFR Section 75.

Bid Submissions

Submittals must be received on the City’s e-procurement platform no later than the time and date specified for submission in the bid. No bid shall be accepted after the specified deadline or at any location other than specified in the bid. Bids shall be opened at the time and place stated in the public notices.

The Procurement Manager may elect to cancel or postpone a bid at any time prior to the time and date set to open bids.

Sealed bids, proposals, or replies received by the City pursuant to an ITB are exempt from disclosure under s.119.07(1) and s.24(a), Art. I of the State Constitution until such time as the City provides notice of an intended decision or until 30 days after opening the bids, proposals, or final replies, whichever is earlier.

If the City rejects all bids, proposals, or replies submitted in response to an ITB and the City concurrently provides notice of its intent to reissue the bid, the rejected bids, proposals, or replies remain exempt from disclosure under s. 119.07(1) and s. 24(a), Art.
