About this file
The document provided is a Questions and Answers (Q&A) document related to Invitation to Bid (ITB) No. DOT-ITB-24-1332-JC for the D1- US 41 Automated Traffic Signal Performance Measures (ATSPM) Upgrades project in Polk County, Florida. The project involves the installation of ATSPM equipment and associated work. The bid items and quantities listed in Exhibit C differ from those in Exhibit A Table 3, but an addendum will be issued to modify Exhibit C to include pricing for all items. The contract duration is 24 months from execution, which includes material acquisition, mobilization, construction, testing, and closeout, despite the 105-calendar day active construction duration noted in Exhibit A. A bid bond is not required for this solicitation.
Regarding pricing, the Department has decided to remove the asterisks indicating "incidental" items in Exhibit A Table 3, so contractors must provide unit prices for all bid items in Exhibit C. This change is intended to reduce risk for bidders. The solicitation does not mention any set-asides, incumbent contractors, or specific funding sources.

Quesfions and Answers
1.) Exhibit C contains the bid items with quanfifies on which we are to submit pricing for. Then in Exhibit A, there is Table 3: Pay Item summary with another list of pay items and quanfifies. This table does idenfify certain pay items with an asterisk, and denotes that those “items are considered incidental and will not be paid for separately”.
Are we to assume all work required to complete the asterisk items will definitely be performed?
Response: An addendum will be issued to modify Exhibit “C” to include bid unit prices for all items previously marked with an asterisk. Also, the asterisks shown in Table 3 of Exhibit A have been removed.
If so, the please confirm the contractor is to include the costs to perform that work in our bid for the items in Exhibit C?
Response: An addendum will be issued to modify Exhibit “C” to include bid unit prices for all items previously marked with an asterisk. Also, the asterisks shown in Table 3 of Exhibit A have been removed.
2.) In Exhibit “A”, page A-3 & A4, in Table 3 there is a list of pay items that describe the work to completed. Several of the pay items have a “*” next to them, which means that those pay items are “considered incidental and will not be paid for separately”. Will the Department consider not making any of the pay items “incidental”? This method of payment creates a huge amount of risk for the contractors that decide to submit a bid for this project. For example, Table 3 indicates that Mobilizafion, Maintenance of Traffic, Temporary Signalizafion and Maintenance, Temporary Traffic Detecfion and Maintenance, and both ITSFM pay items are all “incidental” (as well as other items). Let’s assume that the contractor elects to include the cost for these items in the other pay items, and then after the award the Department decides to eliminate or reduce some of the scope, which will reduce the quanfifies. Now the contractor will not be paid some of the cost for the incidental work, but will sfill have to perform the incidental work. Will the Department consider paying for all required pay items or just make the contract a lump sum contract, based on the provided plans?
Response: An addendum will be issued to modify Exhibit “C” to include bid unit prices for all items previously marked with an asterisk. Also, the asterisks shown in Table 3 of Exhibit A have been removed.
3.) In the Introducfion Secfion of the ITB, Paragraph 1 Invitafion states that “It is anficipated that the term of the contract will begin on the date of the contract execufion and be effecfive for 24 months thereafter.”
Then on Page A-2 of the Exhibit A, under General Requirements paragraph b. states that
“Length of Contract: Work performance durafion is a maximum of 105 calendar days. This includes acfive work only (at the fime the Vendor starts work) and tesfing, and not material acquisifion/procurement and fabricafion.”
This seems like a conflict.
Please clarify the contract durafion.
Response: The Contract duration of 24 months noted in the Introduction Section-Invitation is the duration of the contract from execution to completion and includes all effort associated with the contract including material acquisition, mobilization, active construction, testing, and project closeout. The duration noted in Exhibit A-Section III- General Requirements is the active construction duration at the intersections listed inclusive of testing.
4.) The Bid Form known as Exhibit “C” Bid Sheet, shows a number of 15 Items with Quantities that need the Unit Price filled in – But then on Page A-3 of the ITB “Table 3 Pay Item Summary”, the items and quantities are different but indicates the items listed on the Signal Plans.
Question: Is the Bidder supposed to only provide the Unit Prices listed on Exhibit C?
Response: An addendum will be issued to modify Exhibit “C” to include bid unit prices for all items previously marked with an asterisk. Also, the asterisks shown in Table 3 of Exhibit A have been removed.
5.) Is a bid bond required with the bid submiftal?
Response: A bid bond is not required for this advertisement.
