| The State of Idaho requires the successful Bidder to deliver the specified Work Zone Safety Trucks within 365 days ARO (after receipt of order) to the delivery location. If the Contractor cannot meet the agreed-upon timeline, the Contractor must, upon written mutual agreement with ITD, develop a revised delivery solution that aligns with the State’s best interests. |
1.7 Questions

All questions, requests for clarification, or other correspondence must be uploaded into the Q&A Forum section within IPRO. See Exhibit 6 for additional instructions. Questions must be submitted using the table provided within Exhibit 6.
1.8 Modifications and Exceptions to Requirements, Terms, and Conditions
1.8.1. Vendors are strongly encouraged to submit any proposed modifications to the requirements, terms, or conditions of the ITB on Exhibit 7 – Contract Modifications and Exceptions prior to the deadline to submit questions. Questions regarding these requirements must contain the following:
1.8.1.1. The rationale for the specific requirement being unacceptable to the party submitting the question (define the deficiency).
1.8.1.2. Recommended verbiage for the State’s consideration that is consistent in content, context, and form with the State’s requirement that is being questioned.
1.8.1.3. Explanation of how the State’s acceptance of the recommended verbiage is fair and equitable to both the State and to the party submitting the question.
1.8.2. In the event that a Bid contains modifications or exceptions to any Solicitation requirements, terms, or conditions which are not addressed during the question and answer period, they must be identified and submitted on Exhibit 7 - Modification and Exception Form and must contain the same information outlined in Section 1.8, above. The State will not consider any modifications or exceptions that are not identified specifically on Exhibit 7.
1.8.3. The State has sole discretion to determine if the modifications or exceptions submitted by a Bidder would result in a material change or otherwise threaten the integrity of the procurement process. See Idaho Terms and Conditions Background and Limitations. Pursuant to IDAPA 38.05.01.084.e, the State may only negotiate non-material modifications or exceptions. Modifications or exceptions which the State determines to be material, or which otherwise threaten the integrity of the procurement process, will not be accepted or negotiated. If the Bidder has conditioned its Bid on the State’s acceptance or negotiation of its proposed modifications or exceptions, and the modifications or exceptions are deemed material, the Bidder will be given the opportunity to retract the proposed modifications or exceptions from its Bid. Failure to do so will result in the Bidder’s Bid being found non-responsive, after which it will receive no further consideration.
1.8.4. Non-material modifications or exceptions may be discussed with the apparent successful Bidder, at the discretion of the State; however, the State shall have the right to reject any and all such modifications and/or exceptions, or to call an end to such discussions, and to instruct the Bidder to amend its Bid and remove the modifications and/or exceptions. Failure to do so may result in the State finding the Bid non-responsive.
1.8.5. Except as otherwise provided within the Solicitation, the State will not consider modifications or exceptions to the requirements, terms, or conditions which are proposed after the ITB Closing Date.
1.9 Amendments
The State may issue amendments to make changes to the ITB, or to respond to any questions. Amendments will be posted on IPRO. Bidders are responsible for monitoring IPRO for updates and amendments. All published amendments must become part of this ITB, and must be considered by the Bidder in its Bid. Oral interpretations or clarifications of this ITB are not binding and should not be relied upon. Any verbal responses provided by the State during the pre-Bid conference are considered unofficial, and will not be binding.

The Contract will incorporate the Terms and Conditions, General Requirements, Specifications, Insurance Requirements, and any additional documents from the solicitation.

2. Background Information ITD is responsible for managing the State’s transportation infrastructure. This includes the planning, construction, and maintenance of highways and transportation facilities. Work Zone Safety Trucks are critical to ITD’s ability to progress and complete projects taking place on public roadways and ITD property.
3. Summary of Specifications ITD, through the Idaho Division of Purchasing (DOP), is requesting Bids from Vendors for the purchase and delivery of Work Zone Safety Trucks (Trucks), in accordance with the specifications and requirements outlined in this ITB. EXHIBIT 2
General Requirements
The following provisions establish the contractual performance requirements applicable to the resulting contract. These requirements are mandatory and will be incorporated into the contract upon award. Bidders should carefully review each provision and ensure their bid reflects the ability to comply.
Note: In the event of conflict with the State's Standard Terms and Conditions, or other terms, conditions or requirements contained in this ITB, the following provisions will take precedence. In the event of conflict between the installation standards in Exhibit 3 and the component manufacturer's installation instructions, the more stringent requirement applies unless the Exhibit 3 requirement would void the manufacturer's warranty, in which case the manufacturer's requirement governs and the Contractor must notify ITD in writing at or before the kickoff meeting.
1. Installation & Acceptance
1.1 In the event that any specifications are not met, the Contractor must pick up, correct any discrepancies, and re-deliver within thirty (30) calendar days after written notification from ITD, at no additional cost to ITD. ITD will accept a video review via Teams.
1.2 If approved by ITD, the Contractor may correct discrepancies on-site at ITD’s location in lieu of a pick-up and return process.
1.3 The Contractor must be responsible for providing all labor, tools, parts, supplies, and worksite clean up to make any necessary corrections on-site. The timeframe for corrective action will be thirty (30) calendar days.
2. Warranty, Service & Support, Maintenance, etc.

2.2 Truck Chassis Drivetrain warranty must be five (5) years or sixty thousand (60,000) miles, whichever occurs first.
2.3 Each warranty must include all travel, parts, labor, and freight to replace a defective warranted item. All warranty work must be completed within thirty (30) calendar days after receipt of notice from ITD.
2.4 If any warranty work is to be performed, the Contractor may elect to authorize a dealer of its choice or authorize ITD to perform the necessary repairs in accordance with the manufacturer’s standards. If the Contractor authorizes ITD to perform any warranty work, it is the responsibility of the Contractor to guarantee that the work is completed in accordance with the manufacturer’s standards at the expense of the Contractor. Completion of warranty repairs by ITD which are authorized by the Contractor will not adversely affect the warranty.
2.5 The Contractor will be allowed to operate ITD’s Truck on public right of ways when performing warranty repairs to validate the warranty issue has been addressed.
2.6 Warranty must commence when completed Equipment is placed into service. “In-Service” date is defined as the date the completed Truck passes final delivery inspection with all Equipment installed and operational.
