About this file
This document is an Exemption from Competition (EFC) request form submitted by the Idaho State Police (ISP) to the Idaho Division of Purchasing (DOP) for the procurement of maintenance agreements for forensic laboratory equipment. The ISP, represented by requestor Olivia Sorenson, is seeking exemption from competitive bidding to procure one-year maintenance services for 15 specialized forensic instruments through the proposed supplier REMI. The requested exemption falls under the category of "Exemption from Competition" based on IDAPA 38.05.01.042.05, which allows exemptions when bidding is determined to be impractical, unreasonable, or disadvantageous. The form was submitted to DOP on July 10, 2026, with DOP Administrator approval indicated as pending on July 14, 2026, and the request was to be posted for public review prior to final approval.
The anticipated total cost for the one-year maintenance agreement is $191,440.71. The ISP's justification for the exemption centers on REMI's unique capability to consolidate maintenance agreements for all 15 laboratory instruments into a single contract while coordinating with OEM-authorized service providers, thereby reducing administrative burden and achieving lower overall costs compared to managing 15 separate contracts with individual manufacturers. Although the ISP acknowledges that competition exists for maintenance services on individual instruments through respective OEMs and authorized service providers, the agency asserts that REMI is the only known vendor capable of providing comprehensive consolidated maintenance coverage with unified contract administration, maintenance tracking, and invoicing. The exemption is limited to one year to allow the agency time to reassess procurement options while maintaining uninterrupted laboratory operations.

Type of Exemption*
A solicitation has been completed and my Agency wishes to award contracts to multiple vendors for the same or smilar property (Multiple Award Authorization)
My Agency wishes to administer or award a solicitation at a dollar amount above its normal Delegated Purchasing Authority (Limited/One-Time DPA)
The property required is available on one or more open contracts, but my Agency wishes to purchase from a different vendor. (Note: if total value is over $10,000, Agency must also check the box for exemption from competition if requesting to pruchase from a specific vendor). (Utilization of Open Contract).
A solicitation is being developed (by my Agency under its DPA or in conjunction with DOP) and my Agency wishes to limit responses to a specific manufacturer/brand name (I.e. no substitutions). (Note: this option assumes that multiple vendors can offer the identified brand name; otherwise, select the option for exemption from competition to request a Sole Source Authorization (Brand Name Only)
A solicitation has been completed and there is a need to negotiate with one or more vendors. (Authorization to Negotiate)
My Agency is seeking to purchase directly from an identified vendor without completing a solicitation OR wishes to perform a level of competition that is less formal than would typically be required. (Various exemptions-additional questions to follow) mailto:Olivia.Sorenson@isp.idaho.gov
Additional Questions*
There is an immediate threat to public health, safety, or welfare (Emergency Purchase Authorization)
The required property can only be procured from a single supplier (sole manufacturer and distributor) (Sole Source Authorization)
There is an existing Policy Directive on the DOP website which requires authorization to be utilized (Utilization of Policy Directive)
It would be impractical, unreasonable, or disadvantageous to complete the required competitive process under the circumstances (Exemption from Competition)
Exemption from Competition
IDAPA 38.05.01.042.05 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to:
special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Background* Describe the circumstances
The Idaho State Police Forensic Services Laboratory requires annual maintenance for 15 specialized forensic instruments critical to laboratory operations. The previous maintenance agreement expired on July 7, 2026, leaving the laboratory without active coverage. A one-year exemption is requested to maintain uninterrupted service while the agency evaluates future procurement options for these specialized maintenance agreements.
This field has a 500 character limit
Justification* Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
Although multiple vendors are capable of servicing individual instruments, Idaho State Police is not aware of another vendor capable of providing a single, consolidated maintenance agreement for all covered laboratory equipment while utilizing the OEM-authorized service providers.
REMI functions as a contract consolidator by negotiating discounted pricing with the individual service providers and passing those savings on to the State. The maintenance work continues to be performed by the same qualified OEM-authorized technicians that would perform the work under separate agreements. This arrangement has consistently resulted in lower overall pricing than contracting directly with each manufacturer or service provider individually.
The agency has obtained competitive pricing from individual vendors to verify pricing and has found that, while some vendors may offer competitive pricing on specific instruments, none have been able to provide the same overall value across the entire fleet of equipment.
Procuring individual maintenance agreements would increase overall costs, require management of approximately fifteen separate contracts, create additional administrative burden for contract administration and invoice processing, and eliminate the efficiencies realized through consolidated maintenance tracking.
Granting a one-year exemption will ensure uninterrupted maintenance coverage for mission-critical forensic laboratory equipment while allowing the agency adequate time to evaluate long-term procurement options without disrupting laboratory operations.
Description* Describe the extent to which competition is possible
Competition exists for maintenance services on individual instruments through the respective OEMs and their authorized service providers.
Idaho State Police has solicited and reviewed pricing from these vendors to ensure REMI's pricing remains competitive.
However, competition is significantly limited with respect to a single-source consolidated maintenance agreement covering all laboratory instruments. At this time, REMI is the only vendor known to the agency that offers a comprehensive maintenance agreement encompassing all covered equipment while utilizing OEM-authorized service providers and providing consolidated contract administration, maintenance tracking, and invoicing.
The agency remains willing to evaluate any vendor capable of providing equivalent consolidated services and pricing. This exemption request is https://adminrules.idaho.gov/rules/current/38/380501.pdf limited to a one-year term to maintain continuity of operations while preserving the opportunity to reassess the marketplace and encourage future competition if comparable alternatives become available.
