About this file

This is a Questions and Answers document from an Industry Day held on December 2, 2024 for the Immigration and Customs Enforcement (ICE) Intensive Supervision Appearance Program (ISAP) V procurement. The document contains clarifications about the future contract requirements, including that ICE is open to considering splitting the contract into separate components for case management and data monitoring, as well as potentially regionalizing services. The current vendor has been the sole provider for 20 years.

Key details include: participants who lack compatible smartphones are temporarily provided limited-function mobile devices for biometric monitoring; staffing ratios at C-sites require at least one PM, two Case Specialists and an administrative assistant, with additional Case Specialists required when the 30-day moving average exceeds 250 participants; GPS monitoring is done through body-worn devices (ankle/wrist) and biometric applications; language support must be provided in participants' preferred languages; and all vendor staff require ICE Personnel Security Unit clearance. The document indicates that if proposed legislation passes requiring all non-detained individuals to enroll in ATD monitoring, the program population would expand significantly. The government emphasizes that all information provided is tentative and subject to change.

ISAP-V Industry Day Questions and Answers (December 2, 2024) All information provided in government responses is tentative and subject to change

Question Government Response Given these services have only been provided by one vendor over the past 20 years, and ICE has helped develop the capabilities of this vendor, how will past performance be evaluated?

It has not been determined how past performance will be evaluated.

How is ICE promoting competition in this solicitation? Market research efforts such as the RFI and Industry day are aimed at increasing competition for ISAP-V.

Will ICE regionalize the scope of services to promote competition?

All feedback received from the Industry Day and RFI will be considered to include ideas to regionalize the scope of services and how any risks with that approach would be mitigated.

Please confirm if you will be sharing this presentation? The presentation was distributed via e-mail to registered participants prior to the start of the Industry Day.

How do we get the data from ICE at participant identification? Are they going to make tracking decisions/suggestions?

Information is transmitted through hard copy or technologically as computer systems communicate directly. The Government is leaning more and more heavily towards system integration and communication electronically to reduce paperwork.

What is the most significant change being contemplated with ECMS in ISAP V

No significant change is contemplated for ECMS at this time.

Can you confirm if there is going to be a voice verification component for this iteration of ISAP

The Government does not intend to place a telephonic reporting requirement but that does not prevent RFI responses from submitting it for consideration. All submissions will be considered.

Congress has introduced a bill that will require ALL non-detained docket enrollees to enroll in ATD. How would that impact population volumes in ISAP?

The ATD - ISAP population would likely expand significantly.

The previous RFI mentioned applying ISAP V (or at least case management) to the entire non-detained docket. Is that still being contemplated?

It will be considered as new direction is provided by leadership. The current RFI contains the most recent information.

Can you please clarify the case specialist percentages between sites. I.E what is the rough percentage of case specialists out of the total number across all sites that support ECMS and home visits?

SOW Section 6.0:

ERO will determine the expected capacities, technology, and levels of supervision anticipated at each geographic location. Requests for establishing new sites or adding additional capacity at existing C-Sites, G-sites, S-sites or T-sites will be initiated by the Government and conveyed to the contractor via bilateral contract modification.

For example:

The contractor shall ensure that the C-site has appropriate staffing coverage to fulfill all requirements of this contract.

i. At least one contractor available to resolve alerts, violations, and assist in enrollments at all times, including outside of standard business hours.

ii. At least one PM, two CS and an administrative assistant.

iii. C-Site staffing ratios for each site will be based on the active participant population utilizing a 30-day moving average. (i.e. if the 30 day moving average number of participants is at 251, then a third case specialist would be immediately required).

Are participants allocated government issued 'smart phones'? If so - Are resources such as EBT (food distribution) cards issued electronically?

Participants who do not have a smartphone that is capable of downloading and running the biometric application are temporarily provided a mobile device that is preloaded with the software. It is not a cell phone in the truest sense - it can connect with the biometric application, contact 911, and an extremely limited number of loaded/pre-loaded telephone numbers. The expectation is that the participant will have the mobile device until such time as they update their personal cell phones so that the biometric application can be downloaded. The government is not providing free cell phones.

Is ICE open to splitting the contract into two? (I.E. Case Management as one, and data monitoring as another?)

All feedback received from the Industry Day and RFI will be considered to include ideas to split the scope of and how any risks with that approach would be mitigated.

Is this RFI informed by the new administration's transition team and overall objectives? How might things change in the new administration?

The current RFI was prepared well in advance of the election and the development of a transition team.

What is the language support design for the program? The vendor that wins ATD - ISAP V will be required to be able to communicate with any noncitizen that is assigned to the program in a language they are comfortable with, typically, their first language. This requirement extends to written materials as appropriate (such as documents for signature and the biometric application that requires participation).

What controls are in place that the body worn GPS device assigned to a participant is not lost or transferred to another individual?

The vendor is expected to provide information about their intended devices as part of their proposal and it is suggested that they list safeguards for their devices.

In the Homeland Security Appropriations Bill for the fiscal year ended September 30, 2025, prepared by the House Appropriations Committee, the following mandate was included:

“ensure that every alien on the non-detained docket is enrolled into the Alternatives to Detention Program with mandatory GPS monitoring throughout the duration of all applicable immigration proceedings (including any appeals) and until removal, if ordered removed.” (§228) What kind of existing technology counts as "GPS monitoring"?

Currently the government is able to acquire GPS coordinates through the body worn (ankle and wrist) devices and in a limited fashion from the biometric application.

If the ISAP V looks a lot like ISAP iV can we assume that to avoid complexity the government would prefer a single contractor?

The government will consider all RFI responses and is open to all ideas presented.

You mentioned an example where body worn GPS was utilized when a participant was repeatedly non-compliant with biometric check-in. What factors go into determining if a leg worn vs. wrist worn GPS monitor is utilized? Can you speak to the criteria on GPS device selection more broadly given the recent increase in wrist worn tracking?

A trained ATD - ISAP officer (Federal employee) takes into account numerous factors when determining the most appropriate levels of case management and technology assignment. Some factors include, but are not limited to: current immigration status, supervision history, pending criminal charges, convictions, being a caregiver/provider, community ties, medical/humanitarian needs, etc. There is no singular factor that determines the most appropriate levels of whether or not to increase, decrease, or remain the same. Officers exercise discretion based upon a totality of circumstances.

With regards to ankle vs wrist-worn device, there is not specific guidance indicating which should be used in what circumstances. There are more ankle worn devices but that is not indicative of a requirement for them but it must be considered that wrist-worn devices are the newer form of technology and are being incorporated for use.

Is this industry day recorded and can it be shared? The industry day presentation was not recorded. You may submit written questions in accordance with the RFI instructions.

In the Draft SOW and attachments, specifically in the historical data, columns are defined as OV1, OV2, OV4, OV8, OV 12 - what does OV mean? Additionally can you define

HV?

OV = Office visit. HV = Home visit. The corresponding number is 1 = weekly; 2 = bi-weekly; 4 = monthly/every four weeks; 8 = bi-monthly/every 8 weeks; 12 = quarterly/every twelve weeks.

Are there any security clearance requirements, Secret, Top Secret etc. as part of the program?

Any vendor who will work with participants or have access to PII/SPII must have clearance through ICE Personnel Security Unit (PSU).

Additionally for the S sites, there are acronyms such as RGV EPC Consuelo, and ERO ISAP RGV DAL Dallas. Does this mean that they are in transit from RGV to Dallas? Or is there a S-site in Dallas.

RGV = Rio Grande Valley. The government uses 3-letter designators for locations.

Typically, the site-type variable will be added, such as C, G, S, T, or M. The S-site is for any participant who is transiting from one location to another and is not designated to just the southwest border (SWB). While most S-site enrollments are from the SWB, it is possible that a participant from NYC could be transiting to Detroit and for that duration and until they report and are re-evaluated upon arrival, will be assigned to the S-site.
