About this file
This is an IRS Publication 1075 Contract Addendum for Printer Equipment issued by the State of Maine, Office of Information Technology, establishing compliance requirements for printer equipment to be provided under a purchasing agreement contract between the State of Maine and a contractor. The addendum applies specifically to printer equipment and related devices used for receiving, processing, storing, accessing, protecting, and transmitting Federal Tax Information (FTI). The contractor must warrant that all devices meet the security and protection requirements outlined in IRS Publication 1075, including managerial, operational, and technical controls. The equipment must include least functionality controls that disable unneeded network protocols and services, assign dedicated static IP addresses, and configure proper access enforcement controls for file shares, administrator privileges, and document retention functions.
The contractor is responsible for maintaining current firmware and ensuring all Publication 1075 security features are configured and activated to protect against unauthorized access to FTI. In the event the IRS identifies deficiencies during an audit of the State, the contractor must remediate findings according to specified timeframes: critical findings within three months, significant findings within six months, moderate findings within nine months, and limited findings within twelve months following the IRS's on-site audit closing date. The State reserves the right to terminate the lease agreement and seek reimbursement of unused fees in the event of a breach of the addendum terms, along with any available equitable relief including injunctive relief and specific performance.

The Contractor agrees that any Publication 1075 deficiencies identified by the IRS associated with these devices during an IRS audit of the State will be swiftly remediated by the Contractor to the satisfaction of the State in accordance with the following IRS audit timeframes:

2. For significant IRS audit findings, the Contractor will have up to six months to remediate the findings after the closing date;
3. For moderate IRS audit findings, the Contractor will have up to nine months to remediate the findings after the closing date; and
4. For limited IRS audit findings, the Contractor will have up to twelve months to remediate the findings after the closing date.
In the event of a breach of the terms of this Addendum, the State, in addition to any other remedies at law or in equity it may have, will be entitled to terminate the lease agreement with the Contractor and seek reimbursement of any unused portion of fees associated with the lease agreement, as well as any equitable relief, including injunctive relief and specific performance.
