4. Statutory Authority Permitting Other Than Full and Open Competition.

This action is pursuant to 10 U.S.C. § 3204(a)(1) and 41 U.S.C. § 3304(a)(1), “An executive agency may use procedures other than competitive procedures only when […] the property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency.”

5. Rationale Justifying Use of Cited Statutory Authority.

The MCISRE InTP has a follow-on service requirement for the following one (1) In Place Monitoring Support System and one (1) Gabriel Appliance. (Six (6) month Base and Four (4) Twelve (12) month Option Periods).

The IPMS and Gabriel system is a unique tool that has been customized specifically for MCISRE InTP security hardware systems. These systems are currently in use by MCISRE InTP which allow multiple security disciplines the ability to instantly observe radio frequency energy within a secured location in a manner that allows each discipline the ability to address their individual concerns in a coordinated effort to ensure the potential threat associated with this frequency anomaly is resolved with minimum damage to the assets and resources inside of the secure location or its network devices. The system has the ability to collaborate with existing security tools to enhance the security posture of the facility by adding an additional layer to be observed by the MCISRE InTP security programs.

The systems provide the following: identify and implement technologies, including Network Behavior tools, offering counterintelligence services and cyber security services in the analytical, Briefing/Debriefing, Insider Threat, Cyber Security, Technical Surveillance Countermeasures, and Physical Security that integrate and maintain the “Gabriel” System as a part of the Insider Threat Application responsible for the Radio Frequency in the In-Place Monitoring system. This unique system provides the Insider Threat program with a clear picture of the radio frequency spectrum activity as it relates to unauthorized frequencies emanating within classified facilities.

In addition, the system allows Physical Security, Technical Security, and Insider Threat the ability to see the emanation of radio frequencies within the MCISRE InTP facility to address the threat before this unauthorized exfiltration method can be utilized to remove, add, or modify information inside a secure facility. The tool allows MCISRE InTP to assess, review and assign radio frequency signatures to any authorized individual and/or group via a network to address the anomalies before they can cause damage, copy, and/or modify the information and/or data inside the facility.

Gabriel is a Radio Frequency (RF) IPMS that is designed to alert MCISRE InTP to the use of unauthorized wireless signals in a secure classified space dedicated to discussing and processing the most valuable assets. The system will alert you to the unauthorized use of cell phones and mobile wireless devices such as tablets and laptops. Additionally, it detects the use of electronic eavesdropping technology including bugging devices that can be placed in ubiquitous and/or creative places that are unseen or detected by sight. Gabriel’s unique ability to completely cover the full RF spectrum at speeds designed to catch the burst transmissions from sophisticated eavesdropping devices. Unlike most available sensors that only monitor and/or scan specific bands or multiple specific bands, Gabriel again covers the entire spectrum.

Gabriel’s innovative monitoring capability allows non-technical users to easily set up and monitor their Secure Work Environment. All required software and hardware is included, system functionality (plug & play) is based on the open architecture Microsoft Windows “Tile Application”

Metro environment. The system allows the user to effectively monitor and be alerted when there is RF energy present in a targeted space from the introduction of a wireless device into that space.

Gabriel can alert to not only intended transmissions, but also those of the unintended nature like TEMPEST signals.

IPMS and the Gabriel System is heavily integrated in the MCISRE InTP systems and due to the software’s unique and customized features of complete asset and maintenance management, enterprise identity management and governance to fully protect the organizations security workflows.

In order to change from IPMS and Gabriel to another security service product, if that security service is able to be approved for SCINET Enterprise access, the cost, time and level of effort would be too great to transition to another product solution/tool set that may or may not meet the government’s business and technical needs as an organization Any deviation from pursuing another security service application that does not meet the unique specification, would be detrimental to MCISRE InTP’s ability to track and manage critical physical and technical surveillance countermeasures and would result in a loss of continuity of operations.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market Research was conducted by identifying Azgard Group, LLC as the only prospective vendor that has the capabilities to properly maintain the Gabriel System. The equipment for the Gabriel system was purchased on a previous contract, FA8076-19-F-A029, in the previous Fiscal Year. In addition, market research shows that there is only vendor capable to provide the hardware and software to the Gabriel system, Azgard Group, LLC. (See attached sole source letter)

7. Determination of Fair and Reasonable Cost.

The Contracting Officer will determine the anticipated price covered by this justification to be fair and reasonable by ensuring quoted pricing is consistent with or lower than pricing provided by open market pricing.

8. Actions to Remove Barriers to Future Competition.

At the moment, In Place Monitoring System (IPMS) and the “Gabriel” system subscription and maintenance is the only effective and efficient subscription source to meet MCISRE InTP requirements at this time. MCISRE InTP will continue to monitor and conduct continuous market research in an effort to identify any emerging technologies that may satisfy future requirements.

Should such technologies become available, MCISRE InTP will seek competition to the maximum extent practicable.
