About this file
This is an Intent to Sole Source Notice issued by the U.S. Bureau of Reclamation, Upper Colorado Region, Four Corners Construction Office, for services related to the Navajo-Gallup Water Supply Project (NGWSP) Cutter Lateral Water Treatment Plant (CLWTP). The sole source contractor is Jacobs Engineering, selected under FAR 6.103-1 authority due to their prior design and construction work on the CLWTP and ongoing operations, maintenance, and repair (OM&R) contract with the Navajo Tribal Utility Authority (NTUA). The procurement will follow Part 12 of the Federal Acquisition Regulations as other than full-and-open competition.
The work encompasses three principal objectives: (1) achieving Federal Information Security Management Act (FISMA) compliance by modifying the CLWTP to meet current security standards; (2) updating the communication link with NTUA's Escrito Mesa Data Concentrator to restore disrupted communications between the data concentrator and CLWTP; and (3) an option for programming and integration of the new NGWSP DZ Booster Pump Station. The CLWTP is located on government property and delivers treated water to indigenous communities on the eastern edge of the Navajo Nation and the southwest portion of the Jicarilla Apache Nation. The NAICS code is 238210 with a small business size standard of $19 million. Interested parties may submit responses to the Contracting Officer, Andrew Taylor (andrew_taylor@ios.doi.gov), for government consideration in determining whether to conduct a competitive procurement. No solicitation will be issued as a result of this notice, and no costs will be reimbursed for responses submitted.

INTENT TO SOLE SOURCE NOTICE
PURPOSE: The U.S. Bureau of Reclamation, Upper Colorado Region, Four Corners Construction Office, intends to award a sole source contract to Jacobs Engineering for a contemplated service requirement titled: Navajo-Gallup Water Supply Project (NGWSP) Cutter Lateral Water Treatment Plant (CLWTP) Federal Information Security Management Act (FISMA) Compliance.
This requirement is being procured in accordance with Part 12 of the Federal Acquisition Regulations as other than full-and-open competition under the authority of FAR 6.103-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
41 U.S.C. 3204(a)(1). Jacobs Engineering was contracted by the Bureau of Reclamation (Reclamation) for the design and construction of the CLWTP including Federal Information Security Management Act (FISMA) Compliance and the Supervisory Control and Data Acquisition (SCADA) systems. Per the FISMA, Reclamation is required to modify the CLWTP to meet current security standards.
Operations of the Cutter Lateral and initial water deliveries to Navajo communities began in October 2020. In June 2022, the Operations, Maintenance and Repair (OM&R) responsibility for the Cutter Lateral system, including the CLWTP, was transferred to the Navajo Nation and the Navajo Tribal Utility Authority (NTUA). NTUA is an enterprise of the Navajo Nation duly authorized by the Navajo Nation Council, pursuant to Navajo Nation Code Title 21 §§ 1 – 27, with jurisdiction over all utility operation, to construct and operate water supply distribution systems for water users within the Navajo Nation, including portions of the service area of the Project, and shall perform OM&R of the Transferred Works of the Project. Subsequently, NTUA contracted with Jacobs Engineering for OM&R of the CLWTP. Due to the historical situation of the project and previous work completed by Jacobs Engineering it is determined that this requirement will be satisfied as a sole source purchase through other than full-and-open competition.
REQUIREMENT DESCRIPTION: The principal components of the work are listed below:
The first objective for the CLWTP FISMA Compliance is to bring the Water Treatment Plant (WTP) to current security standards. These security standards authorize the operation of an information system or component within a specific environment, based on an acceptable level of risk. Per the FISMA, the Bureau of Reclamation (Reclamation) is required to modify the CLWTP for current security standards. The work is to provide the required support to Reclamation while accomplishing FISMA compliance.
The second objective for the CLWTP is to update the communication link with Navajo Tribal Utility Authority’s (NTUA’s) Escrito Mesa Data Concentrator which was replaced after the completion of the Cutter Lateral Water Treatment Plant project and has disrupted the communication link between that data concentrator and the CLWTP.
The third objective for the CLWTP is to include an option for the programming and integration of the new NGWSP DZ Booster Pump Station.
LOCATION OF THE WORK: The CLWTP site is located on Government property. The Cutter Lateral takes water from the San Juan River stored at the existing Cutter Reservoir (a feature constructed originally for the Navajo Indian Irrigation Project - NIIP) using transmission pipelines and pumping plants to deliver the raw water to the CLWTP for treatment and delivery to the downstream indigenous communities on the eastern edge of the Navajo Nation and the southwest portion of the Jicarilla Apache Nation.
NAICS AND SIZE STANDARD: The NAICS code for this requirement is 238210 with a small business size standard of $19 million.
COMPETITION: A determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Any solicitation resulting from the analysis of information obtained will be announced to the public on System for Award Management (SAM.GOV) in accordance with the FAR Part 5.
