The contractor must maintain comprehensive insurance coverage at its own expense, with all policies required to be primary and non-contributing to any comparable liability insurance carried by the State. Insurance providers must hold an A.M. Best rating of "A-" or better with a financial size category of VII or better. Required coverage includes Commercial General Liability Insurance with minimum limits of $1,000,000 per occurrence and $2,000,000 general aggregate, Automobile Liability Insurance at $1,000,000 per accident with hired and non-owned automobile coverage, Workers' Compensation Insurance according to applicable laws, and Employers Liability Insurance with minimum limits of $500,000 per accident and per employee by disease. The State of Michigan and its related entities must be added as additional insureds on applicable policies using specified endorsement forms.
The contractor must provide insurance certificates to the Contract Administrator at contract formation and within twenty calendar days of policy expiration dates, require that all subcontractors maintain equivalent insurance coverage, and notify the Contract Administrator within five business days of any policy cancellation. For claims-made coverage policies, the contractor must provide retroactive date coverage before the contract effective date and maintain evidence of coverage for a minimum of three years following completion of contract activities, or purchase extended reporting coverage if policies are cancelled or not renewed. The contractor must waive all rights against the State for damages covered by insurance, and failure to maintain required insurance does not limit this waiver or restrict the contractor's other contractual obligations.
