National Acquisitions Section Justification for Other than Full and Open Competition

1. Identification of the agency and the contracting activity- U.S. Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section (NAS).

Requiring Office: Trust Fund Branch (TFB), Inmate Communications Section (ICS).

2. Nature and/or description of the action being approved– This procurement action is to award a sole source, firm -fixed price acquisition for maintenance and operation of the Inmate Telephone System (ITS). This procurement will allow the Bureau's TFB to continue receiving services for the inmate telephone processing services from Science Application International Corporation (SAIC) without disruption to the ITS. The maintenance and operation of the ITS is required for a base period of performance from October 1, 2020 to September 30, 2021, and two (2) six-month option periods due to the current services expiring on September 30, 2020.

Pursuant to the Federal Acquisition Regulation (FAR) Subparts 13.106-1(b)(2)and 13.501(a) and the Bureau of Prisons Acquisition Policy (BPAP) Subpart 6.304(c), the Bureau has determined there is only one source reasonably available. The following is supporting documentation in accordance with FAR Subpart 6.303-2.

3. A description of supplies and services required to meet the agency’s needs – (including the estimated value)– This acquisition will provide ongoing support for the TFB ITS Bureau-wide. These services include the maintenance and operation of the ITS for inmates to continue to utilize the call processing service. Also, it is to provide the continuity of services during the transitioning phase of services to a new contractor, Verizon, who has been awarded the Enterprise Infrastructure Solutions (EIS) contract through the DOJ Justice Management Division (JMD). Verizon will oversee the Bureau's current ITS. The required services are considered mission critical in maintaining telephonic communications which allow inmates to call family, friends, and maintain community ties.

The estimated value of this procurement is $4,681,920.00.

4. Identification of the statutory authority permitting other than full open competition – The statutory authority permitting other than full and open competition is 41 U.S.C. 1901. The contracting officer (CO) determined that the use of this authority is appropriate pursuant to FAR Subpart 13.501(a), and that the circumstances of this action deem only a single source is reasonably available.

5. Determination that proposed Contractor's unique qualifications or the nature of the acquisition requires use of the authority cited – Due to the extensive transitioning required to change contractors, no other contractor with the expertise and knowledge to support the implementation of services is available in the required time. Any interruption to the inmate telephone service would severely impact the security of the Bureau's institutions, to include the safety of staff, inmates, and the general public. These services are critical in fulfilling the Bureau's mission of maintaining a sound correctional environment. It has been determined that a base period of performance from October 1, 2020 to September 30, 2021, and two

(2) six-month option periods, short term contract will be beneficial to the government to avoid disruption of inmate telephone services through the transitioning phase. SAIC has the necessary staff, equipment, and procedures to continue services on October 1, 2020.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies:

A notice of the Bureau's intent to issue a sole source award to SAIC will be posted to the Government Point of Entry (GPE) in accordance with FAR Subparts 13.105(a) and 5.203(a). The Justification For Other than Full and Open Competition will be made available to the GPE as required by FAR Subpart 13.501 (a) (1)(iii).

7. Contracting Officer's Determination that the Cost to the Government will be Fair and Reasonable:

Through market research, comparison of pricing to historical prices paid, Independent Government Estimate, and catalog pricing for the same and similar services, the Contracting Officer has determined the proposed price for the maintenance and operation of the ITS for the inmates to receive telephone processing services to be fair and reasonable.

8. A description of the market research conducted– Market research was conducted through the General Services Administration (GSA) Federal Supply Schedule (FSS), the National Aeronautics and Space Administration Solutions for Enterprise- Wide Procurement (NASA SEWP) V, and commercial market avenues to obtain competition for this acquisition. It was determined that numerous contracts have authority to provide services. However, services cannot be obtained from any other source in time to avoid an interruption in service due to the costs associated with a transition phase and the extensive security background clearances required. SAIC is the only vendor capable of providing services without a gap or delay.

9. Any other facts supporting the justification- N/A

10. List of Sources, Expressing in Writing, Interest in the Acquisition:

SAIC

11720 Plaza America Drive Reston, VA 20190

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made– For the reasons stated above, no actions are available that could remove competition barriers for the required services at this time. In addition, the CO will publish the justification within 14 days on the Government-wide Point of Entry website, beta.sam.gov, in accordance with FAR 13.501 (a)(1)(iii).
