About this file
This document is a requirements document for an ATF eForms system modernization project, detailing a comprehensive digital transformation of the National Firearms Act (NFA) controlled weapon application and registration process. The document outlines a phased implementation strategy (Crawl/Walk/Run/Fly) for a new Customer Relationship Management (CRM) system that will digitize and streamline firearms application processing, utilizing advanced technologies like Optical Character Recognition (OCR), cognitive AI, and automation.
Key features of the proposed system include automated application validation checks (criminal history, fingerprints, address verification), digital application tracking with color-coded status indicators, integrated payment processing through pay.gov, and a unified electronic platform for various NFA-related forms (Form 1, Form 4, Form 6, etc.). The system aims to significantly reduce application processing times, with a goal of approving NFA controlled weapon applications within 10 minutes, and will provide different user interfaces tailored to roles such as NFAD Examiners, Inspectors, and ATF executives, with robust reporting and tracking capabilities across multiple federal systems including NFRTR, FLS, and NSOT.

Text version
The National Firearms Act of 1934 and the update to Title II of the Gun Control Act (GCA) of 1968 said that certain kinds of firearms were hazardous to the health and safety of the community and set some standards.
- All covered firearms needed to be registered in the NFRTR (National Firearms Registration and Transfer Record), which is a database of the controlled weapon, transfers, applications, and current owners.
o But if you wanted sell NFA weapons, you require an FFL (Federal Firearms License) Firearms License System (FLS)
• Must be renewed every THREE (3) years
• Types o 1 – dealer of firearms other than destructive devices o 2 – pawnbroker in firearms other than destructive devices o 3 – collector of curios and relics o 6 – manufacturer of ammunition for firearms other than for destructive devices or armor piercing ammunition o 7 – manufacturer of firearms other than destructive devices o 8 – importer of firearms other than destructive devices or ammunition other than armor piercing ammunition o 9 – dealer in destructive devices o 10 – manufacturer of destructive devices, ammunition for destructive devices or armor piercing ammunition o 11 – importer of destructive devices, ammunition for destructive devices or armor piercing ammunition
• The records of an FFL’s license from issuing the license to closing the license is currently contained in a system called o FLS – Firearms License System
- All NFA weapons dealers needed to be registered with NSOT (National Special Occupational Tax) o If you wanted to make or deal in any of the NFA controlled weapons, you had to have an FFL from above, but also a SOT (Special Occupational Tax) permit.
Must be renewed every year Types
• Class 1 – can import NFA controlled weapons
• Class 2 – can manufacture NFA controlled weapons
• Class 3 – can retail sell NFA controlled weapons o The records of an SOT permit, from issuing the license, to closing the license, is currently contained in a system called NSOT - National Special Occupational Tax o NFA Controlled weapon types are
Machine Guns (MG)
• Any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot without manual reloading, by a single function of the trigger.
Short Barreled Rifle
• Rifle having a barrel or barrels of less than 16 inches in length.
Destructive Devices
• A missile having an explosive or incendiary charge of more than 1/4 oz.
• Any type of weapon by whatever name known which will, or which may readily be converted to expel a projectile, by the action of an explosive or other propellant, the barrel or barrels of which have a bore greater than one-half inch in diameter.
• A combination of parts designed and intended for use in converting a device into a destructive device and from which a destructive device can be readily assembled.
Short Barreled Shotgun
• Shotgun having a barrel or barrels of less than 18 inches in length.
Silencer
• any device for silencing, muffling, or diminishing the report of a portable firearm, including any combination of parts, designed or redesigned, and intended for the use in assembling or fabricating a firearm silencer or firearm muffler, any part intended only for use in such assembly or fabrication.
Any Other Weapon
• Any weapon or device capable of being concealed on the person from which a shot can be discharged through the energy of an explosive;
• A pistol or revolver having a barrel with a smooth bore designed or redesigned to fire a fixed shotgun shell;
• Weapons with combination shotgun and rifle barrels 12 inches or more, less than 18 inches in length, from which only a single discharge can be made from either barrel without manual reloading; and
• Any such weapon which may be readily restored to fire.
Then there was the Firearm Owners’ Protection Act in 1986.
It resulted in regulations that stated only the Machine Guns (MG) made before 19MAY86 could be bought or sold on the common market… and that only by holders of SOT licenses of the proper type.
Any machine gun (MG) made on or after 19MAY86 has to be made for the government or as a demonstration of the ability to make MGs for the government or another government.
Any one that is able to pass the background check is able to own any kind of weapon but if they wanted an NFA controlled weapon, people had to apply to own one… and the ATF&E would need to run your fingerprints and a criminal history check on the applicant to make sure they were not in violation of any disqualifying laws.
And anyone is still able to make their own guns at home, as long as it was not any of NFA controlled weapon types. If they are making a NFA controlled weapon, they need to apply for permission to make it… but ALL MGs are banned, except for those that meet the exception above.
In 2013, the ability to file NFA controlled applications via the web became a reality. While there will always be the ability to submit an application by paper, we need to drive as close to 100% of the submitted application traffic, across the spectrum of all ATF applications, to the eForms platform. Any paper application needs to be an edge case and for some reason outside of the normal processing flow.
The applicant would go online to https://eforms.atf.gov and fill out applications for an NFA controlled weapon on various forms. Some of these forms are not currently part of the eFroms platform. A brief discussion about the process to bring a form from inception to use in a digitized format, to include approximate time to market, is expected.
Currently, ATF\EPS is in the process of bringing the Form 7, Form 8, FFL RPQ, Form 20, Form 23, Form 24, Form 5400.13., Form 5400.16, FEL RPQ, FEL EPQ, Form 5630.7, as well as some ancillary forms to the eForms platform. The brief discussion regarding the digitization of the forms would give a real time impact analysis and data point for the beneficial use of OCR (Optical Character Recognition), cognitive AI, and automation to meet the ATF needs and goals at the ‘rubber on the road’ level. Some of these forms include payment through pay.gov as part of their processing, others do not.
Discussion within the demonstration will define time and cost benefits to leveraging a CRM with OCR, cognitive AI, and automation in the development process of getting these forms completely and successfully implemented on the eForms platform.
A brief discussion about the speed at which an API can be set up for use in submitting tax free only applications from our Industry partners, including the leveraging of AI to groom the incoming data. This will include the F2, F3, F9, F6p1, F6a, and possibly others.
A brief discussion regarding the implementation of a submission of a form that includes a templated list of weapons in a Microsoft Excel spreadsheet also using AI to groom the data. This spreadsheet will be scanned and ingested into the application, data loaded into the system from the spreadsheet, and submitted as part of the application, rather than a distinct file.
A brief conversation about the feasibility of using OCR on soft data (paper form) to create digital date (digitized application) in the application process, should a paper form come into the process.
- Form 1 o An individual wants to make an NFA controlled weapon (NFA controlled weapon birth certificate) o If there is a Trust involved, this will include RPQ(s) (Responsible Person
Questionnaire) in the form of a Form 23 (below)
- Form 2 o An FFL and SOT holder is telling the ATF&E that they are making or importing an NFA controlled weapon.
- Form 3 o An FFL license holder with SOT transferring an NFA controlled weapon to another FFL holder with SOT or the government
- Form 4 o A person taking ownership of an NFA controlled weapon as an individual, in a trust, or by a corporation o If there is a Trust involved, this will include RPQ(s) (Responsible Person Questionnaire) in the form of a Form 23 (below) o Examples of a Form 4 application FFL to individual\Trust\Corporation\Government Entity Individual to individual\Trust\Corporation\Government Entity Trust to individual\Trust\Corporation\Government Entity Corporation to individual\Trust\Corporation\Government Entity
- Form 5 o A person or license holder wants to tax exempt transfer and register the NFA controlled weapon to another individual, a trust, FFL, or a corporation o Usually, a government-to-government transfer o Only exceptions are
When the NFA controlled weapon is not servable When the NFA controlled weapon is being transferred to or from the
United States or any state organization When the NFA controlled weapon is being transferred to a beneficiary of an estate When the NFA controlled weapon is being transferred to a lawful heir
- Form 6 (aka Form 6p1 or Form 6 part 1) o An FFL is asking to import GCA controlled weapons, ammunition or defense articles into the United States.
o An FFL and SOT holder is asking to import NFA controlled weapon, ammunition or defense articles into the United States.
o A Form 6 has a lifespan of five (5) years and the total quantity can be broken up across those five (5) years.
- Form 6a o An FFL is importing a part of the total quantity of approved weapons on a Form 6p1
- Form 6p2 o Used for individuals in the military that would like to import a weapon.
- Form 6 NIA (Non-Immigrant Alien)
- Form 7 o An application for a new FFL o Includes the Form 7b
FFL RPQ (Responsible Person Questionnaire)
- Form 8 o Renewal of an FFL
- Form 9 o An FFL and SOT holder is asking to export NFA controlled weapon, ammunition or defense articles out of the United States
- Form 10 o The government is registering an NFA controlled weapon that it acquired
(NFA controlled weapon birth certificate)
- Form 20 o A person that owns an NFA controlled weapon is going to take the weapon to a new location… might be a permanent or a short trip, but that weapon is leaving the house.
- Form 23 o NFA RPQ (Responsible Person Questionnaire) o Submitted for every RP listed on an NFA application in a trust document
- Form 24 o Law Letter o Designates a weapon for Law Enforcement purposes for manufacture or transfer.
- Form 5400.13 o An application for a new FEL (Federal Explosives License) o Includes the FEL RPQ o Includes the FEL EPQ (Employee Possessor Questionnaire)
- Form 5400.16 o Renewal of FEL
- Form 5630.7 o Special Occupational Tax (SOT) application\renewal\update form o This works in conjunction with FLS as the records must match exactly.
What we are looking to see, would be an application go through the approval/disapproval process for the NFA controlled weapon, particularly a Form 1, a Form 4, a Form 6, a Form 7, and a Form 8 and the reporting on the NFA controlled weapon registrations (approvals/disapprovals with a breakout of why forms were disapproved). This will include examples of OCR, automation and the use of cognitive AI to benefit ATF and speed the approval process.
All forms will initially be submitted through the eForms system and the data ingested into the correct db schemas. With this in mind, a reimagination of the eForms system will be required as well as the creation of a path forward for the processing of the forms.
The relaunch\reimagining of the eForms system will be part of the initial Crawl\Walk\Run\Fly deployment of the CRM instance.
The ATF is currently moving to Login.gov for its externally facing portals, of which, eForms is the primary external portal. Any implementation would need to be compatible with Login.gov as the MFA source.
A successful CRAWL implementation and the associated plan/timeline proposal are the end product of this demonstration.
The WALK implementation is where the heavy lift of the platform migration\conversion takes place and is determined by the RUN implementation. A proposed timeline for the WALK implementation is sought as well. This is the phase where the bulk of the business rules will become part of the development process.
A successful RUN implementation will be the POS (Point of Sale) approval process for a NFA controlled item. This is defined as a user submits an application for the NFA controlled item, through the eForms system, and through the use of the CRM implementation, cognitive AI, and automation controls, the form will be through the approval processes and the approved application form will be back to the FFL and applicant in ten (10) minutes or less, via the eForms system.
The FLY implementation has also already been determined but is not relevant to this demonstration.
The eForms system will become the “one stop shop” for the external customer to log into and execute any interaction with the ATF. A brief explanation and proposed view of the home\landing page is included in this document.
Form 1 and Form 4 might look like:
- there are some nuanced differences like a Form 4 will need to have a listed FFL holder as the seller, with an SOT
- focusing on the electronic path o the paper driven path will be extremely similar, except will need a role to do the data entry and that is just too far a bridge right now and 97% of the work is electronic submission
- the current environment uses pay.gov for payments for applications, FFL, and SOT.
o Any application moving forward will have to have this stitched in as well
- The system will be PIV enforced and authenticate against the PIV for any actions.
o Single Sign On (SSO) o If the PIV is removed from the machine, the system will log the user out.
Back to login page o Zero Trust environment
- All of these have merit:
o The Primary Object could be the
Application
• It is required to retain for documentation
• The finalized copy is an indexed version
Applicant/Trust/Corporation/FFL or SOT
• Multiple NFA controlled weapons for each
• Tracks the entity and the NFA controlled weapon they have o Easier to spot trends The NFA controlled weapon
• Follows the life of the NFA controlled weapon o From maker to seller o From seller to buyer o From buyer to heir o Etc.
