About this file

This is a template form for Indian Economic Enterprise representation and self-certification required by the Indian Health Service (IHS) under the Buy Indian Act authority. The form is used in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations for federal contract opportunities.

Offerors must certify whether their enterprise meets the definition of an "Indian Economic Enterprise" with Indian Ownership as defined in EHSAR 326.601. The enterprise must maintain this eligibility status at three critical points: at the time an offer is submitted, at the time of contract award, and throughout the entire contract performance period. Any change in eligibility status during these periods requires immediate written notification to the Contracting Officer. Contractors must also be registered with the System of Award Management (SAM). The form requires submission of the Federally Recognized Tribal Entity name, the name of the 51% owner of the Indian Economic Enterprise firm, business name, Unique Entity Identifier (UEI) number, and a certifying signature. False or misleading information submitted with an offer is subject to penalties under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
