Sought Notice in July 2016. At that time, only one (1) response was received from Hexagon U.S. Federal (doing business at the time as Intergraph Government Solutions
(IGS)).
Hexagon is the only responsible source to accomplish the services as identified in the modification covered by this justification and approval because of: 1) The exclusive software licensing agreement, 2) Proprietary language for their CAD 9.4. software, which means only they are able to make the upgrades and changes to complete the CAD at the three locations pending completion (Forts Stewart, Hood, and Bragg), and 3. Agency desire to avoid increased costs from using a new contractor for the work under the modification which would not be recovered through competition.
(a) Alternatives: Due to the necessary utilization of the Hexagon CAD 9.4. software which allows the interoperability with civilian law enforcement and fire agency communications and dispatch systems, there are no current viable alternatives to this requirement. All of the locations identified as a recipient of the CAD upgrade are currently operating some previous version of the IGS/Hexagon CAD software, and the mingling of multiple CAD software data is not feasible.
(b) Impact: Since this modification continues to support the directives set out in the Secretary of Defense’s After Action Review findings and recommendations from the Fort Hood shooting of 2009, and Department of Defense (DoD) Instruction 6055.15, DoD Emergency Management Program (13 Feb 17), the necessity of completing this requirement is paramount. The need for horizontal and vertical reporting in the event of emergencies between Federal, DoD, State, and local first responder agencies is of the utmost importance to prevent unnecessary loss of life, cohesive communication, and ensures the safety and well-being of those located at the CAD upgrade locations.
Failure to continue and complete the installation of a fully operable CAD system could ultimately impact the safety and security of DoD personnel stationed at the ten U.S.
Army Garrison locations identified. In addition, not upgrading the CAD system will result in non-compliance with the Federal Information Security Management Act of 2002
(FISMA).
6. Efforts to Obtain Competition: Currently, the Hexagon CAD 9.4. software upgrade package (to include ancillary services) is the only technical solution that meets the performance characteristics and interoperability specifications of the current CAD systems in place. As previously noted, Hexagon U.S. Federal is the sole provider of the required CAD upgrade and there are no authorized resellers. Competition was sought in advance of the original contract award and the Government received no additional responses. The Government will continue to review market research to identify any new technologies or capabilities that may allow the Government to compete this requirement in the future. The Contracting Officer will publish any notices as required by FAR 5.201.

7. Actions to Increase Competition: Future acquisitions will always be in compliance with existing FAR and Army policies with regard to conducting market research and soliciting vendor input to identify perceived barriers to competition. In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) PGI 208.405-6, the planned actions to increase competition for this requirement have been met to the best ability possible under the current circumstances, as determined by the Contracting Officer. As there was no other industry response to the original sources sought synopsis posted for this requirement other than from Hexagon U.S. Federal, and while the solution is still very much a work in progress (a fully functional CAD system at the ten identified locations has not been completed or accepted by the Government), a proposed change to a different vendor (was there one available) would not be in the best interest of the Government at this point. Competition (as available) will be utilized to the maximum extent practicable in future similar acquisitions.
8. Market Research: As previously indicated, extensive market research was conducted in advance of the initial contract award (W9124J17FF934) on 29 Sep 17. As a completed, fully-functional CAD system has not be delivered, and this modification is for continued work on the existing requirement, market research was not conducted in conjunction with this modification. The contracting officer has reviewed this market research and has determined it to be still valid.
9. Interested Sources: As previously indicated, Hexagon U.S. Federal is the only known provider of the Hexagon CAD 9.4. software and previous market research has determined no other sources for this requirement.
10. Other Facts:
a. Procurement History
(1) Contract W9124J17FF934 was awarded on a sole source basis (Justification and Approval 2016-75 and amendment 2016-75-01) to Hexagon U.S. Federal on 29 Sep
17. The original contract had a period of performance of 29 Sep 17 through 28 Mar 19 for $6,419,162.59.
(2) Contract modification W9124J17FF934P00001 was executed on 26 Mar 19, which extended the period of performance out to 31 Mar 20, and increased the contract total amount by $2,199,785,08, from $6,419,162.59 to $8,618,947.67. This modification was driven from NETCOM direction to deviate from the current proposed CAD solution due to Army network compatibility and access issues. As such, a longer period of performance, and funding for additional components (hardware, software) was necessary to adjust the requirement to the new solution.

(3) Contract modification W9124J17FF934P00002 was executed on 1 Aug 19, which extended the period of performance once again from 31 Mar 20 to 31 Jul 20, and increased the total contract amount $681,180.61, from $8,618,947.67 to $9,300,128.28. Due to Government delays/issues with fielding the assembled CAD systems and obtaining NETCOM and Garrison authorization for access to the local networks, an extension of the period of performance was once again required to complete the CAD requirement. Additionally, an extension of software maintenance was required in order to keep the assembled CAD systems updated with current software and certificates. The CAD systems were being assembled and temporarily activated at the contractor location, and moved to the eventual garrison location when appropriate.
(4) In the May 20 timeframe, direction from NETCOM indicated that the solution developed on modification W9124J17FF934P00002 (26 Mar 19) was no longer feasible given current Army information technology directives and guidance, and a new solution was required. Three of the ten locations (Hood, Stewart, & Bragg), due to the progress made thus far, were allowed to remain on the local garrison networks, but the remaining seven are not going to be allowed access, and yet another solution is required. The requiring activity identified a potential solution of utilizing a commercial data center (which an associate contract, Mobile Federal Law Enforcement Enterprise Technical Services (MFLEETS) W9124J19C0043, is utilizing), which would remove the CAD systems from the local networks. A revised PWS with this new proposed solution was provided to the contractor (Hexagon U.S.
Federal) on 30 Jun 20, and they commenced work on the new solution. In the meantime, the current contract was set to expire on 31 Jul 20 without a complete CAD system in place, and another extension to the period of performance was required. In response to the Government’s inquiry, the contractor identified several components and services identified on their 13 Mar 30 proposal (H20-0005) which could be executed towards the eventual employment of the CAD system. Limited Sources Justification (LSJ) 2020-25 (Attachment 1 of this LSJ) was executed on 30 Jul 20 in support of a contract modification for $699,989.10 of the $1,572,288.68 proposal total for these services and components. This action left $872,299.58 in CAD related services and components yet to be executed (as needed).
(5) As the commercial data center technical solution continues to be developed and coordinated with the Government, there remains several components of the CAD requirement which were identified and required execution to continued work towards an eventual fully-functional CAD system at ten Army Garrisons (items a – e of paragraph 3 of this LSJ). After dialogue with the Contractor and requiring activity (HQ IMCOM), it was determined that a contract modification for $658,425.82 (of the remaining $872,299.58 on the 13 Mar 20 proposal (H20-0005)) was necessary to continue progress on the CAD systems. This LSJ is for those continued services and components.
