About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the purchase of two Illumina MiSeq System instruments by the Naval Medical Research Command (NMRC).

The J&A states that NMRC requires the Illumina MiSeq Systems to maintain its state-of-the-art genomics and bioinformatics research program, which is involved in sequencing clinical and metagenomic samples for infectious disease surveillance, including COVID-19. Illumina, Inc. is the original equipment manufacturer (OEM) and the sole source for this equipment. NMRC intends to award a firm-fixed price contract to Illumina, Inc. for the MiSeq Systems, citing the statutory exception at 10 U.S.C. 2304(c)(1) and FAR 13.106-1(b)(1) for soliciting from a single source. The Contracting Officer will determine the price to be fair and reasonable. No other sources have expressed interest in this acquisition.

JUSTIFICATION AND APPROVAL

OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity.

This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet the Naval Medical Research and Development mission.

2. Nature and/or description of the action.

The need is for 2 Illumina MiSeq System instruments. The Government intends on awarding a Firm Fixed Price contract. The proposed source is Illumina, Inc. 5200 Illumina Way, San Diego, CA 92122-4616.

3. Description of Supplies or Services:

The Genomics & Bioinformatics Department of the Biological Defense Research Directorate, Naval Medical Research Command maintains a state-of-the-art genomics and bioinformatics research program. The department is currently engaged in sequencing of clinical and metagenomic samples for surveillance of human infectious diseases, including COVID-19 samples, arthropods samples suspected of carrying virus causing Acute Febrile Illnesses, etc. As part of this on-going effort, the DoD-accepted standard in High-throughput Sequencing (HTS) workflows are being utilized. This state-of-the-art laboratory instrumentation must be maintained. In order to maintain our sequencing capabilities, we are requesting the purchase of new MiSeq instruments to replace old sequencers (used for >10 years).

Funds will be used to purchase 2 Illumina MiSeq Systems.

4. Identification of the statutory exceptions permitting other than full and open competition.

The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and FAR 13.106-1(b)(1) soliciting from a single source.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

Illumina, Inc. is the OEM of this laboratory instrument and is the ideal source of the product. In addition, Illumina, Inc. is the only vendor that can provide a trade-in discount for our current outdated instrumentation.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

There are no other vendors. Market research was performed, the results of which are in paragraph 8. This requirement will be posted to NECO and/or FedBizOpps in accordance with

FAR 5.202.

7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Office shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.

Market research was conducted by technical experts in the February 2024 timeframe. The results of the market research are documented in a Market Research Memorandum.

9. Other facts supporting the use of other than full and open competition.

The sequencing division currently utilizes sequencing systems that are over 10 years old for their state-of-the-art genomics and bioinformatics research program. It is imperative to update these instruments to continue providing quality genomics and bioinformatics research to the DoD.

10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.

To date, no other sources have written to express an interest.

11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Future requirements will be synopsized in accordance with FAR 5.203.

For the reasons set forth in Paragraph 5, NMRC has no plans at this time to compete future contacts for the types of services covered by this document. If another potential source emerges, NMRC will assess whether competition for future requirements is feasible.

12. Point of Contact.

The point of contact at the Naval Medical Research Command, Silver Spring, MD, regarding the contents of the sole source justification is, Deborah M. Sharpe, who may be reached at (301) 319-6471.
