About this file

This is an Indian Economic Enterprise Representation Form used by the Indian Health Service (IHS) for Buy Indian Act compliance in federal contract solicitations.

The form serves as a self-certification document that offerors must complete to demonstrate eligibility as an "Indian Economic Enterprise" (IEE) with Indian ownership in response to Sources Sought Notices, Requests for Information (RFI), or solicitations issued under Buy Indian Act authority (25 U.S.C. 47). Offerors must meet the IEE definition per HHSAR 326.601 at three critical junctures: when submitting an offer, at the time of contract award, and throughout the entire contract performance period. Any changes in eligibility status during these periods require immediate written notification to the Contracting Officer. The form requires the offeror to indicate whether it does or does not meet the definition, and must include the name of the federally recognized tribal entity, the 51% owner of the IEE firm, the business name, and the SAM UEI Number. Individual contracting officers may request documentation of eligibility prior to award, and awards may be subject to protest if the successful offeror's eligibility is questioned. The form warns that false or misleading information constitutes a violation of 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also maintain current registration with the System of Award Management (SAM).
