About this file

This is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form used for federal contract opportunities.

The form serves as a self-certification document for offerors responding to Sources Sought Notices, Requests for Information (RFI), or Solicitations issued by the Indian Health Service. Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with Indian Ownership under the authority of 25 U.S.C. 47 (the Buy Indian Act) and HHSAR 326.601. Enterprises must maintain eligibility status throughout three critical periods: when submitting an offer, at the time of contract award, and during the entire contract performance period. Contractors must notify the Contracting Officer immediately if they no longer meet eligibility requirements at any point. The form requires entry of the solicitation or sources sought number, project title, and submission date. Offerors must provide the name of the Federally Recognized Tribal Entity, the 51% owner of the Indian Economic Enterprise firm, business name, DUNS number, and certification through authorized signature. Successful offerors must also register with the System of Award Management (SAM). The form emphasizes that false or misleading information constitutes violations under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Individual Contracting Officers may require supporting documentation of eligibility, and awards may be protested based on offeror eligibility questions.
