JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division Lakehurst, NJ
2. Description of the Action Being Approved.
This Justification and Approval establishes authority for the procurement of Maintenance and Support Services for three (3) Joint Intermittence Tester (JIT) - Intermittent Fault Detection and Isolation System (IFDIS) units and their associated Test Program Sets located at FRC West (FRCW) Lemoore, FRC Mid-Atlantic (FRCMA) Oceana, and FRC Southwest (FRCSW) North Island. The Government intends to award a three (3) year definitive contract to Total Quality Systems (TQS) Inc. of Roy, UT to sustain each site’s intermittent fault detection capability.
3. Description of Supplies/Services.
This procurement is for the purchase of a Maintenance and Support Services contract to support the (3) JIT-IFDIS units installed at FRC West Lemoore, FRCMA Oceana, and FRCSW North Island. TQS shall provide the Government with on-call technical assistance, on-site support, upgrade installations, technical documentation, configuration management and preventative maintenance services. If any upgrades are made to the JIT-IFDIS while this requirement is in place, the contractor shall be responsible for the maintenance, repairs, support equipment, parts, software, and configuration management of the upgrades. The Contractor shall provide all new configurations, modifications, or upgrades to include supporting documentation (i.e. applicable drawings and technical manual changes/revised pages) to the Government within 30 days of completion of upgrade installation.
4. Statutory Authority Permitting Other Than Full and Open Competition.
In accordance with Title 10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The technology of the JIT-IFDIS was developed by TQS from the award of Air Force Small Business Innovation Research (SBIR) Phase I contract number F42650-01-C-0169 on 10 February 2001, resulting from Solicitation 2001.1, Topic AF01-296, titled “Tracking Current Flow through Units Under Test (UUT).” TQS was subsequently awarded SBIR Phase II contract number F42650-02-C-0081 on 8 May 2002 and N68335-17-C-0571 on 31 July 2017. Only TQS has the SBIR data rights to make any diagnostics, modifications, upgrades or repairs to the JIT-IFDIS units. Due to this fact, TQS is the only contractor with the data rights necessary to service the JIT- IFDIS. Additionally, if the Government were to procure the required maintenance and support services from another contractor, it would cause the Government to incur a substantial duplication of cost. The Government would have to develop new Test Program Sets for each supported Weapons Replaceable Assembly developed by TQS at an estimated cost of $2.9 million and three years of development. This substantial duplication of cost is not expected to be recouped during a competitive sourcing of the required maintenance and support services. Accordingly, TQS is the only contractor that can fulfill the Government’s requirements to service the JIT-IFDIS.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The Government performed market research via internet search engines such as Google, Bing and the Small Business Dynamic Search to canvas the market place for viable sources to fulfill its requirements. The Government searched for terms such as “intermittent fault detection” and discovered that in recent years, intermittent fault detection technology has matured, which has enabled companies to begin development of automated test equipment to capture intermittent open and short circuits within the 50 nanosecond or greater range in weapons replaceable assemblies.
The market research discovered several original equipment manufacturers that build similar equipment with Intermittent Fault Detection (IFD) technology such as DIT-MCO International, DERCO Aerospace, Lockheed-Martin, Copernicus Technology, and Flight Research Incorporated. The market research also revealed that Universal Synaptics holds the patent for the IFD circuit card assemblies within the JIT – IFDIS bench; however, the company does not offer repair services for the entire JIT – IFDIS bench. TQS is the first and sole company to develop a test bench along with unique test program sets utilizing this new technology to detect faults in essential avionic components and retains SBIR data rights.
The Government posted a Request for Information (RFI) N68335-19-RFI-0175 on 07 February 2019 and ended on 09 March 2019 in accordance with FAR 6.303. This original RFI yielded one
(1) response from TQS. In accordance with FAR 5.202, a synopsis was posted on 28 August 2019 and it closed on 12 September 2019. The Government did not receive any challenges in response to the synopsis.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The contractor will submit a formal price proposal with data other than certified cost or pricing data and sufficient information to support the accuracy and reliability of the proposal estimate. The proposal will be reviewed by experienced technical analysts, cost analysts, and contract specialists with the aid of necessary field pricing support, as required. The Contracting Officer will utilize data other than certified cost or pricing data for analysis and historical pricing information as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
No future procurements are planned at this time. However, PMA260 continuously conducts market research via various DoD and commercial consortiums and will assess whether competition for future requirements is feasible.
