The contract award will be made on the basis of BEST VALUE as determined by CALPIA alone, under statutory authority considering the following criteria:

1. Cost: Fair, reasonable, and competitive price, expressed warranties, life cycle of product, and customer service commitments for goods and or services.

Minimum Bidder Qualifications:

CALPIA will only contract with manufactures or representatives of the manufacturer who agree to work in the unique Correctional Industries setting. Only products offered by the manufacturer will be eligible. If the manufacturer declines to participate, the representatives will not be eligible to offer their product for sale to CALPIA. Bidders can view CALPIA’s current seating line by going to its website at www.calpia.ca.gov to visit the CALPIA store.

Kits will be ordered unassembled (as sub-assembled kits) to be assembled by CALPIA’s ordering factory. There may be occasions when CALPIA will need to order completely assembled chairs. Bidders are not required to bid on every line item listed on the Cost Sheet to be considered responsive.

Any contract resulting from this bid will expire three years from its effective date unless extended. However, in the event the ordering agency’s requirements are curtailed because of reducing requirements, cancellation of State programs, lack of fiscal appropriations, etc., the State shall be excused from purchasing any outstanding balances.

The State will not be obligated to purchase the contractor’s excess inventory of any line item if actual purchases vary from the anticipated purchase pattern. The State reserves the right to order more or less of any line item.

All documentation supplied will reference both Contractor and CALPIA numbering. All component part drawings are to have completed dimensions, including

“point to point” dimensions that allows CALPIA to inspect component parts upon delivery for compliance. All non-compliant products will be returned to Contractor at Contractor’s expense and shall be replaced within 10 working days of notification to the Contractor by CALPIA.

Engineering Change Notifications (ECNs):

Contractor will notify CALPIA in writing or via e-mail of any planned or intended ECNs for any component or material prior to shipments of any effected parts and at least 30 business days prior to proposed change. ECN must include reason for change, drawings, assembly instructions/specifications or requirements with associated revision dates, any additional equipment requirements and ANSI-BIFMA test results if applicable

CALPIA must be notified of any ECN defective parts recall, or ECN affecting any current product in inventory or previously provided from contract implementation, which may be deemed a safety issue (i.e., product safety recall). CALPIA has the right to reject ECNs and retains the right to terminate use of product affected in contract.

Certified Test Reports (CTR):

Delivered products may be subject to additional testing to determine if delivered product meets specifications. If the delivered product doesn’t meet the specifications, CALPIA may terminate for default in accordance with General Provisions, Clause 72.

Should there be any issue with quality and/or damage to the final product, CALPIA can request a written Corrective Action Plan (CAP). A CAP will be provided to CALPIA from the Contractor no later than three (3) business days from time that the incident is reported to the Contractor contact. The CAP will contain the nature of the reported issue, what immediate actions are taking place to correct the problem, and how the problem is going to be prevented from occurring again. The CAP can also contain any other relevant information that the Contractor feels is necessary to explain the situation. CALPIA may issue a vendor performance report based on the circumstances.

The intent of these questions is to establish that the bidder has secured the necessary production, distribution and financial resources to fulfil the contract being proposed.

Except in cases when CALPIA concludes that a specified brand name is the only one that will meet the needs of CALPIA, all commodities shall be entered into with the best value bidder meeting all specifications. Responsibility in this context relates to the bidder’s qualifications and capability to successfully fulfill the requirements of the Invitation for Bid (IFB). Prior to awarding the contract related to this IFB, CALPIA’s Authorized Representative will determine whether the proposed awardee is responsible. In order to obtain information necessary to establish a bidder’s responsibility, each bidder shall complete the information requested below.

Failure to complete these questions may cause your offer to be rejected as non-responsive. Incomplete, vague or misleading responses could cause your offer to be rejected as non-responsible. Use additional sheets as necessary to provide all the requested information.

Bidders who are manufacturers should be able to directly respond to the questions. Non-manufacturers may need to consult with their supply chain to properly complete each question. The burden of proof lies with the bidder to prove, to CALPIA’s satisfaction, that the bidder has adequate knowledge and control of the supply chain being utilized.

Please be prepared to provide a written agreement between your firm and your supplier upon request. If your supplier is not the manufacturer, please be prepared to provide a written agreement between the manufacturer and your supplier. If there is no written agreement between these two parties, provide upon request supporting documents showing that they have worked together in the past.

CALPIA Supplier Code of Conduct Approved 9/16/16

Supplier Code of Conduct

The California Prison Industry Authority (CALPIA) is committed to working in partnership with our suppliers to follow a code of conduct in the areas of employee labor conditions, health & safety, environmental management, business ethics, and corporate social responsibility. We have updated our policies to simplify communications about CALPIA’s values and how they extend to our supply chain partners.

Our supplier code of conduct explicitly communicates our corporate social responsibility expectations to our suppliers and their chain of suppliers. While the vast majority of our suppliers are already working to these or similar standards, and may well have supplier standards that reach back into their own supply chains, we continue to work closely with our suppliers to ensure they fully comply with our Code of Conduct provided on the following page. Integrating the supplier code of conduct into all new contracts is one way we assure compliance. We also require that our distributors reach out to those suppliers who manufacture the products we purchase through them, and return their signed copies back to CALPIA. The supplier code of conduct must be signed by the organization’s Chief Executive Officer (CEO) or Chief Financial Officer (CFO) or his or her designee.

Many of the areas covered in the code are easily understood and simple to follow, but some may require more clarification or additional discussion to gain a common understanding. If you have any further queries about this process, please contact the Contract Analyst designated in the Invitation for Bid.
